The response from J & P Pool, Incis all untrue and making up stories; they were just trying to shirk their responsibility and put the blame onto meIn the “Terms for the Contract”, item #7, clearly stated “Any additional work not specified in the original contract must be agreed upon in advance, in writing signed by both parties and given to consumer prior to commencing the additional work agreed upon.Item #10, “All notices and other communications which are required shall be given in writing by hand delivery or certified mail, return receipt requested, to the partied at their respective addresses first written above”I have the signed contract as the evidenceCan J &P Pool provide any writing evidence to support their story?The reason I didn’t approve the stone they ordered was because they were so unprofessionally ordered the stones in totally wrong size, and couldn’t be installed into the existing surround payersIt ends up I had to order the stone myself, and paid by myself. I still keep the receipt of the purchase I madeThey picked correct stones up and dropped them off at my house then never come back to finish the job It is because their constantly making mistake which cause themselves too much to finish the job!$40,is not small amount of money, people wouldn’t spend that much and try not have the job done in legal way. Specially the permits was part of money I paid already, according to “Terms for the Contract”, item #5, clearly stated “J & P Pool, Incagrees procure all required permits in accordance with local laws.”In the Contract, “Scope of Work”, stated “Install salt chlorine generator, Install the Magic Stream Led Deck Jet, Install the pool pump, Install the pool Automation control panel, etc…” The homeowner just need to “supply amps at the selected area for the equipment”. It means electrical work is part of J & P Pool job, not something I have to pay separate.Last week, I hired a pool repair company, spent $for the pressure test, and they detected the leak is from pipe connecting the pool equipment and the SPA (hot tub), there has no any trees planted in this areaFor the witness, the contractor, *** *** ***, even though we all know he is a great contractor with nice personality, but I impeach his credibility in this case. *** *** *** builds dozens Luxury homes each year, most of the homes come with poolsJ & P Pool is the only company he uses for all his projectsPlus, *** *** *** just built his own house with beautiful pool which also done by J & P Pool. Will *** *** *** stand up and tell the truth to against J & P Pool? I doubt about it

The complaint is meritless. Yes, we were asked to build a pool and SPA., the SPA (hot tub) was built adjacent to the pool with a spillover water into the pool. This was as per standard code. The customer was not happy and asked that the SPA be raised two feet so that the water would...

Following his request we tore down the SPA and rebuilt it 2 feet higher.  We advised the client that this was to code but his remark was " this is what I want I will deal with the town legally if and when it complains". We were there when the town inspector arrived and stated the SPA was too high, no other complaint. He also stated that for the average citizen he would let it pass but for this gentleman he had tried so many times to skirt the rues they we not going to let him get away with it. We then tore down and rebut the SPA a third time.  The client agreed to pay $4,500 for all the rework which include one year of servicing the pool weekly. We received $2,500 and after many attempts to be full paid let the job. In addition we were asked to get the stones needed for SPA surround Stones he himself ordered. We went to pick them up with our truck and paid $450. We could not return the open bundle so were stuck for the $450 which he has not paid. We went back for another set of stones which he did not approve of either. Two round trips of trucking is worth over $500.00 We then asked that he find the stones he wanted and left the job. Our mistake was not to slap him with a mechanics lien but we decided to be civil. The money he paid for the architect is his responsibility. He as the home owner is fined for work without a permit. It is not our responsibility nor is it our responsibility to be knowledgeable of every pool spa regulation amongst Long Island's hundreds of towns and hamlets. He tried to beat the system and got caught and must now be responsible for his attempt. The LED light and salt generator does not work as he never paid the electrician to do the work of installing it. We supplied it but it needs electrical work to run. The leak is due to tree planing around the underground piping which pierced the PVC pipe. All we say can be confirmed by the contractor who built his house [redacted]6. Presently he owes us $2500 for the SPA rework, $450 for the pavers, $500 for the trucking.  Please contact our witness for verification. Thank you for seeking the truth. Regards,Rich C[redacted]

Review: On September [redacted], 2012, I signed the contract with J & P Pool, Inc. for a complete renovation of my existing pool with new liner, new equipment, waterfalls, Hot tub, covers, etc. for total price $40,000. During the construction, they asked me to pay extra $1,000 for some cement work.

As they stated the pool renovation was completed by November [redacted], 2013, I paid $40,000. Only $1,000 unpaid since they said they were waiting for the “Custom Thermal Spa Cover (summer) & Safety solid cover for the winter time” to arrive for my pool.

In the same month, the village of Lake Success issued me violation for “Renovated Pool and New Hot Tub without building permit”, “Hot tub exceeding the permitted height”. Obviously, J & P Pool, Inc. didn’t apply a permit for this job, even didn’t check the local building code when they installed the hot tub. In the “Terms for the Contract”, item #5, clearly stated “J & P Pool, Inc. agrees procure all required permits in accordance with local laws.”

At this point, the hot tub platform and top of platform already finished by Rckwell Developers LLC. I spent $4,000 for Hot tub platform(built with block and cultured stone) and $1,700 for the top of the platform(built with polished blue stone), total $5,700.

On May **, 2014, the village Board of Zoning Appeals denied my application for keeping the Hot tub at the existing high. I spend total $5255.97 for Architect and Village Application fee.

After other 5 months complaining and discussing with J & P Pool, on Oct. **, 2014, J & P agreed to lower the hot tub with a fee of $2,500, and $2,000 for two new “magic stream led deck jets” since the waterfalls were have to gone when they lower the Hot Tub. In this new contract, they were also agreed to supply and install culture stone around hot tub since the platform was gone with demolition.

I paid J & P Pool $2,000 when we signed the new contract.

They lowered the hot tub, installed the deck jets, then they left and never came back to build the new platform and top. I’ve been calling, emailing, texting J & P Pool, Inc. office and the owner Peter hundreds times, but no any actions were been taken anymore by them.

In month of May this year, I had to hire another company to build the hot tub platform and top with spending of $2,000.

As today September *, 2015, the Hot Tub covers never arrived. The LED light for Magic Stream LED Jets and the Salt Chlorine generator never worked. And back in summer, 2014, we found the pool had leak when we just began to use the pool, we have to fill 1,000 gallon water daily to maintain the correct water lever for over these 2 summers.Desired Settlement: Due to J & P Pool didn't apply the building permit and didn't check the local building code, the work they did cause me huge expense and unfinished job. They should pay me $5,700 for the waste of job of platform, $5255.97 for architect and village fee when I tried to correct the problem. $1,200 Water waste from Pool Leaking. And whatever the cost for repair the leaking, repair the salt Generator, repair the LED light.
