My complaint is due the owner sending me to collections. I informed the owners staff that I would be cancelling my membership at least 3 months before cancelling. I told the female employee that worked at the front desk and she informed me that she would forward the information to the appropriate person. The young lady I spoke to is named *** and I recall her name because she was having *** with the owner. The young lady ***, worked at the front desk was friends with my employees and thus I knew her name well. Apparently my request to cancel my membership was not sent to the proper person or was ignored. I received a letter stating that I owed Just Lift Gym $160.00 and that I had to pay the amount or I would be sent to collections. I did reply to and informed the accounts rep at Just Lift Gym. I later received email from the owner ***, and relayed the information as to who I spoke with about my cancelation of my membership. I did inform the owner ***, that I would not be paying the fee because I gave more than enough time to inform the gym staff that I would be cancelling my membership that was month to month. I received no response. Months laters I received a notice of collections from a collection agency. I have no intent on paying the fee of now $300.00 plus dollars for something was not my fault. I believe this is wrong and the owner of the *** Just Lift Gym aka ( Just *** Gym) should be held accountable to wrongfully charging his prior patrons.

I am emailing you in regards to *** complaint.
*** signed a 36 month agreement with Fitness MGMT, Inc. DBA VQ Fitness. When Fitness MGMT, Inc. DBA VQ Fitness was going out of business, Just Lift purchased the rights to the contracts. Therefore, the agreement still stands even though he signed it with Fitness MGMT, Inc. DBA VQ Fitness. As the contract states under Section 6. Right of Timely Cancellation CA Civil Code 1812.85-1812.86: After Initial Term: “After initial term, Member may resign from VQ Fitness {Just Lift} by giving advance written notice via certified mail, or signed, dated form as provided by VQ Fitness Staff {Just Lift Staff}…”
As Mr. has stated, he informed the front desk that he ‘would’ be canceling his membership. He did not sign a cancelation request provided by our Staff nor did he send a request via certified mail. Unfortunately, him letting the Front Desk Staff know 3 months in advance is/was NOT an accepted method of cancelation. The derogatory remarks about the owner are untrue and irrelevant. When Mr. revoked the authorization for JL to bill him, JL sent him a billing problem notice. When that went unanswered, JL sent him a collections warning letter. Neither of these were responded to. Please note that canceling his form of payment to JL does not cancel his membership.
Attached are copies of the front of his agreement and the back (I provided a color and greyscale copy, If you still have issues reading it I will gladly send a more legible copy). Please review the front portion “Authorization of Payment” as well as Section 6 on the back of the agreement. I also attached a copy of the notes on his account.
