This letter will serve as our response to complaint ***.You will also find attached a statement of facts, as the complaint Submitted to the Revdex.com does not specify the true nature of the events associated with the complaintHere at Johnathan's Towing we take our customers concerns and complaints very seriouslyMeaning that any damage complains or concerns are addressed as promptly as possibleWe do examine the complains from every angle and we gather all the evidence required to either prove the damage was company related or it was already an existing damagePlease be assured that we did meet with *** *** on 06/28/around 3:PM, and took pictures of the damage he daims was made due to the towWe do have video Surveillance hours a day so we are able to keep track of how each vehicle comes in and leavesFor complaint *** we have the following evidence as proof of how the vehicle was handled from the time it entered our storage yard on 06/15/till it left on 06/16/Attached that Johnathan's Towing has a contract with the police department which entails a week long rotation each monthMeaning anytime a car is taken away from the owner, there is an accident, or even if a stolen car is retrieved the police department would call Johnathan's if the impound fell within our rotation scheduleAs a tow Company, we must comply with a lot of regulations including providing proof of damageAs mentioned previously we strive to keep Our Customers satisfied and if an issue were to arise we try to look at every single detail and get to the resolution as quickly as possibleRegarding complaint *** we did examine all the video footage, pictures, and paper work which includes a report from officer*** from the Escondido Police Department, and we concluded that no damage occurred or was caused by anyone at Johnathan's from when the vehicle entered our facility to when it leftBelow I will list several occurrences which will include evidence to support our statements.Appendix AOn June 15, around 12:AM we received an impound request from the Escondido Police Department for the Ford FusionAs per protocol officer *** provided our driver *** *** Vehicle impound form which specifies the details of the vehicle which includes the inventory and damage at that timeThis form does state that at the time of the impound there were already 360-degree scratches and dentsPlease find the form attached it Will be labeled as ESCONDIDOPOLICE DEPARTMENT VEHICLE IMPOUND FORM APPENDIX A.Appendix BAt the time of the tow the Ford Fusion was placed on top of tow dolliesThe dollies where used because the vehicle is a front wheel drive and the electronic Ebrake was onMeaning we would have been unable to move the vehicle, also the dollies are from inches to a footaway from the bodyThe placement of the dollies couldn't have caused such damage as stated by *** *** because if something would have gone wrong the dollies would have hit the bottom portion of the bumperThe damage that is being claimed is above the rear passenger tire, a place where the dollies couldn't reachWe also have video surveillance which proves that the vehicle did not encounter any other object at the time of drop ofThe video will be attached as DROP OF VIDEO APPENDIX B.Appendix COn June 16, around 10:AM *** *** and *** *** arrived at the Escondido Facility to retrieve the Ford Fusion*** *** stated that *** *** had gotten the vehicle from the dealership under his name but that she was the one who had possession of itThis could mean that after the vehicle was released on June 16, *** *** may not have had the vehicle insight at all times and the damage may have occurred after it left our facilityI have attached the payment receipt where *** used her Visa to make the payment as she was the one responsible for the costs since she had possession of the vehicleATTACHED ASAPPENDIX CAppendix DJune 20, *** *** called Tim (Escondido Police DeptTow Coordinator) and submitted a complaint that we had caused damage to the Ford FusionAs it was brought to my attention I immediately emailed Tim to figure out what had happenedI explained that the day of the pickup *** *** and *** *** where very upset due to the $they had already paid at the Police Department to obtain an IMPOUNDED VEHICLE RELEASE FORMOnce I told them that they had to pay an additional $to retrieve the vehicle from us, *** became more upsetI told her that all our fees are city approved and that whatever costs she accrues form the Police Department are separate from oursShe kept asking why the Police Department charged them $if that wasn't going to cover our costs as well, I let her know that I wasn't completely sure as to why or how the fees for the Escondido Police Department are set up but that if she walked in and asked someone they would be more than happy to assist herAs I walked her to the vehicle since *** decided to just wait in the parking lot for her; she noticed a parking violation stuck on her front windshieldShe instantly began using foul language and said that it was a bunch of BS that she had to pay all that money and now she had a parking violation to pay as wellI told her that I understood her frustration but there isn't much I could doShe looked at her vehicle and said to me just get me out of here"I showed her what way to get out and she exited the facilityI explained to the coordinator that they may have submitted the complaint to possibly get refunded for the $that they had to pay at the Police DepartmentWhich now leads me to believe that they are now trying to cover all the costs they had to pay and it led them to submit complaint ***PROOF ATTACHED ASAPPENEDIXD.Appendix EJune 28, *** *** (Manger) met up with *** *** at the Escondido Facility to take pictures of the damage *** claims were madeAfter examining the pictures and the video Surveillance of the day the vehicle had exited our facility, we concluded that the damage was not caused by Johnathan's Towing due to the tow or the car being in contact with any other vehicle or objectWe also realized that if the vehicle right next to the Ford Fusion would have encountered ***'s vehicle, that the car would have damage as wellWhich in fact doesn'tI have attached the images of the vehicle when it left our facility and the images that were taken when *** and *** met upATTACHED AS APPENEDIX E

towing company damaged my vehicle during tow and did not disclose the the damage to me the registered ownerwhen I asked for any photos of vehicle my request was refused
