This is in response to complaint ID [redacted] dated 62015I believe this complaint has been incorrectly associated with JRP- New York.Also please note that JRP never received the original complaint.FACT: [redacted] is NOT a client of John Robert Powers NY [redacted] has questioned JRP’s selling practices yet, [redacted] has not been involved in the process [redacted] did NOT attend the audition and Free Workshop [redacted] has included new information which states “I have been contacted by John Robert Powers regarding complaint ID [redacted] ” I would like to know who [redacted] spoke to regarding this complaint since JRP never received the first letter from the Revdex.com and this is the first time hearing of this complaintOur phone records do not show such a callI would be the only person that would handle such a call I have never spoken to [redacted] .In [redacted] ’s complaint to the Revdex.com there are several other falsehoods [redacted] states that “in the radio commercial for this business they were looking for all actors ages 14-25, and that the first one- hundred callers would receive a free audition and acting workshop .”The ad states “JRP, Is Having Pre-Screening Auditions Pre-Screening Auditions Will Be For Guys And Girls Ages Four To Twenty-FiveThe First Will Win A Free Acting And Modeling Workshop! Never in our radio announcement does it say “Free audition” Never did we say looking for all actors ages 14- [redacted] needs to get her facts straight before she makes a complaint and then calls it “advertising’ Nothing is our ad is false All of it is factual JRP did provide a free acting and modeling workshop to the first callers [redacted] DID NOT ATTEND the Free Acting and Modeling workshop All attendees sign in.It is [redacted] that falsely states the ad copy.Under new information it states that:The complaint has not been resolved because: “I have yet to be informed as to whether or not this advertising will still be aired openly on the radio”JRP stands by its radio announcement It is not advertising I would like [redacted] needs to cease and desist making accusations before this turns into a legal issue[redacted] JRP NYC

In response to Mr [redacted] 's complaint, and contrary to his opinion, we have complied with our original agreement to remove the standing water in his upper back lawn area around his existing patio by removing the garden area and planting beds and stone retainer walls to allow the water to drain awayWe also installed drain lines and a dry well to direct the water away from his house (which it does) and filled in soil, re-graded and reseeded his entire back lawnAs mentioned, it was hot and dry last summer and not a true test of the entire situationIt is clearly visible that his property sits lower than the surrounding properties and collects the excess water flow after a heavy rainIt does drain off however, in "48" hours as we explainedWe also suggested the only other solution would be to install a drain line to the street which Mr [redacted] declinedWe would like to mention that his shed is built on stilts that show previous water issues not caused by our work and the neighbor's wooden fence should not have been installed directly into the ground where it was already rotted - perhaps built for the intention of a damWe also surmised that the planting beds removed from around the perimeter of his yard might have been originally installed as dams as well to prevent water from surrounding propertiesIn all reality, sheds and fences do not rot out in six monthsThe "threatening" penalty issues Mr [redacted] refers to are merely the "generic "Terms" pre-printed on all of our Invoices and Statements.We completed our work professionally and efficiently as proposed and agreed upon for his back yard, and don't appreciate his slander on the Internet

To Whom It May Concern: This response is to let you know that we returned to Mr***'s property last week to correct the items in his complaintWe replaced the damaged section of his downspout and dismantled and re-aligned the vinyl fence to his satisfaction (he was home at the time)We apologized for the issue with the size of the gravelIt seems that the #'s vary with different distributers and inadvertently, the wrong size was delivered and installedWe agreed to return and install a smaller size over the larger asapHowever, in the meantime it has snowed, so as promised, we will return to do so asap.Respectfully,Office ManagementIngersoll Landscape Company

I will respond to each of your points, but there are a few facts that cannot be disputed.1) The work was not completed correctly from day one (and after your attempt to fix your errors) and series of pictures provide verificationThe outcome was not what we verbally agreed upon and I would hope that Mr*** would stand by his words.2) There is no reason to my wife or I to lie, fabricate, or form “opinions” on the matterI gave your company prior opportunities to fix the issue or have a more qualified company fix the problemI was never initially seeking any type of financial settlement, but it has reached the point where your level of professionalism prevents me from trusting or working with you and has forced me to escalate this to an oversight groupI just wanted what we agreed upon and all I have got is excuses.In response to Mr***'s complaint, and contrary to his opinion, we have complied with our original agreement to remove the standing water in his upper back lawn area around his existing patio by removing the garden area and planting beds and stone retainer walls to allow the water to drain away.Yet, standing water remains after it rains, just in new areas.I want to make it clear that at no point was it ever voiced by my wife or me that the issue was related to water around our home or patio.The removal of the garden area (planting beds only, there were no remaining stone “retainer walls” or commonly referred to as landscaping pavers, across at 3” each, they were removed prior to their work) were specifically done at OUR request and made no impact, voiced or otherwise, in relation to the standing water situation.We also installed drain lines and a dry well to direct the water away from his house (which it does) and filled in soil, re-graded and reseeded his entire back lawn.While the drain lines do take water, from other parts of the yard, to a dry well, it doesn’t change the fact that the area above and around the dry well is flooded out, which is now closer (underneath and right next to) to the fence and barnAgain, moving water away from the house was never a concernThe issue was standing water, which we still have.As mentioned, it was hot and dry last summer and not a true test of the entire situation.This was mentioned during some fall rains and I find it to be yet another excuseI contacted you in the spring and summer as well, giving time for the soil to settle, and you still refused to accept responsibility for the inadequate grading.It is clearly visible that his property sits lower than the surrounding properties and collects the excess water flow after a heavy rain.That is highly debatableI would like to see some evidence of this, other than your “professional opinion”.It does drain off however, in "48" hours as we explained.This was explained after the work was completed as a way of separating yourselves from the existing issueThe old standing water prior to their work was “48” hoursWhy would I spend a couple thousand dollars to get the same results I already had?We also suggested the only other solution would be to install a drain line to the street which Mr*** declined.IncorrectThis was MY original suggestion after receiving multiple quotes before yoursYou had said that it was not necessary and could be resolved with French drains, a dry well, and regradingI relied on your expertise.We would like to mention that his shed is built on stilts that show previous water issues not caused by our work…TrueIt had been slightly sinking in one cornerHowever, the water level is now high enough to touch the actual sides of the walls which are causing them to rot at a high rate.… and the neighbor's wooden fence should not have been installed directly into the ground where it was already rotted - perhaps built for the intention of a dam.I have no clue what this is aboutI have a wooden fence and the neighbor has a chain link fenceIndependent of each otherIf Mr*** would also like to neighbors involved, maybe we can look at that optionThey’re taking on some of our extra water that is pooling along the fence in their own yard, due to the improper grading.We also surmised that the planting beds removed from around the perimeter of his yard might have been originally installed as dams as well to prevent water from surrounding properties.Again, there’s no evidence of water coming in from surrounding properties other than a “professional opinion”We had the same pooling issues with the planter “dams” prior to them being removed.In all reality, sheds and fences do not rot out in six months.In fairness, that is fairly accurateFor reference, we’re talking about work that was done pretty much a year ago, not six monthsBoth the shed and fence are old, but the constant sitting water at the posts have caused them to sink and degrade at an obviously faster rateI can let that issue go, even though I’ve been in this house for years and never had issues with the fence or sides of the shed, until the work was done.The "threatening" penalty issues Mr*** refers to are merely the "generic "Terms" pre-printed on all of our Invoices and Statements.The last time I spoke with Mr***, he was out to my home re-evaluating the work; continuing to backpedal and continuing to make excuses on status of the yardI brought this up to him, in person, and he told me regardless of conditions the bill would still need to be settled and subject to those penalties, even if I was unsatisfied with the workForgive me for being intimidated by his tone and stanceHe was already being defensive about me bringing up the quality of the work and he apparently wanted his money.We completed our work professionally and efficiently as proposed and agreed upon for his back yard, and don't appreciate his slander on the Internet.That is your opinionI think you meant to write was libel, not slander, since it was “in print” on Facebook onlyI spoke of the situation and provided pictures, which again, speak volumes and stand on their own.It is my right to voice my opinion and share the of the quality of your work, to hopefully influence others to find a more professional company to spend their hard-earned money onAt no point did I write anything that hasn’t already been written in previous emails or this complaint.You don’t stand behind your work and you haven’t treated me professionally or fairly from the moment you packed up your trucks and sent a bill

Review: I went to a casting call with my daughter. I was told if I put 200$ down I could make payments for the rest of the cost of the acting classes. I was also told the classes were located an hour away. After much consideration and finding out the classes were closer to a 2 hour drive I decided to hold off. y daughter never attended one class and I told the recruiter at least a month before that we would not be interested. after one class was scheduled to start I got an email that the office has now closed so, I would like me 200$ back, which I have been requesting for months andbeen give n the run around.Desired Settlement: My 200$ back and an apology.

Review: On the radio, the commercial for this business in question stated that they were looking for all actors ages 14 - 25, and that the first one-hundred callers would receive a free audition and acting workshop. First, one should never have to pay for an audition, so "winning" a "free" audition sounded sketchy to begin with. Second, when I spoke with these people on the phone (when they called me), there was no mention of the acting workshop. Third, when I tried calling them, it always went to voicemail, and my call asking for more details about the audition were never answered, either when I actively called, nor by calling me and leaving me a voicemail, even though I received a text from this company tonight regarding the audition time and place tomorrow.Desired Settlement: Frauds like this should not be able to advertise on the radio. The station in question is [redacted], and in the [redacted] area, it's at 106.1, but I have also heard it on a few other radio stations, the frequencies of which I cannot recall.
