Review: I contacted [redacted] in October of 2012. In January 2013, I wrote a check to formally retain the services of [redacted] on behalf of my elderly mother. After a general lack of responsiveness to my calls and requests for status update, he contacted me to let me know that, in the opinion of the expert witness, there was not a case. We agreed to not pursue it further and he indicated that he would reimburse any funds that were still in the escrow account. I never heard back from him. In September 2013, I contacted him to find out the status of the remittance of the check. I was told the check was sent on July 25, 2013. When I spoke with the paralegal ([redacted]), I was told that the check was mailed to an address that I never gave him and that I have not lived at for over 2 years. When I followed up with him, he asked me to be patient because the account was closed. I sent an email this week questioning how an account could be closed before the funds cleared and have not heard back from him. I have attempted to contact him repeatedly and have not received any response back. His business telephone # is not answered by a person anymore; rather it goes directly into a voice mail box (his voice.) He does not answer his email or his cell phone.Desired Settlement: I would very much appreciate if the Revdex.com could assist me in getting him to send the refund. I am also sending this complaint because I would like to ensure that he cannot take advantage of other potential clients.

Response:

Ms. [redacted]'s files and refund of the unused costs retainer were sent to her months ago. She has acknowledged that her neighbor may have received the package and that the neighbor was out of town for an extended period of time. We never received the package back and the check was never cashed. When we inquired of Ms. [redacted] as to why the check hadn't been cashed, we were told about the neighbor and were asked to provide another copy and check. Subsequent to this request, it was discovered that certain costs and expenses had not been posted to Ms. [redacted]'s account and that a new accounting needed to be performed. This process is in the works and will be concluded shortly.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

His explanation provided is unacceptabe, incorrect and untrue. The address to which the check was mailed is an address at which I have not resided in almost 3 years. Therefore, it is impossible that a neighbor would have picked it up. Nor is it the address on the check I had provided when I retained his services. He agreed he would reissue the check and needs to make good on his word.
