The complaint is meritlessYes, we were asked to build a pool and SPA., the SPA (hot tub) was built adjacent to the pool with a spillover water into the poolThis was as per standard codeThe customer was not happy and asked that the SPA be raised two feet so that the water would cascade moreFollowing his request we tore down the SPA and rebuilt it feet higher We advised the client that this was to code but his remark was " this is what I want I will deal with the town legally if and when it complains"We were there when the town inspector arrived and stated the SPA was too high, no other complaintHe also stated that for the average citizen he would let it pass but for this gentleman he had tried so many times to skirt the rues they we not going to let him get away with itWe then tore down and rebut the SPA a third time The client agreed to pay $4,for all the rework which include one year of servicing the pool weeklyWe received $2,and after many attempts to be full paid let the jobIn addition we were asked to get the stones needed for SPA surround Stones he himself orderedWe went to pick them up with our truck and paid $We could not return the open bundle so were stuck for the $which he has not paidWe went back for another set of stones which he did not approve of eitherTwo round trips of trucking is worth over $We then asked that he find the stones he wanted and left the jobOur mistake was not to slap him with a mechanics lien but we decided to be civilThe money he paid for the architect is his responsibilityHe as the home owner is fined for work without a permitIt is not our responsibility nor is it our responsibility to be knowledgeable of every pool spa regulation amongst Long Island's hundreds of towns and hamletsHe tried to beat the system and got caught and must now be responsible for his attemptThe LED light and salt generator does not work as he never paid the electrician to do the work of installing itWe supplied it but it needs electrical work to runThe leak is due to tree planing around the underground piping which pierced the PVC pipeAll we say can be confirmed by the contractor who built his house [redacted] , [redacted] s [redacted] ***Presently he owes us $for the SPA rework, $for the pavers, $for the trucking Please contact our witness for verificationThank you for seeking the truthRegards,Rich C [redacted]
