Issues with cars being in good shape and issues with money.
On Februray 27,2020 I went to the car dealership after seeing ads on *** They sold the car I wanted so Jospeh showed me a car that was just brought in. It was a 2005 Mercury Montego. He wanted 3500 total for it. Within a couple hours, the transmission started acting up. We took it back asking for a return on money and he said he couldn't. That for us to keep it while he came up with alternative plan. A couple days passed, and he offered us a downgrade 2005 Ford Focus. He wanted us to pay an additional 1000 on top of that. He agreed to accept 500 that day after getting angry in his office that we didn't have more money. He also stated in his office that he wasn't giving a lady her tags because she was rude. Now we have expired tags and he will not give us the new ones even though he has gotten 4000 from us. This car is now broke down in our yard and won't run. He gets angry every time we have talked to him.

Desired Outcome

I want all my money back since I couldn't get a car in decent shape.

On February 27th,2020, I came back from auction and 4 people were waiting on me to sale them a car. I sold 2 cars and one was leaving when Mr. and his girlfriend came and were upset that they car they had wanted had just been sold and was leaving the lot. As they were leaving they saw a car that was similar with lower mileage on my tow dolly. He asked me about the car and I told I had just brought it in today, but I still have to take it to mechanic to check it out. I only stopped by because there were customers waiting on me. He said he wanted the car as is he loved the inside and everything. He asked me to crank it up and I did he and his his girlfriend were really happy and excited about the car. I told them they had to wait their turn as I attended to the customers that were there before them. While I attended to the other customers they circled the car and cranked it up. That evening after they bought the car he called me and said the car was driving funny I told him to bring it back to my shop so I could see what was going on with the car. As I drove the car I did not notice any of the things that he said was wrong with it and I have the conversation on record where he stated the car is not doing what it was doing when I (Joseph ***) was driving it that it was doing when he ( Mr.) was driving it. So after that they took the car back home with them. The vehicle was sold as is with them understanding that I had not yet taken it to my mechanic. They signed all as is paperwork as well as buyers that stated there might be issues with the vehicle. A coupled days later after they had driven he told me that he had taken the vehicle to the mechanic and the mechanic said the transmission was going bad and it would take 3000 dollars to fix it. And he begged me to help him out and I told him to come in on Saturday morning to help him out. I told them I would try my best to help them. I showed them a 2014 KiA forte and 2005 Ford Focus I told them we are both at loss on the vehicle and the 2014 forte I would need about 2500 and 1500 on that. I presented the 2 cars and he picked the Ford Focus and he could only afford 1000. He told me that he had only brought 500 with him and he would give me the remainder at the end of the following week. I have the conversation on record.when he came to the day he was suppose to pay he never came and refused to answer the phone until I send him a text message. He responded and told me he didn't have the money yet and cussed me out. Then every time I called he cussed me out and told me the car was broke down on the side of the road near *** and I offered to come help him because I knew where *** was. I went to *** neither him nor the car was there. I told him to send me the location and I would come help him. He told me he did not trust me. After that I called him again he told me the car isn't running anymore the car was parked in his yard. I went by his house and the car was not there and I found out he has been driving the car to work and he has been lying the whole time . He has been trying to take advantage of me the whole time. I have all conversations on record.

Customer Response • May 04, 2020

(The consumer indicated he/she DID NOT accept the response from the business.)
The car has been sitting in our yard ever since it broke down. Any conversation with the dealer, the dealer would also start yelling and getting angry. The dealer did take a drive with the car that day we called back, but he did notice the light and hooked it up to see what sensor it was throwing. When we did eventually get to get back in his office, it was pay for a whole new vehicle or keep one that needed a 3000 transmission. The sealer was contacted the same day we bought it about a refund. Our mechanic looked at it while the dealer was making a decision about how to help. We also have a record of all text messages from him. We should have been able to at least get some of our money back from that original vehicle purchase. Additionally, we were not able to drive the first vehicle the weekend we kept it while he made a decision. It sat in our yard the whole time until it went to the mechanic's shop. We were not risking driving it with 2 kids. With our new vehicle, we have issues with it and O2 sensors. You can't crank it so there is no driving it back and forth to work.

I bought a car 2 days ago on the 25th. I seen the ad for this car stating that it was a 2011 Nissan Versa Note 4D Hatchback with 85,000 miles and priced as $4,900.00. The ad stated that the car runs great no squeak leaks or rattles. Runs smooth new oil change, and that it had 1 previous owner, it said it was like new inside and outside.
When I went to look at the car not only was I excited and was I having to work out of town in 2 hours so a little rushed, but I was also a bit too trusting in this man that is running his own business.
So I asked him 3 times before buying if that was the car in the ad that had 85,000 miles he said yes multiple times. I looked inside the car quickly. I test drove it and there didn't seem to be any issues but with my anxiety I kept my eyes on the road and didn't have a chance to look at the mileage. I asked again to be sure that this was the car in the ad because I have to be cautious when purchasing due to me being a single mom of 3 children and not receiving child support I could not purchase anything that would be unsafe for my kids, or my finances. He then reclaimed that this was in fact the vehicle so after paperwork and everything else was done and I was driving off the lot having 20 mins to spare before getting to work I looked down to see my speed and noticed the odometer reading 278,000 miles. Also seeing that the tires were needing air. I called the salesman, and I asked him why this car had 278,000 miles when he clearly stated multiple times that it had 85,000 miles. He said that he told me that it wasn't the car in the ad and that it was sold a long time ago. Which he did not. I never wouldve purchased the vehicle knowing this info. The next day I am seeing the check engine light come on I go up there and he refuses a trade or refund and tells me not to worry about the mileage. This car needs a new CV axle, very high mileage and oil change. I have picture proof of this being the exact car in the ad and a video of his response.

Desired Outcome

The information that this customer provided above is incorrect. She came in and asked about a vehicle that was posted on Letgo back in December that was 2011 with XXXXX miles. I told her that the car was sold , but I had another car in her price range for her down payment. I then showed her the car that she has. I showed her 4 Nissan Versas the same type of car that she expressed interest in previously. she made the decision to pick the car . She test drove the car and took it to auto zone and had them check the car as well. I am not sure how anyone can drive and not look at the odometer at anytime especially after taking it to auto zone and having them to look over the car. Auto Zone did a scan on the car and told her it was in great condition and it was a good car. The mileage was also included in the paperwork that she signed during the transaction as well as on a sticker on the car. This customer was begging me to get the car at this time of year I really didn't want to do finance because of the simple fact that people are getting large sums of money for their tax return. She also sent her brother to threaten to burn down my shop and come after me. After she and her friend came threatening me as well. I worked with her and try to meet her car needs and told her multiple times that the car she saw in December was gone and then reports me because of her decision.
