Review: I was building an extension in the rear of my Queens house. Asbestos shingles was exposed and asbestos debris fell within the extension. DEP inspector Nagin Patel posted a stop work order on my front door on 1/**/2013. Licensed asbestos abatement contractor need to be hired to do the work. [redacted] was in contract with me for $10,000 to clean the asbestos contaminated area and do the asbestos abatement behind the siding in the rear wall. He received $5000 deposit. An verbal Stop work order was given by another DEP inspector [redacted] (###-###-####) who came to the worked site on April *, 2013. According to [redacted], "she suspect by looking at the name of the applied sub contractor [redacted], she had previous experience with him before. She came and found unlicensed sub contractor was working, no permit was obtained to clean the asbestos contaminated area, cleaning rear wall asbestos shingles permit was posted on wall, but only cover a small area, not the whole rear wall. Couple of day later after the verbal stop work order, [redacted] showed me the spread asbestos debris in my back yard and driveway which was not there originally. Those debris [redacted] showed me was places so obviously that it was impossible not notice by any one who came to the back yard and knowing there was an asbestos stop work order, and I was in my back yard all the time, there was no asbestos debris was found outside the extension area until [redacted] start working. Because of those asbestos debris, [redacted] had us to clean 1 inch of top soil in the back yard. [redacted] quoted me an additional $9,000 to clean the whole thing, or hire another licensed asbestos abatement contractor to clean the 1 inches contaminated top soil, and he wanted me to have that contractor to clean the contaminated extension area, he said it won't cause me much more by adding the contaminated extension area. He told me he was going to be on vacation soon that I need to make the decision fast. I paid $14,500 another licensed asbestos abatement contractor to do the work.Desired Settlement: He did not do the work, and he did not give me back my $5000 deposit.I want him to refund my deposit, pay my extra cost $4500 which I pay the other contractor who did the work, plus my 3 months lost time.
