John's Garage Reviews (164)

Nothing disputed since last filing other than Mr. [redacted] doesnt accept our side of the story.  We received his application from [redacted] and he gave them permissible purpose to pass on the information and have us pull credit.  His dispute should be with [redacted] on sharing his information.

I am sorry that we were unable to help you refinance your loan at this time.  You were approved but like all loans (mortgage, auto, etc) there can be requirements to complete the loan.  In your case it was to prove the income as stated on the application.  Unfortunately when we got...

your pay stubs and validated the monthly amount of income it decreased by almost $1,000 per month which created the debt to income percentage to increase beyond the acceptable limits.  So we were unable to continue the loan process.  In the case of the documentation, the Power of Attorney is narrowly focused to only allow us to complete title work on your behalf.  Since we will not be refinancing your loan, the paperwork is meaningless for us and we will keep for audit purposes but will be locked up in a document vault.Again I am sorry we were unable to help at this time.

I reject this response because the letter did not specify that they would have to run my credit in order to determine whether or not I was qualified or not. It stated that I was pre qualified and that I could get my payments lowered as well as my interest rates lowered. The way the letter read didn't seem like I had to go through any process in order to get this deal.

Mr. [redacted] - thank you for voicing a concern about our company. First let me start by saying I apologize about your poor experience. We help thousands of customers each month refinance their auto loan saving a considerable amount of money. In your specific case, your credit report changed from the...

time we received your information from the credit reporting agency to send you the pre-approval to the time you applied, specifically, your existing auto loan with Santander is now reporting past due. Unfortunately with that being the case, we can no longer help you. The back of your letter clearly states that if anything has changed on your credit report we are no longer obligated to offer you a loan. Again, we are sorry you had a poor experience. We hope we can earn your business in the future.Regards,The OpenRoad Lending Team

Remove inquires. I do not care about the loan.

Ms. [redacted] - thank you for your comments. I understand your frustration. Unfortunately when we issue that pre-approval it is based on your credit profile only. There are disclosures on the back of your letter that discusses other factors you still must meet in order to qualify. Two of those (debt to...

income ratio and loan to value) you do not. While many of your student loans are deferred at this time, we still must include a minimum payment to determine your ability to afford the loan once those get in repayment. Likewise the value of the vehicle you are refinancing exceed the allowable limit we can finance.Again, we are sorry for the poor experience and hope we can earn your business someday. The OpenRoad Lending Team

I am rejecting this response because:  The very narrow definition you define for "prequalifier" doesn't mitigate the misleading verbiage in your unsolicited flyer.  Additionally, the criteria you outline for the vehicle to qualify for your program seem arbitrary and capricious in that 100,000 miles on a typical gas powered vehicle is very different from 100,000 miles on a diesel truck such as mine and the age of a diesel vehicle is also quite different. To be clear.......you should be able finance or not finance anyone based upon whatever legal criteria you invoke.  I don't believe I have any confusion about "prequalifying" per se, I just believe the manner and context in which it is used in your flyer is misleading and confusing and should be reworded.  Additionally, I feel that it is incumbent upon you to at least get your hard inquiry removed from my credit report. If you don't see the merit of this remedy, that would be consistent with the attitude which caused this problem in the first place.

I do apologize for you poor experience with our company. When you complete your application with us, you agree to allow us to pass your application on to other lenders in an effort to find you the best terms for financing. You also agree that they are allowed to access your credit...

report. Those disclosures are listed below which are listed on our application.  Again, we do apologize for your dissatisfaction with our company and hope we can earn your business someday.
I agree that OpenRoad Lending may forward this application and my financial information to one or more third party lenders, dealers, affiliates or others that may be able to offer me, or assist me in finding, financing or other products that meets my needs. Some of these affiliates may offer or arrange dealer financing rather than a direct loan from a lender.
I authorize those third party lenders, dealers, affiliates or others which are forwarded the application to share information in the application and any other credit information they obtain with other third parties who may be able to offer or arrange for a loan or financing through a dealer or other products and services.
I authorize OpenRoad Lending and its lending partners, automobile dealers,  third parties, affiliates, agents, service providers or assignees to obtain such additional information as may be required, including credit reports, in order to complete the processing of my application.
This disclosure is linked from the application but here it is in its entirety.  http://www.openroadlending.com/terms-conditions/

Complaint: [redacted]
I am rejecting this response because: the response in not pertinent to the complaint. If the company is not able to address whether or not it can serve prospective customers before a credit pull then the complaint is valid and should be made public so that consumers will see it if they check the Revdex.com site before doing business with the lender.

I am sorry we were unable to help you.  The mailer you received was from data that we bought in July 2017.  You applied in August and since then you had a charge off that reported in August 2017 with [redacted] which drastically affected your credit.  The back of the...

offer discloses that "you must continue to meet the criteria used to select you in this offer and our creditworthiness criteria."  Unfortunately, your credit changed during that time and we are no longer able to offer you the same opportunity.

Thanks for sharing your concerns about our process. Unfortunately, you have listed you only make $1,500 per month on your application which is below our minimum income allowed. We don’t believe that to be accurate since you are paying rent of $1,000 per month but we need you to confirm what your...

gross monthly income actually is before we can proceed. The reason for your decline was income the ratio of debts compared to that income disqualifies you. When we send you a mailer, it is solely based on your credit profile. We don’t have access to things like your collateral, income, job, etc., which are all detailed out on the back of your letter. We are happy to try and complete your refinance application but will need accurate information from you regarding your income to proceed.

Ms. [redacted] - thank you for your email. I am sorry we were not able to assist you in refinancing your vehicle. It is not our practice to return any documents to you especially since most are copies. I would be willing to shred all documentation you provided as it relates to the two original...

documents you returned to us. Again, all of the documents requested were in an effort to overcome the loss of income from what you stated on your application when you applied to what you could actually verify. We will set into motion the destroying of the original paperwork you provided.Regards,The OpenRoad Lending Team

Revdex.com:
I have reviewed the response and I am tired of arguing with a company that clearly doesn't want to own up to their flaws. I hope Revdex.com will investigate their A+ rating, because continuing to argue with this company is unacceptable, and does not merit their rating.

Again I am sorry for your poor experience but your FICO score will not go down with multiple inquiries in a short period of time. It is only affected one time as explained in this article by Experian (http://www.experian.com/blogs/ask-experian/2009/03/01/impact-on-credit-scores-o... When you applied to agreed to our terms and conditions which allowed us to pull your credit and share in order for you to obtain the lowest rate possible
Again I am sorry for your experience.

Complaint: [redacted]
I am rejecting this response because: I thought I already rejected this.  The company that OpenRoad set me up with ([redacted] via [redacted]) has made no contact with me since opening a loan in my name for an amount greater than my actual payoff!  I have likely missed a payment and am accruing both interest and late fees, but I wouldn't truly know because they haven't sent me a bill despite a new loan of $11,200 now showing up on all my credit reports.  I had to make a payment on my car to the original lender because ORL and [redacted] took so long to process all this that I couldn't let their lethargy ruin my credit.  Also, I am receiving emails to leave positive feedback before even being acknowledged by the lender.  ORL has sent me OVER THIRTY EMAILS during this process, many with redundant info and unanswered issues, and 2 months later, I still haven't heard a thing from [redacted] a.k.a. [redacted] a.k.a. Shady McShadertons.

Please enter your reason(s) for rejecting the business response below.I reject Open Road Lendings response and wish no further communication with Open Road Lending, as I will be forwarding a complaint to Texas attorney general and consumer affairs.

Complaint: [redacted]
I am rejecting this response because:As I've told their representatives, I DID NOT apply for any financing. I knew fully well what my plans were moving forward and had already moved towards the acquisition of a new home. Financing or Refinancing a vehicle was NOT EVEN BEING CONSIDERED! When speaking with Open Road's Supervisor, he stated that they never had anything like this happen before. Further, that I must have applied, because nobody else would stand to gain from a refinance of a vehicle. I would differ because 'they' or any lender would stand to gain from my vehicle' current finance being moved from the current provider. I have asked that all related Open Road Lending and affiliate credit inquiries be removed from my credit report(s) without further delay. If this cannot be effected, I will be in contact with my legal team to discuss taking action as this could very well cost me tens of thousands and the loss of a home that I'd already entered into a $400k purchase contract.
Regards,
[redacted]

Ms. [redacted], I will reach out to the credit reporting agency and see if they will remove the inquiry. There is no guarantee they will but I will make an effort in an attempt to make you happy. The OpenRoad Lending Team

I am rejecting this response because:the response from the lender did not address my concerns. I understand the terms of their counteroffer, but I don't accept your deceptive advertising practice.
