K& S had spoken to the warranty company, EFG Companies/Maps, on 1/15/2015. K&S Auto Sales was told that Mr. [redacted]'s contract was cancelled on 12/19/2014 and that K&S Auto Sales should be receiving a refund check that is owed to the dealer. We were also told by the warranty...

company that the refund check takes about a month to process. When K&S asked about Mr. [redacted]'s refund and the amount and to send us a document containing how they calculated the refund amount, the warranty company representative had told us that they could not do so because they did not have anything that shows the calculation. Mr. [redacted] had called K&S on 01/15/2015 asking again about the refund. We explained to him that we were waiting on a check from the warranty company and that refunds usually take 30 days from the date the check is received. We told him that we would try to  expedite his refund as soon as possible. K&S received the dealers refund portion on 1/21/2015 via mail with no documents pertaining to the customers refund calculation. When Mr. [redacted] spoke to K&S Auto Sales on 2/6/2015 we told him that we have an amount however we still did not have a calculation from the warranty company and that the check can not be signed by the GM without a confirmation page of refund amount. K&S had contacted the warranty representative on 2/10/2015 after receiving the complaint to Revdex.com from Mr. [redacted]. The warranty representative was able to send K&S Auto Sales a page explaining the breakdown of the calculated customers refund. the resolution for this dispute is that K&S Auto Sales has issued a refund check to Mr. [redacted] in the amount of $2,799.08 on 2/11/2015  along with the calculation page he requested. Here at K&S Auto Sales, customer satisfaction is our goal. Mr. [redacted] had till 2/19/2015 to receive his refund check from our company. When Mr. [redacted] see's his check he will see the date the check was issued was indeed on 2/06/2015. K&S Auto Sales was simply waiting for the calculation page from the warranty company so that the amount refunded to the customer was correct and so that Mr. [redacted] would be completely satisfied with our business.

Review: We saw a car advertised online, went to see it, liked the car agreed to buy it. That day we put a down payment on the car. The car stated it was under warranty, it was clearly marked on the windshield, we took a picture of it and all visible conditions. Went back a few days later to finalize the payment, they removed the warranty from the car without telling us, essentially violating the original contract. It was clear bait and switch. So we took possession of the car and within 10 minutes realized the door was broken internally. Immediately we brought the car to a inspection facility where they determined the car was in a accident and needed serious repairs to pass. Repairs that would affect driver safety, not cosmetic repairs. Repairs worth more than a third of what we paid for the vehicle. We looked back at the original ad and realized they photoshopped out defects with the car that would have indicated there had been accident. We have photos that show the doctored images and photos of the car at the lot that we took to show actual conditions. We called the dealer to complain he told us he KNEW of the damage but he did not disclose anything to us. He knew the steering wheel console was damaged, the door was damaged internally, the locks didn't work and the front of the car was damaged. He refused a refund, refused a trade in.Desired Settlement: We would like a refund or a trade in. This was a dishonest transaction. We want to be made whole and nothing more.
