I, Andrew [redacted], Sales Representative/Inventory Specialist for Johnson Auto Salvage did witness the following incident beginning Wednesday, July 1, 2015 at approximately 4:12 PM.
Prior to the purchase of a distributor for a 1995 Ford Probe,...

a customer called looking for a distributor for what I believe was a 1996 Mazda 626. The Probe distributor interchanges with the 626 distributor. The customer stated that the entire distributor was not needed and all they were looking for was a small piece located under the cap. I informed the customer that we would not separate anything from the distributor but we would sell it complete. The customer agreed and asked that we could locate the complete distributor in our salvage yard. One of the parts pullers located the distributor on a Probe and removed the part from the car before marking the item with the stock number AD0053 on the distributors aluminum casing. The item was brought to the office and was placed on a counter awaiting pick up.
On Wednesday, July 1, 2015 the customer arrived to the Johnson Auto Salvage sales office and presented a check for the amount of $80.53 with the sales manager. The customer received a Johnson Auto Salvage receipt with warranty information on the back. Once the sale was complete the customer left with the distributor making no complaints at this time. I was not present for the purchase. On Friday, July 3, 2015 the customer called Johnson Auto Salvage and spoke to me. The customer explained that the distributor that Johnson Auto Salvage sold the customer broke while another subject was installing it. The customer stated that the distributor was also cracked in another area. I explained to the customer that I could try to find another one. The customer stated that they just wanted to bring the item back.
At approximately 4:15 PM on Friday, July 3, 2015 the customer and a second subject arrived at the office with a distributor. The customer stated that the item was broken. The customer stated that the item broke upon installation and that a part if the item was broken before installing the item. I noticed that the items stock number was faint and appeared to be rubbed off. I was the only one at the office at this point because Johnson Auto Salvage had closed at 3:00 PM as this was the day before Independence Day. I called the parts puller that located and removed the item from the vehicle. The parts puller stated that the stock number was written on the distributor and that the distributor was not cracked or broken when it was pulled. The parts puller stated that the distributor was in good condition at the time of sale. The sales manager confirmed the parts puller statement that the item was marked and in good shape at the time of sale.
The customer stated that the form of payment used was a check. I informed the customer that I wanted to talk to the owners about the situation. I also explained to the customer that I was not authorized to write checks for Johnson Auto Salvage. I explained to the customer that I would talk to them the following week when the owners were back from vacation and had time to review the situation. The customer left at that time. I spoke to the owner on that following Tuesday morning, July 7, 2015. The owner referenced the warranty information on the back of the receipt. The warranty for this item located on the back of the receipt that the customer received states exactly: RETURN POLICY bullet point number 3 states "Parts must be returned in the same condition as sold, complete, and undamaged.". RETURN POLICY bullet point number 7 states "No returns on sensors or electrical parts.".
The owner and I looked at the distributor locating three points of damage. One aluminum bracket was broken off completely approximately 2 inches long by 2 inches wide by .5 inches deep. A bolt holding the distributor cap to the aluminum casing was broken off at the casing and the head was no longer with the distributor. The last notation of damage is on a mounting tab at the point where the distributor cap meets the aluminum casing. This area is cracked as the bolt holding the two parts together was placed too tight and compromised the integrity of the plastic breaking the item. The plastic cap on the distributor appeared to be tampered with and removed allowing access to the internal parts of the distributor. At this point due to the warranty information and the three areas of damage located on the distributor Johnson Auto Salvage decided not to refund the customer.
The morning of Tuesday, July 7, 2015 I spoke with the customer explaining that the distributor was in good shape when it was sold to the customer. When the distributor was returned it was broken in three places. The customer stated that the aluminum bracket broke upon installation. I asked the customer if the plastic cap was removed at any point. The customer replied "Yes my boyfriend took it off to see what was wrong with it". The customer then stated "It's not my fault that he took it off. It didn't work to begin with". I asked the customer why the cap was dismantled from the casing if it was known to be a bad part. The customer replied "I don't know why he did it. To look at the inside maybe". I explained to the customer that at this point Johnson Auto Salvage would not refund the $80.53. After explaining this to the customer several times the customer asked if Johnson Auto Salvage was going to keep the $80.53 and the distributor. I explained to the customer that Johnson Auto Salvage was not refunding the $80.53 and the distributor was going to be in the office for the customer to pick up.
The customer stated that they were going to do a stop payment on the check with their bank right away. The customer stated that they were going to call the Revdex.com to inform them that Johnson Auto Salvage sold the customer a part that the customer never received. I explained to the customer that if they did that it would be dishonest as the customer did receive the part in good condition and brought it back broken in three places. I explained again that the distributor also appeared to be dismantled. I explained to the customer that I was placing the distributor and the broken aluminum bracket in a bag in the office here for them to pick up their distributor. The customer hung up the phone at this point while I was talking. I immediately informed the owners and the sales manager of the situation. I taped the broken bracket to the distributor and placed the item in a plastic shopping bag. I placed now broken distributor in the bag on shelf in the office for the customer to pick up. The customer never came out to pick up the distributor.
If needed a duplicate copy of the initial receipt given to the customer can be provided with the Johnson Auto Salvage Policies and Warranty information printed on the back of the receipt. Also pictures of the customer's distributor can be readily available as it still sits on our shelf in the office.

no due to the fact I called on july 1st said how much distributor was when I said I called another place he asked what they were asking for that I explained that I needed one affordable and he said I have one I could sell for 80.00 I did ask for the whole distributor when I called he was willing to sell for 80.00 when I went to pick up and when it was trying to be put in the piece broke right away now something that thick of metal should of not broke my boyfriend looked at it unscrewed to due to he wanted to see how the ignition coil was inside cause once we put in it was not working at all thats why he unscrewed it due to the distributor has everything thing in it the rotor the cap on the cap he noticed that it was cracked as he was unscrewing it the piece was not dismantled it was broke in 2 places when I got it noone checked it over when I went to pick up the lady and I just matched it she says I think it looks like right one when I called that friday the guy asked if I wanted a different one he could go see if guys can go down look to see if they want anoother one I said I just wanted to return it and he even stated I could get money back obviously this distributor didnt work cause when it got put in car it didint work so I brought back thepart the guy whos was working I showed the exact places where I found to be cracked he said he would have to wait till monday hes not authorized to give me money back so when I spoke with the guy on tues he accused me of breaking the whole thing I stated I called friday the guy said bring it back to get money back we argued little bit on tues he did not state to me that I could come back and get that part that it would be at front counter he stated I dont get nothingthe distributor was taken apart after the fact it was put in car and due to the fact the ignition control module and rotr and all everything else is in this distributor as it was checked out the 2 pieces were broken on that part due to them selling it that way to me as I explained this to the guy on phone it was told to me bring part back to get refund and again it was never said to me at all to come get back get that part he was very rude and again I dont get nothing also I have the reciept this part the metal bracket on that part should of not broken as they claim it it was working distributor if it didint even work in the car so it was a false part that was not working in the proper condition so if a part does not work it does state warranty
