Review: Earlier this year I was in the process of purchasing a house. The house was located at [redacted]. On November 20, 2014 I was given a denial letter by my mortgage company and I sent that to the seller's attorney ([redacted]) on November 24, 2014 and I have yet to receive my initial down payment of $2,931.25 back. My attorney has reached out to the sellers attorney ([redacted]) multiple times and [redacted] has yet to respond. The seller's attorney ([redacted]) stated they would return the down payment once I produced the denial letter but I have yet to see it.Desired Settlement: I want my initial down payment of $2,931.25 back within five (5) business days of the resolution of this matter. The check should come certified.

The complainant entered into a real estate contract to purchase property at [redacted] jersey City, NJ. I represent the seller. Under the terms of the contract I was holding a deposit of $2,931.25 towards the purchase price. As the escrow agent, I am not authorized to release money unless both parties, buyer and seller, that the contract has been properly terminated. The buyer alleged that she could not obtain a mortgage commitment. My client, the seller, is under the opinion that she did not make a good faith effort to do so and has not authorized me to release the deposit. I am in continued discussions with my client as to his legal position. This is not a matter for the Revdex.com to review. Under NJ Law it is to be handled between the parties. Please mark this case dismissed and confirm with my office.
