Review: I have sent letters to Jonestown Bank and talked with them over and over and asked them to please not call me at work, I am a payment behind on my mortgage, and we are struggling financially. We also went into Jonestown Bank and asked if we could extend and remortgage our home for a lower interest rate. They turned us down. I have tried to be as polite as I possibly can be, but they continue to call me at work, and at home. My husband talked to them one day and they called me the next day, I was upset and asked why they called after just talking with my husband. I'd like to know where the cut off is for harassing. I can not believe I am the only customer that gets behind in a payment now and then, and how many times can they call home, work, and not be considered harassment. I thought of talking with a lawyer but of course that is more money to spend, that I do not have at this time. I sent a letter and said please do not call me at work as I work in a cube and have no privacy, and I don't take personal phone calls. We are not supposed to have personal calls at work. They continue to harass me at work and at home. I live in [redacted] and work in [redacted], so by the time I get home they are out of the office usually. I call and leave a message.Desired Settlement: I would like to know if there are any laws that pertain to this kind of practice behavior. I won't be able to pay them anything if I get fired from my job for getting personal phone calls. I am under more stress then I can handle but they keep pushing me and pushing me. My husband works seasonal (Construction), which causes us difficulties financially, and I have a disabled son living with me, and I'm trying the best I can to handle my proble**. Calling me at home is sufficient.

Unfortunately, internal procedures regarding the disclosure of non-public personal information to non-affiliated parties were not complied with in the response.

This letter is in response to **. [redacted]'s complaint to your office filed on November 12, 2013.

The mortgage and the various points of communication **. [redacted] references in her complaint were investigated by our staff. While I am unable to share the details of **. [redacted]'s account I would like to address her concerns regarding what constitutes harassment.

Although we are not generally subject to the Fair Debt Collection Practices Act, we do, as a matter of policy, voluntarily follow the provisions of this act in the collection of consumer debt. Employees of [redacted] serving in a collection capacity may not (1) harass, oppress, or abuse any person in connection with the collection of a debt; (2) use any false, deceptive, or misleading representation while collecting the debt; or (3) use any unfair or unconscionable practices in debt collection.

Unfortunately, we did make an error by contacting her at work after she had asked us not to. This was an inadvertent mistake and we do sincerely apologize for our oversight in not complying with her instructions. Her file has been appropriately documented so that we do not make this mistake again.

In addition, in her compliant **. [redacted] indicated an interest in refinancing her loan. We will communicate directly with her regarding options we may have to resolve this satisfactorily for all parties involved.

Review: We have been making all of our necessary payments since an agreement reached in the spring where collections was giving us faulty information. That issue was solved by going into a branch and being told that collections repeatedly gave us false info which led to us having to pay over a hundred dollars in late fees to get them off of our back, which we did. Everything was fine with the agreement we settled on. We have been honoring it ever since, but this morning we got notified that they reported us behind on payments to our credit report when we are not. We had great credit until doing business with jonestown bank now it is ruined of no fault of our own but trusting their professionals. We have considered getting a loan from a different bank but these mafia like tactics prevent this.Desired Settlement: To have the most recent activity on our credit report immediately removed and as long as we honor our agreement they should leave us and our credit alone!

This letter is In response to **. [redacted]'s complaint to your office filed on August 9, 2013.

The loan account and communication **. [redacted] references in her complaint were received and researched by JBT's Loan Servicing Department. In her compliant **. [redacted] indicates that she reached a payment agreement with us in the spring, which we confirmed to her by letter. She did make those payments as agreed and her account was not reported to the credit reporting agency as past due in April, May or June.

Unfortunately, there appears to have been some break-down in communication between JBT and **. [redacted]. In a show of good faith, we are reversing the late charges assessed on her account from February 2013 through August 2013 in the amount of $41.24. We also agree to give **. [redacted] a fresh start by removing the five 30 day late credit reporting.

Review: Please review the emails below and the banks response. Nothing sent in writing. I disagree that payments were late. They site 39 payments were 10 days after the due date (doesn't matter - no late payment unless 15 days late - just a bully tactic). They did not send me updates regarding late charges and interest being charged. They notify me when I call to close out my loan, no detailed invoices, no notices about late charges not being paid, etc. Very unethical. It appears that they are charging a very high interest on the money, well over 100% a year based on the daily increase they quoted. Money figure moves from day to day. No detail to what total charge is.

MY response on 9/5/2013:

The $228.94 figure differs from the $227.99 quoted yesterday. Please explain. Is $228.94 due on the 30th as you noted below or not. Please send me something in writing. Thanks.

In the meantime, I have thoroughly gone over your account and the following is what I found. The final payment due on September 30, 2013 is $228.94. This includes $100.00 in unpaid late fees accumulated since August 15, 2012. Since the beginning of your loan, 39 payments were made past 10 days from the due date and 2 payments were made past 30 days. This resulted in 13 late charges at $20.00 each and 8 of those charges were paid. Late charges result in making payments later than the grace period of 15 days past the original due date.

As far as the mailing time issue that you mentioned, as soon as the payments are received they are credited to their corresponding accounts. No checks or payments are held. If you would like, I can send you a copy of your payment history but it sounds like you already have a history for review. Unfortunately, we have no control over the Post Office or when the payments are mailed. If this is a concern, I would go to the Post Office where you mailed your payments and speak with them about this issue.

I checked with our Collections Department regarding your late fees and according to their records, many contacts were made or attempted to be made because of your payment history. As a result of this finding, I am not inclined to waive any late fees.

Again, I apologize for your initial conversation today regarding your loan and I hope that I was able to answer your questions and concerns.

I called today to inquire about my final payment on my loan and was told it was 227.99 and was told it would increase each day even though it was not due until Sept 30. When I asked about why so much I was told probably late fees. I asked to have a detailed explanation and bill for my review. This request was met with some resistance. I was then told it looked like a $100 late fee on a 126.52 payment despite payments sent on time and a late fee of $20 clearly written on coupon book if sent after a certain date.

Records will indicate that I sent in the late fees when payment was sent after the due date. I notice that at times checks are processed the day after I send them. Other times it takes up to three or four days after they should have been received. I am not happy and want any overdue charges eliminated so I can close out my loan. I see on the Revdex.com website that there have been two similar complaints made this year already. I would like my experience with your bank to end on a pleasant note. Please get back to me ASAP as it is a time sensitive issue. Thank you.Desired Settlement: Late charges and interest dropped. Detailed account of what is actually owed. That they not do this to anyone else.
