Complaint against Jon Carroll Contractor License #[redacted] The total square footage of the bath and closet involved in this remodel is about 103 sq. feet, including the shower stall, with 8 foot ceilings throughout. We paid Jon $12,800 for his labor and rough materials; we paid for all finish materials.NRS 624.301(3) failure to complete a construction project for price stated in contract.NRS 624.301(4) failure to prosecute a project with reasonable diligence.NRS 624.301(5) failure or refusal to comply with the terms of a contract.When we first approached Jon about this project, we told him that we had a maximum $9,000 budget for labor so he could tell us if he was interested in such a small project. He assured us that he was an experienced tile setter, and came in with a bid for $5,385.We signed the original contract with Jon on 3.16.14 and he began the project on 3.17.14 with a projected finish (as he had other projects pending) at the end of April. He did not bring the work to a close until 6.02.14. We assert that he parked himself on our project and billed us solely to meet his income requirements for the 11 weeks he spent here, that his pricing is arbitrary in that he has provided no contemporaneous log to substantiate any dollar figure on his final bill (which I watched him finalize in the cab of his truck on the day he gave it to us, note that the charges for these extras are written in a different ink color). We dont know his rate per hour, nor did he give us any warning about his spiraling costs, even though he knew about our labor budget. He also ignored my request in a note dated 3.21 to provide an estimate for extra costs related to replacement of the Master bath window. We should have insisted because written change orders signed by both parties are specified in his contract, but trust made us lazy.We gave him a key to our home, as we both work. My wife works part-time so was a regular witness to his work habit of arriving by noon or later, then sometimes leaving for lunch. She assisted him on several occasions with finish work, and would pick up items at Home Depot that he had not planned for. After he surprised us by setting some shower wall tile without consulting us on the layout, she took over all tile layout responsibilities. I helped him install the exterior window trim and we both spent time cleaning up after him. All of this was our way of keeping him working on our project as we wished to get it finished; we had yet to realize that he was in no hurry because he intended to inflate his billing to reach his pre-determined income requirements.His final billing for additions to the original contract was $9,510.70, a full 170% increase over his original estimate. He reduced his fabulously inflated bill to $8,000, a 149% increase over the original estimate, and began to get agitated when we objected to his charges, threatening us with a lien against our home if we did not pay him immediately. We had asked for the bill on the previous Friday so we could review it.Poor planning was evident throughout this project. Jon ordered the windows from a supplier known to him so all dimensions were provided by Jon at this time. He had spent a great deal of time to carefully remove the exterior trim as it was his intention to re-use it, only to discover on what was to be his last day that the original trim was not wide enough, necessitating yet more time (and cost) purchasing, cutting and finishing trim materials which are different in dimension from the rest of the trim on our home. He ordered the Master Bath window to open in the wrong direction, ignoring the opening direction of the original window. On his extra billing he specifically mentions the delay related to his error and arrogantly applies a charge to it. In the final days of the project he was also struggling to get the shower operating valve to fit properly. He told me that he reached into the opening and cut away some material, then pulled the copper plumbing out enough to make the attachment work. I will hold him responsible for any future leaks caused by his actions here. His original contract for the Master Bath & Closett Remodel specifies that he will Mud tape, texture, Paint walls two tone ceiling. Jon double-charges for this task in his extras billing. Full texture of Bath and Closet were part of the original contract. We want to recover $4,000 from Mr. Carroll because we feel his charges to be excessive and predatory and are unsupported by written change orders signed by both parties as required in his original contract.Desired SettlementWe want to recover $4,000 from Mr. Carroll because we feel his charges to be excessive and predatory and are unsupported by written change orders signed by both parties as required in his original contract.
