06-02-This is in response to case #***Patient *** *** *** (DOB 06:17-1968) This patient was first seen in my office on 04:29-He has told us on his first visit that his left eye has been weak since birth(wife translates for him)Since that visit we have seen him
on 06-10-and gave him a new script for glassesHe then came back on 10-23-- not happy with the glassesWe then had asked him if he wanted to get a second opinion and sent him to see DrW*** on 1023-Each time the patient gives a different answer on what makes him see the best in the phorophter which he likes before he leaves and then gets glasses made and is not hap?? with the glassesA phoropter is an instrument used to test the visual acuity with specific lenses and the patient is to respond if it is clearer or not and this is a subjective response by the patient.The patient has the responsibility to choose the correct lens' correction for the satisfactory visionThe doctor cannot read the patients mind and should not be blamed for the unsatisfactory visual outcomeWe then had also seen him on 11-20-and issued once again another script for glasses that the patient said he could see better with and likedThe patient's wife then stopped in again on 12-29-asking if he could go back to the original right lens from 10:23-and the left lens from 11-20-saying that is what he had seen the best with individuallyDrCappiello had said if they returned to the optical shop *** optical that they went to have them put the lenses back into the frame if they couldSince that is what the patient wanted and he said that is what he could see the best withAfter that we have not heard from the patient until he came in for his next appointment on 05-11-many months later
Keep in mind that the patient had not stopped back to say he was still having eyeglass - problemsHowever when he came in for his appointment on 05-11-he came in with a belligerent attitude yelling a screaming at the employeesDrCappiello talked to the patient and did an exam & refraction on him at no costAfter refracting and the doctor was done checking for the glassesWe asked him if he was able to seeHe said it was perfecto!!! His wife said that he was seeing perfectSo DrCappiello then dispensed another eyeglass prescription and he explained to the wife that we will not bill him for the exam & refraction todayThat was a goodwill attempt to help him and to minimize his angerDrCappiello took almost hours at no charge with this patient to make sure he was seeing the best(This caused a backup of Dr. Cappiello seeing his other patients) He also explained to the patient that he does have some problems medically with the eyes, which could cause some issues with how he sees, Patient through translation of the wife said he understoodI am restricted by HIPPA Law for giving out medical information without the patient's signature approvalThe patient left happy saying he could seeLater on that afternoon he came back because the optical shop at *** Optical office will not redo his eyeglassesWhich were already changed two times, Saying they had changed it too many timesThe insurance company will not reimburse the optical shop and that the patient needs to pay for itThe patient was yelling and screaming again in the office disrupting the patients' exams and disturbing the peace and taking up time with the optician and techsThe wife and the patient were here for another hours arguing that they should not have to pay for the lensThey had been told and explained once again that he wasn't charged for the exam or refractionThis was goodwillAlso this eyeglass problem has been going on for over a year and nothing was said about how he was not happy with the last script he was givenWith all this disruption they were causing a public disturbance in the office againSome of the elderly patients were nervous and scared due to the patient yelling and ScreamingHe was taking up a lot time and time away from other scheduled patientsPatient said I will get a lawyer and looked as his wifeShe said he would call a lawyer and he was not leavingSo it was explained to patient that if he would not leave and stop causing a disruption the police would be calledThe patient's wife said to go ahead and they would wait, They were defiant and would not be quiet in the officeThe Lancaster City Police were called because of the disturbanceAs soon as the police vehicle pulled up in front of the office and we said they were hereThe patient and his wife quickly left out the back door and sped down and out of the parking lotThe police said they would get in touch with the patient and let him know he is not allowed to return to the office, DrCappiello has been doing a service here for approximately years and has never had any complaints.If there is any further information needed please contact my office ###-###-####Due to Federal Law HIPPA I cannot explain any further medical problems regarding his eyesight without being outside the lawWe would need the patient's signature for allowing release of his medical eye recordsIn summary this case has no merit and should be droppedThank you for your consideration regarding this matterSincerely,
