represented the community's association. The community has a newsletter that provides information about pertinent issues and events that are specific to that community. So there was NO reason for anyone to believe the contest was sponsored by the association. The association is NEVER mentioned in any of the newsletters. To date, there has not been any correspondence from the trustees. Any individual or group can express interests in a community through a newsletter, especially when there's no deception that it is representing any other entity.
As mentioned in the complaint, the newsletter advertised the essay-writing contest. The headline stated, "Tell Us Why You Love Barrington Downs & You May Win A $200 Gift Card for the Holidays". With a request for a 200-500 word essay, we expected several home owners to participate. There were at least 20 home owners who stopped by an open house for a chance to win a $50 card in August. Unfortunately, that was not a reflection on the participation for this contest. The contest was extended a few times to give a chance for others to participate. However, the only one person provided an entry. The contest was not created to sell homes. Essays don't sell homes. The contest was created to get a better feel of how the home owners felt about living in their community. It was an opportunity to engage with the community and could have been done at any time of the year.
