Initial Business Response /* (1000, 9, 2015/07/14) */

Re: Case #XXXXXX; [redacted]
I am responding on behalf of Missouri Horse Auction and am acting has co
owner. My husband [redacted] and I have operated this business for 30
years and have been at the current...

facility at the Springfield Livestock
Marketing Center since Jan. 2004.
Mrs. [redacted] has frequented our Tack & Horse Sales and
we have had business difficulties with her in the past.
I have attached a log of our detailed conversations via
social network as we did not have her phone number in
our files for communication.

We have been dealing with her for a few months due to
her writing checks at our March sale, which were
insufficient and our April Sale where she wrote 2 checks
out of the wrong account and it was a lengthy process to
get them all paid.
The May sale is when Mrs. [redacted] purchased several
Tack items along with a 2 horse trailer. This is the Trailer
that she has complained about to the Revdex.com.
The night of that horse sale I remember her coming up to
me at my counter and asking me for a bill of sale. I have 2
women that work for me in the office. One for the Tack
and one for the Horses. They both do this on Computer
and I sit at another area in the office. When she asked me
about the bill of sale I asked her to tell me what

transaction had taken place. She said she purchased a 2
horse trailer and she needed a bill of sale.
I asked her if it had a title and she informed me No it did
not. I then told her that the computer generated invoice is
the only receipts/bill of sale that we give out. If a trailer
comes in with no title we sell it as such. She agreed she
was aware of this at the time of bidding and acknowledged
this trailer had come out of Oklahoma.
She never asked me for any of the sellers information and
seemed satisfied as she walked away. The seller sold the
trailer with no title...he wasn't trying to hide anything from
the public and we announced the trailer would be selling
this way...with no title.
The public purchases trailers for many different reasons

and we were unaware or uninvolved with why she bought
this specific trailer with no title. Some people use them for
signs for their farm or business and some people use them
strictly on their farm for moving livestock from pasture to
pasture. The new thing is shabby chic and some like to
decorate their yards. For the people who want to purchase
a trailer for on road use they buy a trailer that has or that
can be titled. Sometimes the situation if fitting, titles can
be obtained due to homemade trailers and due to lost
titles.
On this said trailer this was not the case as it was selling
out of Oklahoma with no title. Everyone in the crowd
knew this as we always state the situation for each item as
we know it.

As far as her claim, we were unaware of her discontent
completely until [redacted] asked her to please contact us at
XXX-XXX-XXXX. You can see from the log that we sent this
message on June 9th at 5:44pm.
After no reply we sent the message again June 10th at11:15 am.
After no response from those 2 messages we sent one more on June 17th at 6:47pm telling her if she doesn't respond
by Friday June 19th taking the 2 insufficient
checks from the May Horse sale to the Prosecuting
Attorney. The Trailer is included on the invoice totaling

the insufficient funds checks and starts telling about this
trailer that she got cheated on and how we misrepresented
it and that we ran the bid up on her. This is all news to us
and she never complained that night or after about the
trailer until we warned her about not responding to our
request for contact and that we would have to go to the PA
if she did not. The owner of the trailer was at the sale and
she could have talked to him and asked anything she
wanted to at that time. She stated in the logs that the
owner high tailed it out of there before she could. I don't
believe for a minute that happened as that is not how fast
these transactions take place. He would have to come to
the office to receive his check and it is upstairs and Mrs.
[redacted] had plenty of time to come up and try and catch

him there if she wanted or needed to. In the end, the truth
is the trailer sold with no title and that is the way it was
and is. What she chose or any other bidder there chose to
do with it was not of our concern. That was for her to
decide. It is not our concern or business what the public
does with items they purchase at our auction. These items
become their property and there is nothing we can do
about that fit is abuse towards an animal then we would
alert the authorities, but for things like tack, trailers, or
vehicles, we sell them as they come in as long as we are
within the limits of the law.
I would like to address the hospitalization of Mrs.
[redacted] that she has mentioned in her claim.
________________

She informed me in the logs that she was in the hospital
and that was her reasoning for the delay in contactingus
about the insufficient fund checks. She never stated that
the trailer situation was the reason she was in the hospital
at all. I feel she is trying to pull out all stops on trying to
make our business be at fault for her purchase decisions
and to cover up for the several past and current
insufficient funds checks she has written. We have been
very patient and kind and we have tried to remain discreet
and business oriented through this entire ordeal, but it
obviously seems Mrs. [redacted] idea of a resolution, is to
slander us and try to see if she can obtain monetary gain
off of her being a victim in this scenario.

As of this date, Thursday July 9th 2015 at 4:06pm, we have
still not received the payment for the outstanding checks
for [redacted] (tack & 2 horse trailer) and [redacted] (horse)
from the May 29th 2015 Tack/Horse Sale.
I have enclosed copies of the insufficient fund checks for
these amounts.
I have also enclosed the logs to which lam referring to in
this letter.
I would be glad to answer any questions that anyone may
have.
Sincerely,
[redacted]
