Jim did repairs on pool and hot tub for us for years. So we contracted his company to do new tiles, coping and plaster of my pool and hot tub in 2017. In 2018 when we opened the pool there was frost heaving that damaged hot tub beyond use. I have pictures! The pool had cracked tiles that were visible. Jim said he would make repairs but due to the scheduling he did not come out at all till November. I marked tiles to be replaced with tape and only 10 were replaced in pool. HE did not come out until June 5 2018 and only replaced some of the cracked tile. He did not finish the job and is not honoring his work. He said he will not come back. However, my pool tiles are still cracked. They did not make t through one winter and I had the proper pool closings. I want the work done and the contract met.

Re: Complaint ID: ***; ***JW Contracting, Inc. (JWC) entered into a contract with *** and *** in September 2016 to renovate their existing swimming pool and spa. Conversations and emails began prior to that in spring of 2015 after which the first proposal was sent to them in May 2015. At that time they were contemplating swimming pool and spa renovations as well as removing and replacing their pool deck. After receiving ballpark estimations for removing and replacing their existing swimming pool and spa deck from the owner of JWC, *** and *** decided to do the deck work themselves. The owner of JWC brought to their attention the need to remove all existing concrete around the swimming pool and to make sure that there was proper drainage and an expansion joint between the pool/spa and any new deck materials installed both verbally and in emails. JWC completed the coping, tile and quartz pool finish installation April 21, 2017.In 2018, the owner of JWC received emails and telephone calls from *** regarding some cracked tiles and coping stones. As per our stated warranty, the owner of JWC went to look at and met with the owners concerning the damaged tiles/coping stones. It was clear and both parties agreed that the deck installation by others was the root cause of the damage to the coping and tile. Even though this was the case, the owner of JWC agreed to replace the cracked tiles and damaged coping in the spa and replace 10 cracked tiles in the swimming pool, which *** had marked with tape, when the schedule allowed. In September 2018 the owner of JWC reached out to *** to schedule the repairs . As per email dated 11/20/2018, the repairs to the spa were completed and the following was relayed to them both verbally at their pool during a meeting and in the email:*** and ***,We have completed the repairs on the pool and spa. You'll need to put some water in the spa and make sure it is winterized. Your deck contractor can do the repairs on the deck around the spa skimmer as agreed. Let me know if anything looks out of place or unfinished.Lastly, as I stated in our meeting on November 7, 2018 at 12:30pm at the pool, I don't expect this to be the end of the issue because of the way the deck has been installed. This is unfortunate because in order to correct this problem the entire deck would need to be removed and reinstalled. Therefore, moving forward we cannot be responsible for any further damage caused by this issue on the pool or the spa.Have a wonderful Thanksgiving as we all have a lot to be thankful for!James WJW Contracting, Inc.The following email was received from *** on 11/21/2018:Jim, Thanks for the repairs!!! Really appreciate your help. Did the electrician look at the light fixture w/ water? Have a Happy Thanksgiving! ***On May 20, 2019, JWC received an email from *** stating that repairs had not been completed. There were 8-10 more cracked tiles in the pool and that the electrician did not complete his light repairs. In addition she stated that the repair work we completed on the spa came apart again and that she was willing to pay us to do the repairs again, which JWC declined. The owner of JWC sent the following email in reply to ***. He also spoke directly with *** via telephone.Good Morning ***, Busy Monday morning here. I got your vm. Never did get an email from Scott.I put a call into my electrician about the lights. As soon as I hear back from him, I’ll let you know. As far as the tile, we replaced all of the tile in the spa and some tiles in the pool. As I explained to you last year, the tile and coping will not stay together because of the deck. I’m not sure why you guys think we should just continue replacing tile on the pool and spa when it does not fix the problem. I feel we have done everything we can to help you here. Later in the day on 5/20/19, the owner sent the following email to ***: ***,I heard for Tom our electrician and he said he checked the light last year and they worked. He said he would come by again and make sure. Probably sometime later this week!Even though JWC is not responsible for the tile and coping damage on the *** pool, the owner of JWC agreed to replace 10 more tiles on the pool, which according to *** still had tape on them from last year, and on 6/4/19 the owner sent the following email to ***:***,We’ll have a crew by tomorrow to lower the water level in the pool and replace the cracked tiles. I’ll also have them leave a few pieces of coping as discussed.BTW – Tom pulled the light and did find water in it. He replace the bulb and gasket.When the crew arrived they discovered that there were more than 10 cracked tiles just as the owner of JWC predicted would happen due to the installation of the swimming pool deck. The Owner instructed the crew to use all 20 tiles in their possession to replace as many as possible. It is evident that the continued cause of the damage to the coping and tile is from the deck installation by others, not the workmanship of JWC. We have installed thousands of miles of coping and tile on pools since we opened our doors in 1995. We do not subcontract this work out, we do our own work in house by our own trained, skilled installers. The swimming pool renovation project looked beautiful when we completed renovations in April 2017.
