In response to complaint with assigned ID of [redacted]: This is my rebuttal on actions that took place at my business, Just Pawn It 11C, on July 21, 2015. On April 21, 2015 he had pawned the [redacted] 4 with the serial number [redacted] with one controller in the box....

When he had pawned the [redacted] for $200, pawn Interest payments are due in 30 day increments. He had only made two $50 interest payments on the [redacted], not three, as he had stated. You are always paying for the previous month when you are pawning an item. So technically, when he paid in May that paid for the period of April 21-May 21, & then the payment he made in June, paid for the period of May 21-June 20. He never made a payment for the period of June 20-July 20. He had called the shop on July 17, 2015 to see when he was due; I never called him on that date. He had two options, either make his payment on Saturday July 18, 2015 or I told him that he could make his payment by 11:00 AM on Tuesday July 21, 2015. Yes, I gave him a time because I was being generous, because I did not want to see him lose his [redacted] even though the 21st was after his due date. He called at 1:40 PM on July 21, 2015 & asked to speak to the owner & was told by the young lady that I was busy & that I would return his call when I was no longer busy. The [redacted] was NEVER put on layaway. He never came back to the shop to make his monthly payments. He paid by phone with a credit card & he had no problem using that statement as his receipt. Also, on May 6, 2015 he had pawned 2 items, which were a [redacted] binoculars, which I had loaned him $100 on those items & he got really agitated that I wouldn't loan him more than the $100 that I had loaned him on those 2 Items. The first due date of the interest payment for those Items was June 5, 2015 & he made that payment, but the second interest payment which was due on July 5, 2015 he never paid it at all. I gave him 10 days to pay that & I contacted him several times to try & get him to pay. He never mentioned that in his complaint. I was more than fair with him. He was reminded that if he lost this pawn, the next one would be pulled & sold if it wasn't paid on time, Still, I gave him, as a courtesy, an hour into our business day, to pay. The pawn ticket states; "In the event said Total of Payments is not paid on said Due Date, or my loan renewed by payment of the monthly charge, Lender shall become vested with all right, title and interest of myself and/or my assigns to such merchandise to hold and dispose of as its own property, without any notice to, or demands from me." I call him like I do everyone else as a courtesy at my pawn shop in which I am NOT required to do. I also [redacted] & mail pawn tickets if their phone numbers are disconnected. If he was so interested in keeping his [redacted], he should have called that morning asking for more time, instead of waiting until 1:40 PM to finally call to argue with me because he had lost the [redacted] by that time. His excuse was that he was waiting for an item of his to sell on [redacted] & the money being put into his [redacted] account. He had lost his job because of a DUI & that he is living off of his girlfriend, who is a hairdresser. Those were his exact words. He also failed to mention the way he acted when he came into my shop, stating that I was running a dirty business & that I was dirty. He caused a scene & was rude to me in front of customers & I then advised him to leave. I also have a recording on my voicemail on my business phone line of him stating that he caused a scene at my shop. We did not sell the item on his due date & we are NOT replacing any item for him. I didn't threaten to call the police, a customer in the shop did. There was no discussion of revising his contract either. He went over 30 days & defaulted on his contract. I've also attached a GPS map where he has stated that it takes an hour and fifteen minutes to get to the pawn shop; clearly you can see it is only 34.5 miles, which is 43 minutes without traffic & 48 minutes with traffic. This is a pawn shop, you pawn stuff & if you make your monthly interest payments on time you are able to keep your stuff here. He did not pay on time, he lost his item, & we are not replacing it. He is not worried about his other items that he lost. Please see attached a copy of a blank pawn ticket to show any additional information concerning non-payment & default. If verbal agreements are not binding then he should have paid on a day that we were open before his due date.
