On 10/3/13, Ms [redacted] arrived for her first class and paid her $20 drop-in fee.  At the conclusion of class, Ms [redacted] was informed of every membership option available at that time, which included the ability to drop in as her schedule allows and she would have to pay $20 per visit. ...

She was informed of our Month to Month, 12 Month Annual and 3 Month Paid in Full memberships.  Ms [redacted] decided it made more financial sense to enter into the Month to Month option with the flexibility to cancel at her leisure, with 30 days notice, rather than spend more per month in drop-in fees.  Her first guest fee was also credited towards her membership.  On her 3rd visit, Ms [redacted] was being trained to deliver groin kicks.  She did in fact strain herself, although a torn calf muscle was unlikely.  No treatment to her calf was given without her express permission and with full knowledge that massaging the area would release the cramp and allow her to stand and walk without assistance.  There was no bruising present at any time during or after the massage.   At the conclusion of this class, Ms. [redacted] walked out on her own and agreed to have her calf assessed by a medical professional if the tenderness persisted.  We were never informed of any official injury nor do we claim responsibility for any injury that may or may not have happened on our premises.
Just Results uses American Payment Services as our third party billing agency.  They are bound by the Terms and Conditions of every signed agreement in accordance with state law.  According to APS, Ms [redacted] failed to send her termination letter within the 30 day deadline of her draft date (her first draft was on October 3) and was thus charged one more additional month.  If Ms. [redacted] felt there was a discrepancy with her draft date, or she wished to change her draft date, a written request was all that would have been required and the changes or corrections would have been made. Concerns or requests of this nature are usually addressed within the first 2 months of a membership and not 3 months after a termination has taken place.  No changes to any portion of her signed contract were made at any time. Proof that no dates were changed are reflected in the signed Consent Form we have on file with Ms. [redacted]’s signature and dated in her hand writing the same day as her signed agreement with Just Results.  Ms. [redacted] was aware of the Terms and Conditions of her agreement, was fully informed of the cancellation policy and is bound by the agreement she signed.  Copies of Ms. [redacted]'s signed Consent Form and signed Agreement are available upon request.
