nameOn November 29, 2016, our office sent an initial validation notice to the address provide by our client as the consumer’s last known mailing addressDue to the consumer’s failure to voluntarily resolve the account, our office began processing the account for administrative wage garnishment by the guaranty agency, pursuant to the provisions of the Higher Education Act of 1965and the implementing federal regulations on April 6, On March 2, 2017, the consumer contacted our office to establish a resolution on the account, and agreed to make voluntary payments while enrolled in the Federal Loan Rehabilitation Program to suspend her administrative wage garnishmentA garnishment is eligible to be suspended once five qualifying payments have been made, and all required paperwork has been returnedUnfortunately, there were several payment discrepancies on the account, and the required paperwork was not returned until June 20, 2017, causing a delay in the suspension processOn July 18, 2017, the consumer’s account was paid in full, and all remaining payments were removed from our systemThat same day, we mailed Release of Wage Withholding (ROWW) to the consumer, and also to the consumer’s employer in order to suspend the administrative wage garnishmentOur office also attempted to fax the notice as well; however, the fax number provided to us was invalidSeveral attempts were made to contact the consumer’s payroll department to obtain updated information; however, our attempts were unsuccessful until August 3, 2017, when a new fax number was providedOur records indicate the fax was successful to that numberWe have reviewed the account notes and call recordings and maintain that our representatives were professional at all times

I would like for them to work with me to lower my payment.  I do not have a problem with paying my loan, but with the interest rate that they have me under, I will never be able to pay off the actual loan.

Our representatives attempted to assist the consumerestablish voluntary resolution; however, the consumer did not commit during the conversation. As novoluntary resolution was established; the consumer’s account was processed for Administrative WageGarnishment.Our representative attempted to contact the consumer via telephone; however, were unable to reach her.However, contact with the consumer was not again established until May 12, 2016. During theconversation; the consumer expressed her desire to establish resolution through a consolidation; however,to date our office has not received the completed application.Upon review of the file, our records show our communication attempts to the consumer intended only toassist her enrollment in a federal program that may resolve this matter for her. The consumer was made aware how her defaulted student loan balance increasedsubject to collection costs and interest in accordance with federal law. The consumer did not enroll inrepayment prior to the assessment of collection costs to her account and while those costs are not repeatedlycharged to the consumer, the charge allowable under the law is based on a formula, or statutory range,provided the amount does not exceed statutory specifications. On January 14, 2017, our client assessed costs atan amount permissible under 34 CFR 682.410(b)(2). Our client also previously mailed a notice to theconsumer that informed the consumer the maximum range, as well as the method of calculation for which suchcollection costs may be assessed. Our office will provide the consumer with a statement of account or paymenthistory upon her request.We do encourage the consumer to continue with the Federal Loan Rehabilitation Program.
