I am rejecting this response because: I have a contract that was signed by him and me for a total of $122,and it specifies what work was to be done. My lawyer has a copy of that contract. *** *** stated to me on January that if he didn't get that final $5,that I owed per the contract, he will take his crew to another job. I refused to give that last $5,since I had already given $117,and they hadn't even started in the kitchen or even gotten any of the other rooms finished I did not stop them. I only told him of the building inspector on February when I called and asked when I would be getting the $10,I had paid forHe told me it would come the following Tuesday and we were to have a meeting at that Tuesday morning and I never heard from him and never got the AC/heat unit My lawyer told me that the tools belonged to me because they were purchased for use of the house but it will get settled in court First off, there was no lock on the trailer and I have witnesses to that because they loaded the trailer. I was told I had to return the trailer which I did and the sheriff told me that the tools stay in my possession because he has no way of proving who owns what. My complaint is that I paid for materials that I never got and he says he needs the tools that were bought for my house, well, I need the materials that I had purchased for my house and there is a whole lot more money that he owes me. The tools he is referring to are brand new and I have the receipts for many of them. They were purchased specifically for my house. I don't care if his crew was people or people, or if they were illegal are not, I just want the materials that is owed to me. Every single thing they did has had to be ripped out and started over and I am not even going to make a stink about the fact that their work was so shoddy.

On October 29, [redacted] said that she had hired JR Construction Co to level her mom's house. JR Construction Co was not a "DBA" until Jan. 3, 2014 of the new year. We did...

quote her a price of $ 25,000 plus - $35,000 for just the Living Room of the house. I do have picture of the house how it look from the start of construction. Then she asked us for additional work we could do. So she agreed for the following work to be done, But she never signed a contract with us we did it by just agreeing to what she want done. We never had .a crew of 14 like she say. Look at the time sheet we give her. The crew only between 3- 7 guys on the crew. She also claims the guy's on the crew were illegals. She would come over while construction was going on and spoke to the guy's on the crew in English. We did a lot of "EXTRAS" for her at no charge, she does not mention that in her compliant. I didn't make an agreement with her LAWYER.
I made the agreement with [redacted] by mouth, not with a contract and what she claims. She had told me and [redacted] my Super. To stop work because she was going to get an Inspector for an inspection and she would let me know what was the outcome of the Inspector report. She never once call me, email or a letter of the Inspector report. While waiting for the report we when to see the house to see if your "TOOL's were ok. But they were all gone. I call The [redacted] and made a report that all my tool's were gone and materials were missing from the job site. They broke off the lock's of my trailer and loaded my tool's and she claims to have in a storage in [redacted], Tx. So she say's. [redacted] said to stay away from her house and her mom's home until word. This is some of the thing's she claim's against me from her side of the story. I don't how a person kept your "TOO L's and get away with it after BREAKING of my lock's of my trailer. And converting my property and tool's just because she want's to. I try to put theft charge on her for stealing my tool's and property. [redacted] it was Civil Matter. I'm look for a lawyer to get back my tool's and press charges for theft. And claim's me doing wrong while she things it's ok to take my tool's. I haven't work because I have no tool's. There is a lot more to say but, I have to wait the outcome and get a Lawyer to help with my matter's

Started to move furnisher to the back room. Started to demo the living room floor. And started to dig trenches to start to dig for footers. And we went to buy materials for the footers we had dug.
Seconded Week - Nov. /4/ 13 — Nov. / 9 /13
Still digging trenches around the house and inside. And move more furnisher. And we haul off some off the trash we had. And bought more materials that we need.
Three Week — Nov. / 11 / 13
Finally finish digging the trenches in and out of the house. And you added to do more work on the bathrooms and remove the ac unit for a new one. And started the demo work for the bathrooms and ac unit work. And demo the wall and hall way. We started to pour footer this week. Bought materials as needed.
Four Week and Five Week we work at your home. Six Week — Dec. / 2 / 13 — Dec. / 6 / 13
Started to pour more footer and to put beam's and runners. And also to started the Addition of the bathrooms and to do also your mom's room and started demo work.
This week we are working at your home.
You have given us the total of Five checks.
