Review: I contracted Mr. Bugay to fix/take the swallow out of my driveway so large heavy vehicles did not get stuck and water did not lay in the swallow. My driveway is appoximately 30 ft. to the road, meeting with Mr. Bugay we both agreed he would have to start from the end of driveway(at road) and come up the driveway approximately 12 -13 ft. with fix/ asphalt fill to eliminate swallow. Mr. Bugay repaired my driveway while I was working; when I came home from work, immediately saw that the swallow was still there, had only come up the driveway approximately 5-6 ft. (you could see the deep marks still in driveway where our moving truck had got stuck - and water was running to side vs. down driveway to road in order to run to drain. I called and met Mr. Bugay to discuss at my driveway - he said he would be there the next day to fix correctly. When I came home next day all Mr. Bugay had did was pour HOT STREET TAR and ground Stone dirt over line 5 to 6 ft up driveway. Called Mr. Bugay again and again he met me at driveway, after 30 minute discussion all he would say is that he could not come up that far in driveway(but he had written agreement/contract that he could). He told me I could get/ask other paving contractors and they would tell me the same. The stone and dirt washed out of tar within weeks/month. I have had two other Asphalt paving contractors out - one attempted to take out some tar and seal but could not stop tar from bubbling through. The other contractor told me the only way to fix was start over and cut out tar and re-fill with Asphalt, and both said Mr. Bugay should have definately come up another 6-8 ft. to eliminate swallow and they recommended I get the contractor "that messed up my driveway with street tar and I had paid to come back and fix". I called Mr. Bugay about a few weeks ago and expressed this and the fact that the hot tar bubbles on hot days - gets tracked into my garage and house(new carpet and wood flooring) on car and person's shoes/feet. He came out and gave me a small box of ground stone dirt again and told me to pour on when tar was hot. I expressed only going to wash away again and that I really needed this to be fixed correctly - telling him what the other contractors said. He refused to fix correctly.Desired Settlement: I would like Mr. Bugay to do the work that he was contracted for - at very least get the HOT TAR out of my driveway that is destroying my garage/home floors. OR give me a refund of what money I have paid him for to hire new contractor. I would like most and foremost the street tar out of my residental driveway (this was to be done with Asphalt). The original contracted work done or a total refund to be able to hire someone that would be willing to fix Mr. Bugay's mess.

I am rejecting this response because:

Mr. Bugay's response is neither totally factual or truthful and as much as he would like his Revdex.com rating restored, I would like to have a driveway that is restored to contracted work and is not full of hot, bubbly tar that is all over my car tires and garage along with on shoes and tracked in on my flooring(actually had shoes get stuck in it and come off!).

Yes, the attached list of satisfied customer's is the same that is on his web site and why I called. Yes, he mailed that hand written 2 line quote to me, but failed to mention after receiving his quote I called him and asked him to please meet me at my house and go over it because it wasn't very specific and I wanted to be sure we were both in agreement of what I was expecting and he was quoting and to ensure he had repaired residential driveways and not just done business parking lots prior.

Mr. Bugay met me that evening and assured me he had done many residential repairs as mine(eliminate swallows) in the past. I pointed out the gouges in the driveway where truck had scrapped and got stuck(had to be towed out) and showed how the water ran to the side(in neighbor's yard) not down. That's where the 12 to 14 ft. came in we both marked as to how far up the driveway he had to come with repair/fill to eliminate this and swallow, which he also fails to state. He assured me he would fill with asphalt and tape(not tar) seam and correct both these problems/issue the next day - asked me to leave a check in the door for him to pick up after work completed.

It was not in a day or two that I called Mr. Bugay, it was the same day work was done and I saw his work. I asked if he was coming back to finish, due to the fact he had not come up driveway with repair even half of want we agreed upon, there was still large swallow(could still see gouges I pointed out from truck prior) and water still ran to the side. He said he considered completed but if I was unhappy would met me that evening and discuss.

Also, Mr. Bugay failed to mention, after our discussion that evening the he agreed he would be back next day to finish/repair as agreed and once again we marked the point to eliminate swallow(approximately 14ft from end of driveway), and Mr. Bugay asked again that I leave his check in my door the following day.

When I came home the next day I found Mr. Bugay had only poured HOT TAR and then sprinkled ground gravel over the 5 ft. he had done the day prior.

I called very upset and in a rage, and once again Mr. Bugay came to my house. It was at this point and only at this point did he tell me that he could not come up as far as marked and agreed because my car would scrape (for the life of me I am still trying to figure out how eliminating a swallow will cause my car to scrape). He explained tar and gravel was to seal seam, he used all the time and in time would harden/blend in. After lengthy discussion/agrgument and his assuarance that I could call any other paving contractor and they would tell me the same thing, absolutely would tell me the same thing or if by chance they did not he would come back, that I reluctantly gave him $400.00 to cover his worker.

Mr. Bugay absolutely lied when stating he told me to wait 2 years to have the driveway sealed. He told me it was standard and to wait 6 months to have it sealed and that it would be beneficial to have it sealed after the 6 months!

I had the driveway sealed approximately 8- 9 months later and then on first hot day of this summer the tar only cracked the sealant and bubbled right through.

I had two other paving contractors to my house and both stated the same exact things. "ABSOLUTELY Never heard of or would Never use hot street tar in a residential driveway, and would have to charge me twice as much due fact of having to cut out tar and original messed up work and then do repairs, and absolutely should have come up 14 to 16 ft to eliminate swallow, and they would have the original contract that made the mess come back and fix!"

I called Mr. Bugay after receiving both contractors statements and suggestions and once again he agreed to come to me home and discuss. He immediately started to disagree, argue the facts of other contractors and handed me a small box of ground gravel and told me "pour this over the tar when it is hot and bubbling , that's all I can do for you."

Mr. Bugay did not do the work that what he agreed and contracted to do, along with making a total mess of my driveway and home.
