We rented a boat for $and left a $security deposit The owner kept the entire deposit because we failed to sign in adults
The deposit of $was kept because the owner felt we hade violated NC boating laws by not signing in occupants The boat held passengers we had total I have tried contacting him to receive reimbursement - he has refused I have never been treated so unfairly in any business transaction

We rented a pontoon boat on Memorial Day weekend (Saturday), and agreed to pay $500 for 1 day rental and leave $1,000 deposit. There was no formal paperwork during the morning walk through. [redacted] the owner basically told us it was a new boat with only about 50 hours, so everything was new. When we returned the boat, we asked if everything was ok, and he said we were good to go. We stayed around the parking lot for almost 30 minutes and he never approached us. He did not give us any type of paperwork after we were done either.I called the next day (Sunday) to ask when I should expect my $1,000 deposit back. They said [redacted] would call me back, but he didn't. On Tuesday, I received a [redacted] notification saying I was refunded $567. Again, I was never contacted by [redacted] (the owner). I called again on Tuesday, and [redacted] answered the phone. I asked him why did I not get my full refund back, and he said he saw a dent on the boat, so he just took my deposit. He sent me a picture of the dent, and admitted it was just a cosmetic issue (see attachment), and mainly he was upset because it was a new boat (I have emails to back this up, and phone records to show I called several times but he never called me). I do not recall doing anything during our rental that would cause a dent, and again, he never pointed out the dent while we were there. If he saw it after we left, I don't understand why he never called or emailed me to tell me about this. I found out 3 days later, after I called him. And regardless, he didn't provide a quote for fixing the dent, he just took half of my deposit!I asked a lawyer if what he was doing was legal, and the lawyer said no. [redacted] then mentioned I signed a rental agreement online when I reserved the boat. I tried finding the rental agreement on his website and couldn't find it, he never emailed me the agreement either. I asked him in 2 separate emails for a copy of the agreement and he ignored my emails. I then called him and asked him to please email me a copy of the agreement, and he said he will not do that.I don't think he can just take what he wants out of the client's deposit without any sort of communication with the client. We do not recall doing anything that would cause this dent, and he has no paperwork or proof to say it was us. I would advise future costumers renting from this company about his refund "policy" and excessive rates. I think he is trying to come up with money to pay for his new boats by charging almost twice as much for his rentals (other rental company in that Lake charges $325 for 1 day rental of same boat) and dipping into costumer's deposits.Desired SettlementI want a copy of the agreement and an explanation of charges including a quote on the dent.Business Response Contact Name and Title: [redacted], ownerContact Phone: [redacted]Contact Email:[redacted]Case was resolved, where I legally have the right to withhold funds from the damage deposit, when the items return damaged. Customer refuses to take responsibility for what I assume were accidental dents to my boat. Higher rental fees for nicer equipment should not matter in this case, because customer agreed to all terms and conditions prior to use, and was more than happy to take a nice, clean, functional, new boat for her recreational activities at the agreed rental rate.Social media, Revdex.com, etc are ways for her to vent her unhappiness with our business practices, but reviews from other customers will support that Jordan Lake Water Sports is a great business, offering excellent customer service and great equipment at fair prices.Consumer Response I filed a dispute with [redacted] about this issue, and this was their response "[redacted] Purchase Protection only applies to tangible, physical goods that can be shipped. Payments for intangible items, services, licenses, or other digital content are not eligible for dispute resolution." Meaning, they cannot cover rental agreements. This is what Jordan Lake Water Sports is referring to by "Case was resolved, where I legally have the right to withhold funds from the damage deposit, when the items return damaged." No lawyers have been involved to argue the the case was resolved legally.This business did not provide copy of rental agreement prior or after the rental (and when requested, it was denied 3 times), did not document the walk through prior or after rental (no paperwork was provided or signed by us saying that there were no dents), and in my case, I was never notified by the owner about the damage he claims we did. He simply took half of the deposit without notifying anyone. I was the one who called to inquire about the deposit, and when he finally answered the phone 3 days after I returned the boat (I called 1 day after rental, he did not return my call), then he said that he saw a dent the next day so he took my money.Again, he has no paperwork to document boat appearance before or after our rental (car rentals do this), he did not contact me to discuss the "cosmetic damage" to the boat prior to taking money from the safety deposit, and he said he will not provide a copy of the rental agreement when requested.Case was never legally solved as he claims, and he kept the money.Final Business Response A copy of the rental responsibility sheet has been submitted to both the [redacted] complaint, and to the consumer's credit card company where consumer is also seeking resolution concurrently with this Revdex.com complaint. Responsibility sheet contains signatures from consumer, consumer's husband, and all other adults that were on the boat during the rental period.Consumer is welcome to obtain her own estimates from accredited repair facilities. Boat will be made available on our premises for inspection during normal business hours (9am -6pm), provided that item is not being used by other customers. Repairs to the boat will be completed once rental season is complete to avoid loss of rental fees. Estimated October.

I ordered 2 11 foot rental kayaks for the day on August 15, 2015. This company never delivered them and are not granting me a refund. All I want is a refund. This company says they attempted to call and text me the day of the kayak rental but that is not true. My phone did not have any missed calls or texts from this company. All I want is a refund because I paid $60 for nothing. Nowhere in the correspondence with this company was I told that everyone who would be using the kayaks needed to stop by the office to try on life jackets. Communication with them has been shady from the start./////Desired SettlementJust a refund, that is all. That is a fair resolution./////
