12/14/The mediator spoke to the CONS and notified the CONS that the BUS is unwilling to issue the $refund that the CONS is seeking. The CONS is disappointed that an A+ rated accredited member of the Revdex.com would conduct business in this fashion. The CONS wants to make sure that this complaint stays on the BUS' record

Here is what I have that is not a text message. First off, when I accepted the work from *** ***, I sent him the following email onOct 27with the warning not to damage the new(ish) year roof (*** in the "to" is my son). Previously, I sent him (and other potential contractors) the attached pic of the back of the chimney and the repair work required. It was from an email datedSept 11. The pic isn't super clear, because the point of the pic wasn't to focus on the shingles...but if you zoom in, you certainly don't see all the cracking that the post-John Paul damage pic shows (2nd attached pic). I also sent that damage pic to my roofer, who called me, and over the phone, told me it definitely needs repair and that he would send a guy to fix it for free but we had to pay for one bundle of shingles. Note how the shingle closest to the chimney is NOT damaged, because they didn't stand right up against the chimney to do their work...they needed some space between their body and the chimney, so all the damage is confined to the next 1' to 3' back from the chimney, where they stood or sat while doing the work. The second shingle back shows slight cracking, but the 3rd through 6th shingles show a lot of cracking that my roofer said could result in leakage. Lastly, the shingle purchase from Frederic Roofing is attached. Thanks for your help on this. Mosty I want to be sure that other folks who are considering this contractor know what to expect. I would be surprised if one in ten homeowners that have work done on their roof ever go up and check it out afterwards....there is a certain amount of trust in this kind of thing. Well, I did, and this is what I found! Besides the damage, his workers didn't wear dust masks while spending almost hours grinding out the old mortar...they were covered in white dust (see this link for the health risks to his employees: ***). I suppose OSHA should be called about that. Again, thanks for taking this second look. *** ***Oct 27to***,***excellent, thank you! I will be around in the event there is anything I can do to assist. Hopefully you have some way to protect the year old roof adequately while you do this work

I am responding to this complaint that has been filed. He owes me money. He did not give us a chance to complete the job on his home. If we were given the opportunity to have finished the job, the customer would have been satisfied with our work. However, he threw us
off the job due to the lack of funds to pay us not because of our work but due to unforeseen personal expenses of his that he no longer could pay us. He then fabricated problems with our work to try to justify in his view that our work was not good. This was also expressed to us by the police officer that spoke to us. I am given no other recourse but to file a lien on his home

I am rejecting this response because:I forwarded the invoice for the shingles to John Paul today, but I found the email where I had already forwarded it to him on Nov 15. Today, I also forwarded the "before" picture of the roof, when it was in perfect condition and nobody had been on the roof between the "before" pic and after John Paul performed the tuck pointing (and simultaneously trampled/damaged the shingles).After the job was completed, I actually never told *** *** the job was excellent, as he purports. I told him the tuck pointing looked like it should be fine to weatherproof the chimney for many years to come, but in reality it was somewhat sloppy, cosmetically. I did not complain about the quality since it is on the backside, facing the roof, and not visible from the ground. As I said in the original Revdex.com complaint, after I inspected the work, I did not initially discuss the damage he did to the roof when he completed the job because I needed to check with the roofer first to see if the damage was critical or cosmetic. When I sent the picture of the damage to the roofer, he said it must be repairedI then contacted *** *** via email and text to make amends. In his first reply, he denied causing the damage. Then I sent him the damage photo. Then his second response claimed that since I paid, I implicitly accepted his work so he was off the hook. I will repeat that the roofer did us a big favor by fixing John Paul's damage for only the cost of the shingles...no labor cost. I would not go through all this Revdex.com complaint effort to somehow try and scam $from the contractor, on an $job.

Regarding this complaint, I received a message from the Revdex.com that since the complaint appeared valid and couldn't be resolved, it was going to arbitration. A couple days later I get a message from the Revdex.com that "the business has provided Revdex.com with its position. This matter is now closed...". How is that so? What happened to the arbitration? It almost appears like the company paid you off! Is the Revdex.com looking out for the consumer at all anymore? This guy is a horrible contractor and should never have a A rating. I was duped by the Revdex.com when I chose him. Now others will continue to be also. Please explain

I am not paying for damage that I did not do. The damage was there prior to my work and the consumer paid in full after we completed the work and was happy with the job. The damage has nothing to do with my tuck pointing work.
