I am in receipt of the above complaint and would like to clarify that [redacted] was never informed that [redacted] can no longer return to the facility and the bed was being held for [redacted] return once his rehab is completed. The facility requires a 30 day notice which in this case...

the facility did not receive until Jan 2016. Nevertheless, the facility has agreed to waive the charges in question and has mailed [redacted] a refund payment.Rob S[redacted] Executive Director

Review: The Judith Lynn Assisted Living Facility (which is now goes by name, Amber Court of Pelham Gardens)

recently accepted my 91 year old grandfather ([redacted]) into their facility (November [redacted]). We were asked to pay upfront $5,000 for 1 months' rent and a $4,000 Security Deposit (total of $9,000).

We were told in writing that grandfather would receive Physical & Occupational services at this facility (these statements were later found false)

After three weeks of residence at the Facility, we were told that the Facility is UNABLE to provide proper care for grandfather because of his high level of care needs. My grandfather was sent to a hospital/ another facility for continued care on December [redacted].

The inability to care for a senior at the Judith Lynn/Amber court is actually defined in their Admissions Agreement as grounds to terminate residence and agreement.

However, The Judith Lynn/Amber Court facility has refused to return any of grandfathers ($4,000.00) Security Deposit in spite of their inability to care for him and their transfer of grandfather out of their facility on December [redacted].Desired Settlement: We want a FULL refund of the $4,000 security deposit made on November [redacted] based on misrepresentation of Judith Lynn/Amber Ct Assisted Living facility's care services and their inability to Care for [redacted] as originally promised in their agreement.

Response:

I have reviewed the response by the business in reference to complaint ID [redacted] and I am pleased that Amber Court decided to do the right thing in this case by rightfully returning a full refund to my grandfather, ([redacted]). [redacted] was a resident at Amber Court (aka Judith Lynn) facility for less than one month and he was unable to get required care for his needs at this facility.

Sincerely,
