To begin with Happy New Year, I have just returned from vacation to find this Complaint issued against our Manufacturer's Representative Agency, and would like to respond.I would like to give you and The Revdex.com a clear understanding of who we are, what we do, what we have done for
the claimant, and why I feel this claim is completely without merit:John Stack Sales Company is a Manufacturer's Representative Agency, We have represented multiple manufacturer's in the Heating Plumbing and HVAC Industry since Our job as Representative is to act as a Marketing arm to the manufacturers we represent, setting up wholesale distributors that will in turn Set up dealers (contractors that will install and service the products of these manufacturersWe are NOT engineers, Mechanical installers or Technical Trouble ShootersFurthermore, we are not licensed nor are we permitted to work on any appliance installed by any of our wholesale Customers Dealers {Contractors}We do NOT manufacturer any product and therefore are not liable should a product malfunctionWe do NOT sell any product direct to the end user customer, we only arrange sales from our Manufacturers to Wholesale Distributors who in turn sell the product to the Dealer, who in turn sell the product to the end user (The ***'s in this case).Our agency has conducted business in the Mid Atlantic region of Eastern PA, Southern New Jersey, Delaware, Maryland, Washington D.C., Virginia and West Virginia for over twenty five years without a si*** claim being filed against us to the Revdex.comWe recently expanded our territory coverage to include the Northeastern states of Maine, New Hampshire, Mass., Rhode Island, Vermont & ConnecticutThis is important to note because We took over representation of the *** *** product line sthe product that *** & *** *** are presenting this claim Over) in the State of Connecticut in August of The ***'s purchased this product and had it installed prior to our agency having anything to do with the sale to the wholesale distributor, who in turn sold it to the dealer that installed the product into the ***'s residenceIn August of 2015, we were made aware that the ***'s new contractor (*** ***} was requesting assistance with a problem that they were experiencing with a *** *** Condensing BoilerAs the new Representative, in good faith for the integrity of the product's reputation in the marketplace, we agreed to come out with the tradesman (contractor) requesting assistanceAs we are not licensed to install or trouble shoot, Our function "on site" was to insure that the product was installed per Manufacturers Installation Manual and metall codes in this Specific installationWe could also offer "another set of eyes" to see if anything Was Out of place or defective on the product in questionWe Sent one of Our Representatives to the site {Dave E***} in August of MrE*** noted that the initial installer (*** Plumbing & Heating had been fired over a disagreement with the ***'s and that *** *** had inherited the job and were not privy to the specifics on how or what occurred in installation of this boilerAfter listening to the contractor and reviewing the situation, as it had been experiencing "rough starts" and had been "locking out", not knowing if anything had been initially wired incorrectly and might have caused issue with the control board (brain of the boiler, MrE*** instructed *** *** to replace the controlThis was done and after a while later he was called out to the residence again with the same issueAfter inspecting the connections on the control to insure they were correct from the replacement by *** *** Tech., MrE*** suggested that the insulation fiber under the burner head be checked and possible "shaved" through the ignitor opening of the burner head, again, as this could have been slightly moved in the initial installation*** *** did this and MrE*** gave them a new ignitor (sparker} to install as the old one could have been compromised in this service inspectionAgain the boiler had a "rough start"at this point the only possibility that MrE*** thought could be causing the problem was a lack of air to the burner duringignitionHe came to find out that the original installer had used a "concentric Vent" terminating through the roof of the residenceFor the record, a concentric vent is a company designed and Code approved product that allows the combustion air (exhaust gas air} to be removed, while also bringing in the fresh air (combustion air} through an outer pipethis concentric piece allows for only one penetration through the roofMrE*** asked to see the Connection of this termination piece in the attic and was refused accessHe then asked for a way to observe the actual vent at the roofline and was told he couldn'tbut that they (homeowners} would get this to him laterMrE*** did receive three photos of the vent (I have attached copies of the same for your review)From the pictures it was evident that the homeowners had had the concentric vent ALTERED, having Wrapped it in Copper sheeting "TO BE MORE PLEASING TO THE EYE"This ALTERATION Violates every code and installation instruction for this boiler, as the vents Supplied by Or recommended by Our manufacturer *** *** must be approved by the Gas Code and other regulating agencies for Safety and Correct Operation that can not cause harm to the applianceThe Cause for "hard/rough start" is usually a lack of Combustion AirThe ALTERING of the Flue Vent needed to be corrected and MrE*** explained thisIt was some time before we again heard from *** regarding this matter, she called MrE*** explaining that the issue was still presenting itselfMrE*** asked if the vent had been replaced to a factory authorized unithe was not given an answerInstead *** demanded that he "come out to insure her nine thousand Square foot home was able to get the hot water she needed from the boiler"MrE*** unfortunately suffered a seizure in the late Spring of and was out of work for several monthsWe received a call at the office from *** asking that the boiler be replaced or that someone come out, again we had our Regional Sales Manager, Guy W*** (an employee of *** ***, not John Stack Sales Co.} call *** and ask if the concentric vent had been replaced no answer was givenThis repeated itself several timesInstead of answering the question of the vent the ***'s kept demanding that the boiler be replacedIn November of *** called the factory, in Blackwood New Jersey, multiple times speaking directly to their customer service representative (Terry B.}, who in turn asked the question of *** pertaining to the concentric vent having been replaced*** said QUOTE; "I don't know anything about a vent, this is the first time I'm hearing about such a thing".*** states that John Stack Sales oignored her, I personally called her husband at a number that was left by ***Upon calling, I was told by a Secretary at his roofing company "He is busy right now and will have to get back to you"I never received a call back from him, however, *** told our Secretary and *** *** that I was ignoring her.The customer has brought a claim against John Stack Sales Co., the independent marketing and sales representative for the manufacturer *** ***For the Record:(1) We did NOT sell this product to her, we made ZERO money on any transaction that occurred between the ***'s and their original installer(2) We did NOT manufacturer the product, therefore made ZERO profit from the purchase by the ***'s(3) We did NOT copper clad the Concentric Vent to be "pleasing to the eye"this was done by the ***'s....Yet, they choose to file a report against usthe only entity in the chain of events that made no profit and had ZERO to do with any purchase or installationThrough MrE***'s efforts we tried on several occasions to help the ***'s AT NO COST FROM John Stack Sales Coyet, they find it necessary to file a claim against us??Upon receiving this claim while I was out on vacation, our office manager contacted *** *** regarding this claim*** ***s' CFO Maureen C***, contacted *** *** and explained that since she took this action, they were out of the picture and that the ***'s would need to deal through The Revdex.com for resolution***, then promised (around December 18th} that she would cancel the claim against John Stack Sales Cowith the Revdex.comObviously this has not been done and again *** has lied (we have her statement in an e-mail from her to Maureen C*** saying she was cancelling the claim)In the Conversations that Maureen C*** has had and through various e-mails With the International VP of Sales Sjacco S***, *** has now changed the Story, Saying that the concentric vent was changed the day MrE*** asked about itWe have asked for pictures and received nothingThe ***'s told*** *** that they were going on vacation for the Holidays and that they would be happy to show our representatives the new vent when they returned after the new yearWe have scheduled for *** ***s' chief engineer {Mike S***} and *** ***s Sales Manager (Guy W***} to go to the ***'s job site on Jan11, to inspect the corrected vent and the overall bOiler.Permy above explanation, I would like to be removed from any negative result that this claim by the ***'s has caused against John Stack Sales Company with The Revdex.com.I thank you for your time and attention to
