The client can hire a new attorney and any unused portion of the fee shall be refunded. As soon as we receive a substitution of attorney from his new attorney, we shall be relieved from handling his case. Until we receive the substitution of attorney we are not relieved from an obligation to appear in court. The client also has a right to proceed to fee arbitration if he feels that the refund of the unused portion of the fee is unfair.
As for his position regarding the facts of the case, we dispute his version. The attorney handling the case had a death in the family and the need to adjourn the case was communicated to the client. He took it upon himself to review court records online and thought that somehow necessitated his appearing. When he appeared, the case was adjourned just as was represented. He apparently wanted the case done irrespective of the unforeseen circumstances with Mr. F[redacted] death in the family. If he now wants to fire us because of that he has every right to do so and be represented by the attorney of his choosing. Notwithstanding, this is not the way you go about things since there was no wrongdoing as is implied.
Once we receive a substitution of attorney we will prepare a bill and refund any unused retainer. That is the process that applies in a situation such as this and what will be fulfilled by my firm.
