that the customer knows exactly what’s he’s buying. The customer filing this complaint had been a customer for several years and has previously received shipments of plants with total satisfaction and praise by emails to our plants, nursery and staff (which I can provide if needed). He continued over 2017 to order more plants for later shipping. When a customer buys plants he always receives an invoice. On each and every invoice it prominently states at the bottom that all sales are final and that there are no refunds. It also states that any accepted cancellations or refunds are subject to a “20% or more fee”. At our website on the home page is a link to our refund policies. If you search Google with “Refunds, Jungle Music Nursery”, the first item showing by Google is our refund policy. So, this is not hidden from customers.In our published refund policy it states that “If a plant has been selected and held for more than 30 days for a customer and the order is then cancelled, a 33% or more charge to the customer will be deducted from any approved refund.” The rare cycads purchased by the complaining customer were actually from a series of many purchases over approximately a 12 month period starting in February, 2017. Approximately fifteen invoiced purchases were made between February, 2017 and December, 2017. These purchases included a large number of rare and endangered cycads. The customer requested that we hold these cycads and ship to him via a trucking service in Spring of 2018 or possibly even later. All were tagged and held specifically for this customer. All required continual care such as watering, fertilizing, weed control, pruning, etc. None were or could be sold to anyone else. These plants were taken out of our inventory and held for this customer.On or about 21 January, 2018 I received an email that the customer wanted a refund. He stated that things were such in his life that he needed the money. He was aware of our 33% refund policy on cancellation as mentioned above. He himself calculated the amount that the Nursery needed to refund to him. I agreed that the amount he calculated was correct. I wrote a Memorandum of Agreement between the customer and our Nursery that described the total monies spent on the cycads, the cancellation fee amount, the terms and amount of the refund (set up with a two part payment schedule) and that “Both Customer and Seller agree that there will be no further action and that no other compensation will be sought.” The customer agreed to this with a second agreement a day later which, by the terms of the Agreement, acted as signatures to the agreement.Per the Agreement above, a total of $24,812.20 was refunded to the Customer with payments on 29 Jan and 13 February, 2018. These payments were made to his credit card and done before due dates per our signed Agreement. On February 13, 2018 I read an email sent from the customer that said that he wanted a bigger refund. In this email he wrote “I feel that an additional $6,000 would straighten this up entirely… If you reject this offer, know that I will dispute the entire remaining difference with Discover and will seek to recoveragainst you by any means necessary.  I will also take to the web and begin a blog encouraging the public not to do business with you….”This demand with extortion type insinuations was totally against and in conflict with our mutually signed Agreement. It appears that this complaint to the Revdex.com is the first part of his campaign to smear our company. With our repayment of his Refund, we have totally met and fulfilled the signed Agreement. All correspondence and interactions with him have been professional and courteous. We followed our own published refund policy.
