We do not accept *** *** response, which continues to avoid the bottom line: he gave us a fixed price for a job whichwe paid in full. As first-time users of the Revdex.com, we would like to commend its staff for excellent service andassistance. Despite years of working with companies across the U.Sand in Europe, this is the first time we’ve felt the need to issue a complaint. Based on information relayed to us by the Revdex.com, we have also filed a complaint with the Law Center’s Local Consumer Program through Middlesex County, andthank the Revdex.com for informing us about this other additional resource for customers.?

JLS Responce,It's unfortunate that it has gotten to this point as I feel that I have done all I could do to mediate this process with the Dalys History of the Daly account with JLS:- Fall Clean up - Spring Clean up and Fall Clean up- Fall Clean up- No services
providedIn the spring of the Dalys contacted our office and inquired what the Spring Clean up would be We were led to believe that the clean up would involve the same scope as it had in the past What the *** failed to mention to our office was that the property had not been cleaned at all in This information would have been vital to us being able to rely accurate pricing over the phone It was the lack of this information being provided by the client that has led to this disagreement Knowing that this client had been on with us for multiple years I assumed that it was just an oversight by them and not an intention to deceive us However, through further communication with them after the work was completed, I unfortunately now believe that they knew the job the requested differed from the scope that had been done in the past When our crew did they work, they are not privy to pricing information therefore would not know if something is over budget etc After the bill went out, I received a note in the mail from the client stating that all they were paying was the $ I followed up with the client (at their request) and had a long conversation with *** Daley regarding the situation He understood where I was coming from as I understood where he was coming from He said he would discuss it with his wife and that I should outline my proposed solution in an email, which I did The email and my proposal for resolution is below:***, ***,Hoping we can come to a resolution on this seeing that it sounds that we both understand each others view.The disposal cots on the job were $185The original labor was $ (per man per hour / men = $per hour)Original Total $1175.00I propose reducing the hourly fee to $per man per hour ($120) per hour Disposal charge $185New labor charge $720New total - $905.00I think this is a fair resolution and hope you agree Look forward to hearing from you.EMAIL END*** *** response was email contained an opportunity for me to avoid negative online filings if I reduced the charges - see email below:Dear ***, Thank you for your email. We have enjoyed using John's Landscape in the past and really appreciated the transparency and honesty of prior agreements (flat fee given to us was always respected). I'm sure you can understand that this abrupt deviation by John's Landscape from all previous work done by your company and paid for by us is concerning. I have spoken with the Revdex.com, Consumer Affairs, and the Law Center's Local Consumer Program through Middlesex County. I have been advised by all three on how to proceed with the complaint process. Because of our historical relationship with John's Lanscape, I prefer not to file formal complaints with the Revdex.com and the Law Center/Attorney General's Office, but am prepared to do so if you continue to bill us above and beyond the $which we have already paid in full. Are you saying there was intentional deceit with regards to your clean up? Do you honestly think that for $500-$dollars that I would choose to all of a sudden deceive clients? Honestly, whatever agencies you choose to deal with is your choice and how you choose to proceed should not factor into how our current situation is resolved We maintain an A+ rating with the Revdex.com, and an A rating on Angie's list As you initially mentioned we are an extremely honest and transparent company and once I realized that you had an issue with what was done I initiated contact to resolve any mis-communication and have stayed in constant contact. You were quoted for the work that you have had in the past Unfortunately, when requesting and receiving that quote you chose not to inform our office that your property had not been properly cleaned in over at least a year and that the job was sufficiently more than it had been in the past However, you were quite clear with telling the office that you wanted to know if the "spring clean up" would be the same rate as in the past without mentioning that the conditions of the property had changed significantly. I truly do not believe that you were attempting to deceive us, and instead believe in the midst of everyone's busy life, you did not consider that the scope of the work had changed dramatically from what you had had done previously and therefore was not mentioned I on the other hand trusted that the work that you requested was inline with the work previously completed and thus the same pricing would be sufficient To both our surprise, the work was double of the previous scope, I do not believe, that you or I intended for this to be the case and now should work to find an amicable resolution Please let me know how you would like to proceed.EMAIL ENDThat was the last direct correspondence from me directly She would still receive a monthly invoice because the balance still exists on her account.I welcome the Revdex.com input and complaint resolution teams assistance in working through this matter I can be reached via email or cell ###-###-####.Regards,*** ***PresidentJohn's landscape Service Inc###-###-####***

I have read the response For clarification - when I described the first estimate via phone, I was indicating that no property walk through had been done with the client nor was there one requested and that the estimate was based off the previous work done on the property and no indications were made to us otherwise These transactions did happen over email I believe that that this mis-understanding stems from the initial communications I stated this in my original response Mary indicates in her own words that she emailed the office to "confirm" pricing Again, pricing was based off the previous work that had been done See below:2010-Fall Clean Up-$5752011-Spring Clean Up-$& Fall Clean Up-$5752012-Fall Clean Up-$6752013-no work doneWe had assumed that she would have had work done in 2013, perhaps by another company, but nothing was done The latest fall clean up in was $ The spring clean up in was $ We are not currently offering rates to any client The spring clean up estimate was inline with the fall clean up, fall clean up ASSUMING that work had been done on the property in 2013, which none was A common courtesy would have been to explain to us that the property had not been touch since we last did work in 2012, was this the clients responsibility, No, however in my experience in working with clients from year to year (even ones who leave and come back) people are honest and upfront as to the situation that we may be walking into Did it not strike the client as odd, that the fall clean up in was $and with NO work being done in the spring clean up in would be less? That would basically equal a spring clean up, fall clean up both lumped into a spring clean up for less than the cost of the last clean up done by us?I initially addressed this situation as a mis-understanding / mis-communication and tried to work with this client to resolve the situation Those efforts on my part were flat out rejected and then the threat of online complaints and bad reviews were dangled against us in exchange for us forgiving the full cost of the job Additionally, in conversations she said that she planned to do a bigger project in the future and wanted to consider using us for this, another sort of threat dangled Please understand that there is no incentive for me to pursue this if I did not believe the we were being taken advantage of The difference is $after I reduced my hourly man rate do to any mis-understanding If I felt that I had done any "bait and switch" would I really have rejected this clients offers not to write a bad review or file a complaint? If I were doing something wrong or deceitful why would I persist in defending? There would be no reason for me to do so.It should be noted that there were no complaints with the work that had been completed and that outside of the billing dispute they were happy with the service and work completed I would be happy to agree as I initially proposed that there was a mis-communication / mis-understanding here on both of our parts and that no one was trying to deceive anyone and work to come to a settlement that leaves neither of us taken advantaged of *** ***PresidentJohn's landscape Service inc
