In response to the Revdex.com issued complaint # [redacted] , Just Drive provides the following response:On January 1st, 2017, Mr [redacted] registered (daughter) and paid the sum of $(PayPal) for the “Behind-the-Wheel Only” program offered by our school Mr [redacted] completed the online registration process via our website: www.justdrivewi.com During the online registration process, all customers are required to enter student information, provide payment, and must electronically sign the Just Drive customer agreement / contract to complete the registration process Pursuant to Wisconsin State Statute (3m), our contract clearly states the following:“just drive will not refund any tuition or part of tuition if just drive is ready, willing, and able to fulfill it's part of this agreement This written agreement constitutes the entire agreement between just drive and the student / parent / guardianNo verbal statements or promises will be recognized I also agree to pay a fee of $for each behind the wheel lesson or observation session not cancelled hours in advance I have read, understood, and accept this agreement.”The above customer agreement / contract was approved by the Wisconsin Department of Transportation prior to Mr [redacted] registering his daughter for our program.It should be noted that our Just Drive website will not accept any form of payment or allow any customer to complete the registration process without acknowledging and accepting the above stated agreement Mr [redacted] agreed to and electronically signed the above agreement on January 1st, For these reasons, we firmly believe from a legal standpoint that Mr [redacted] is not entitled to a refund.We have consistently held more than behind-the-wheel lessons per month since Mr [redacted] enrolled his daughter in our program Mr [redacted] ’s account has remained active since he created the account and Just Drive remains committed to providing behind-the-wheel instruction for his daughter should he decide to schedule lessons for her.Our “Behind-the-Wheel Only” program provides the following services for students:- Upon completion of the registration process and proof of online completion, Just Drive will complete and provide the student with documentation (MVform) required by the State of Wisconsin It should be noted that students who are not years of age must have completed and signed documentation from our company to apply for an instruction permit No student can begin driving without a valid instruction permit, which is why we provide this documentation as part of our service Our company processed Mr [redacted] ’s registration, completed the required paperwork, and mailed it to him on January 2nd, 2017, thereby allowing his daughter the ability to obtain the required instruction permit Mr [redacted] states that he did not use any of our services, which is false– Students enrolled in our program are granted access to our website and may begin scheduling behind-the-wheel lessons once the student has a valid instruction permit Mr [redacted] ’s daughter was assigned student identification number (WY528) and granted access to our website and scheduling calendar on January 1st, An email explaining scheduling procedures was also sent to Mr [redacted] on January 1st, – Students enrolled in our program will complete six lessons Each lesson is two hours long and includes one hour of driving instruction and one hour of in-car observation As of today’s date, Mr [redacted] has not scheduled any lessons for his daughter, but he is free to do so at any time.On or about December 23rd, (months after Mr [redacted] registered his daughter for our program), Mr [redacted] requested a refund, which was denied I attempted to reach Mr [redacted] by telephone to discuss this matter, however, he did not answer my call My office manager exchanged several emails with Mr [redacted] on February 16th, and on February 19th, to reaffirm our position regarding this matter.Customer requests for refunds are reviewed and then granted or denied on a case by case basis based on the factors relevant in each situation Mr [redacted] waited months before contacting me regarding this matterFurthermore, Mr [redacted] ’s request for a refund is based on factors that we do not feel are relevant in this case, notably Mr [redacted] ’s daughter’s anxiety and Mr [redacted] having paid for two separate driving schools We are sympathetic to Mr [redacted] ’s daughter’s condition Had Mr [redacted] made us aware that his daughter had special needs, we certainly would have made every effort to accommodate those needs We have many students that suffer from the same or similar needs as Mr [redacted] ’s daughter In addition, we have many students that have other situations which require special accommodation, including both mental and physical ailments as well as religious restrictions We have always worked with and will continue to work with students in which an accommodation need is brought to our attentionThe first time Mr [redacted] made us aware of his daughter’s condition was in his email requesting a refund, which was sent to us months after signing the contract Mr [redacted] did not allow us the opportunity to work with his daughter, and we continue to remain committed to working with her at any time.Mr [redacted] states in an email to Just Drive on February 16, that his daughter “tried to push through on taking the lessons from Just Drive but eventually found out that our neighbor was enrolled at the local driving school, Lada, and she found herself able to push through her anxiety and take the behind-the-wheel lessons there.” At no point were we made aware that his that his daughter “tried to push through on taking the lessons from Just Drive” as there were no lessons that she had signed up for nor any contact whatsoever from Mr [redacted] to let us know of his daughter’s circumstances Again, had we been made aware of this, we would have worked with the [redacted] ’s to accommodate this situation, and indeed we continue to remain able and willing to work with the [redacted] s.Mr [redacted] states in his emails to our manager and in this complaint that he should receive a refund Our position regarding this matter remains the same Just Drive will not issue a full or partial refund as Just Drive remains willing and able to fulfill its part of the agreement As stated above, as Mr [redacted] has paid for services, Mr [redacted] ’s account remains active and he is more than welcome to use our services If Mr [redacted] online registration process via our website: www.justdrivewi.com.  During the online registration process, all customers are required to enter student information, provide payment, and must electronically sign the Just Drive customer agreement / contract to complete the registration process.  Pursuant to Wisconsin State Statute 343.71 (3m), our contract clearly states the following:“just drive will not refund any tuition or part of tuition if just drive is ready, willing, and able to fulfill it's part of this agreement.  This written agreement constitutes the entire agreement between just drive and the student / parent / guardian. Weather the service is used or not our policy is no refund once the contract is signed.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
I understand a "no refunds" policy if it was a product I took home and used, or if it was a scenario where I had used part of the lessons and caused a hardship with scheduling. Otherwise, I think that for a business to not allow even a partial refund when zero service is consumed is unusual and poor form. So be it.

This can be closed, but I'm not satisfied. I respect a "no refunds" policy if we had started to use the service. We did not use the service, so we are canceling. I don't even need a full refund. It's a shame that the business model for this business is so suspect that they can't even afford a partial refund.
