[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed Administratively Resolved] Complaint: [redacted] I am rejecting this response because: This contractor is not being truthful He did NOT return to my residence, nor has he been in contact with me to rectify the situation I have no correspondence, no note, no voicemail message or any other communication outlining any offer to correct the deficient work His last contact with with my partner, [redacted] back in September wherein he indicated he would get back to us when "he got around to it" along with a claim that he needed to return when it was raining to assess the situation, despite our having provided him with numerous photos (some of which are attached and clearly depict the problem) That his correspondence acknowledges there are deficiciencies with the work he performed (i.ehe found water pondage on the right hand side) he should return immediately to fix it, or he should return the money he was paid (and very promply collected) so we can hire someone else to do the job rightThe weather is turning cold, and the window to repair is closing I suspect he is dragging this out so he can then claim he can't fix til spring, leaving us with a hazardous situation in the ice Accordingly, if MrC [redacted] does not come to fix the poor work he performed before October 17, we will have no other recourse than to hire someone else to correct the work and seek reimbursement through whatever legal remedies available Regards, [redacted] ***

I am rejecting this response because:

Unfortunately, at times, water pondage occurs. I, nor does any other contractor, guarantee 100% water pondage. Unfortunately, at times, some do not come out 100% smooth, unfortunately, at times, some do not “look” right. What I do is the best of my ability and experience and is not an exact science and sometimes customers are not happy. I do try to comply with what the customer wants to be corrected, but at times, it will not work or make the situation worse.This particular driveway is 3,000 square feet, which is large and the cost was $4250, not $4500. I did return to the customer's residence to assess the situation and what I found was water pondage on the right hand side and the customer is not happy. I offered a solution to no avail. There is no one answer.Thank you,

Review: Contractor hired to re-pave existing driveway. Driveway not smooth/pools in rain. Contractor contacted on numerous occasions to inform of service defect and to make repairs. Contractor has refused to come to make repairs, indicating he has been busy, needs to come to view during active rain, etc. Contractor will not provide a definitive timeline to make repairs.Desired Settlement: Contractor should refund payment of $4,500 so that another contractor can be hired to perform the services correctly.
