I told the ***s that it would take three pieces of equipment one on the end loading rock and one on the end loading dirt not two you cant haul both ways without something to load with on both ends so that was a lie I told them the fair way to do this job was by the hour
because no one new how thick this rock was and how many loads of dirt it would take to fill the hole back up I had another customer down the road that wanted some rock I asked mr *** that sense there was so much rock there that we could haul it to them and I would not charge them dump truck or bobcat time which I didnt and it would save them money said great mr *** and I talked nearly every to or three loads of dirt he seen every load going out and every load coming not once did any body say anything about the size of loads they were ton loads both ways we still had lots of rock to haul off I told him I would not charge any bobcat time on loading end which I should have I did not charge any mobilazition time moving bobcats around I was very fair with them on price I broght a itimized bill to them and showed her every hour that was spent and where I should have charged t for another bobcat Tell us why here

With regards to not being able to determine a projected cost up front due to not knowing the thickness of the gravel pad, MrMarr could have given us a price range (low vshigh) so that we could have made a decision about which company to hire. When he tells us $85/hour each for two pieces of equipment, and 2-days to complete the job, we clearly interpreted that to mean $4,000. Then, when he took several loads of gravel and black dirt from our property, to sell to another customer, we rightfully believed that the bill would be reduced. He mentions that three pieces of equipment were used; however, the three pieces of equipment were not all used at the same time, and there was only one person operating all three pieces of equipment; therefore, we should not be charged $85/hour for equipment that is sitting with no operator. An equipment delivery fee was never mentioned until I confronted MrMarr as to why the bill was so high and the job not done. Finally, with regards to us never complaining about him only partially loading his dump truck when he was transporting dirt/gravel, this is precisely why we confronted MrMarr prior to the job being finished. We felt, and MrMarr confirmed through his bill, that he was "milking" the bill by only hauling partial loads, and in turn, extending the number of hours it was taking to complete the job.
