years doing his own home, several rentals he owns and a few roofs for the bank he worked forHe knows I'm a man of my word and get things doneShortly after taking this recent job on I broke my right ankle holding me up for several weeks putting things behindThe whole time keeping constant communication with Mr ***The job originally started as copper gutters and then became resurfacing the driveway and putting a bell drain in the sidewalk and fixing several other thingsAfter working for him for years we had a gentlemen's agreement on the other little thingsWe ran into some problems trying to pressure wash the driveway running his well dryI had to take a water truck up from *** *** to enable us to properly wash the surface to make sure the product would adhereMr *** knew I had to do this and was all for it to keep from ruining his wells running them drySeems once I told him they wanted paid for the truck he decided to start canceling small things after several were already doneAnd when I ordered the copper, it was under the company name of *** *** ***Which I told Mr *** I was underHe called ***/*** supply only asking about John Springer ordering copperThe copper is installedAttached are picturesThe contract he signed was to replace and resize the existing downspoutsWe added more spouts, and feet of gutterI've made more trips up to get this done and he only wants me to work when he's thereWe've got a date of October 10th for completion of the last downspouts to be installedBut we couldn't put them in until he got his underground pipes inThey were just put in 10/1, and 10/So how am I supposed to get done without having the necessary pipes in to connect toI would've flooded his basement had I put them up without the underground pipes firstThe white downspouts were installed to prevent his basement from being flooded until I could get the copper upHe knew my ankle was broken and asked if I could at least put those up since his inch weren't handling the waterHe runs us up and down the mountain like it doesn't cost anythingI've always considered him a friendCouldn't believe he did thisWhen *** *** *** took over my *** number I called him immediately and gave him my new numberHe tried making it look like I was trying to hide from himBut we've since got this resolved to my knowledge and will be completed by 10/by his schedulingThe only time I said I didn't have any crew was when of our men got flooded at their home in *** paI can't force them to come in after thatI was the one told Mr *** about my *** *** ** *** *** *** *** *** * *** *** *** *** *** *** ** ** *** *** *** *** *** *** *** ** *** * *** *** ** *** *** *** *** ** *** *** *** *** *** *** *** *** *** *** *** *** ** *** *** *** ** *** *** *** ** *** *** ** *** * *** *** ** *** *** *** * *** *** ** *** *** *** *** *** *** *** ** *** *** ** ** *** *** *** *** ** *** ** *** But he's trying to use it against meI've always been upfront and honest with himAnd he can tell you he's been at my house several times leaving me notes and watching me work on equipmentHe's always said no problem until nowI'll let you know and send final pictures of completion

After working for him for years we had a gentlemen's agreement on the other little things. We ran into some problems trying to pressure wash the driveway running his well dry. I had to take a water truck up from [redacted] to enable us to properly wash the surface to make sure the product would adhere. Mr [redacted] knew I had to do this and was all for it to keep from ruining his wells running them dry. Seems once I told him they wanted paid for the truck he decided to start canceling small things after several were already done. And when I ordered the copper, it was under the company name of [redacted]. Which I told Mr [redacted] I was under. He called [redacted] supply only asking about John Springer ordering copper. The copper is installed. Attached are pictures. The contract he signed was to replace and resize the existing downspouts. We added 2 more spouts, and 40 feet of gutter. I've made more trips up to get this done and he only wants me to work when he's there. We've got a date of October 10th for completion of the last downspouts to be installed. But we couldn't put them in until he got his underground pipes in. They were just put in 10/1, and 10/2. So how am I supposed to get done without having the necessary pipes in to connect to. He knew my ankle was broken and asked if I could at least put those up since his 3 inch weren't handling the water. He runs us up and down the mountain like it doesn't cost anything. I've always considered him a friend. Couldn't believe he did this. When [redacted] took over my [redacted] number I called him immediately and gave him my new number. He tried making it look like I was trying to hide from him. But we've since got this resolved to my knowledge and will be completed by 10/10 by his scheduling. The only time I said I didn't have any crew was when 2 of our men got flooded at their home in [redacted] pa. I can't force them to come in after that. I was the one told Mr [redacted] about my [redacted] But he's trying to use it against me. I've always been upfront and honest with him. And he can tell you he's been at my house several times leaving me notes and watching me work on equipment. He's always said no problem until now. Review: I contracted with [redacted] Contracting on March 4, 2014 to replace my existing slate roof with a Majestic slate roof. I paid Mr. [redacted] a $8,000 deposit at the time the contract was signed by check [redacted] which he cashed. Work was to be completed by July 12, 2014. I or my wife stayed in very close contact with Mr [redacted] from April to July texting him often about when the work was to begin. Beginning in July, Mr [redacted] was literally on his way to my house giving excuse after excuse as to why he was not showing up all the way until the end of September. At one point Mr [redacted] brought and left a truck and then removed it and brought and left ladders and then removed them. At no point did Mr. [redacted] perform one speck of work never stepping one foot on a ladder. We began to get concerned since it was getting so late in the year that we began to press Mr. [redacted] for a date. He made several additional promises of when he or our product would be delivered and every time he had an excuse. I was in a car accident, my break lines broke, my transmission dropped, I am going to pick up your slate, I locked the keys in the truck, I am so sick I cannot get out of bed. These are all documented in text messages from Mr. [redacted]. I asked for confirmation that my product was ordered and he assured me it was but would not provide any documentation. Since the product was only sold through a limited number of distributors I was able to contact the general manager for the area and he confirmed that there were no orders filled or ordered in 2014 for our product and blend of colors. Finally I got so concerned that I cancelled the contract (since he was already in breach) on or around September 27th and requested a refund. Mr [redacted] has yet to return one penny of the $8,000 although he repeatedly said that he would. Mr [redacted] is also is also not in compliance with nearly every aspect of the PA Home Improvement Consumer Act.Desired Settlement: I would like my $8,000 refunded and I would like the attorney general to assess all possible fines under the PA Home Improvement Act for operating without a contractor ID, failing to put contractor ID on all documentation and vehicles, failing to refund my money within 10 days. I also believe that Mr. [redacted] commited home improvement fraud under section 517.8 of the act as he repeatedly made false statements including totally low balling the bid, and receiving a deposit and failing to perform.
