Hi ***, The issue was never about committing supposed "Fraud"It's actually very common for renters to not show up to the move out inspection (i.eevictions, etc.) and/or leave early for various reasons (i.ework)You didn't actually need to be there since the move out form is filled out by us, not youConsidering those points, we don't necessarily even require your signature on that document for it to hold up in courtWith pictures and other evidence, we can prove in court that the apartment was left in a specific condition, and we can show the actual damages you caused us to incur by showing receipts and invoicesYour complaint here has actually always been about simply not wanting to pay the costs of how you left the rental (i.eyour listed desired outcome in this complaint)Bear in mind that everything was easily preventable on your part, and you actively chose to leave the place how it wasYour listed desired outcome here states that you do not want to pay, and we also received a certified letter stating that you will not payWe understand what you want.However, the fact still remains that you left the apartment in an unrentable stateAnd in addition, we had to pay a cleaning crew, as well as a handyman to repair other miscellaneous items that you broke (i.ebroken blinds, etc.)You clearly did not return the apartment in the same condition as when you rented it, and because of what you have done to it, we had to spend more than what your security deposit amount was to return it to a rentable conditionCan you show how you or your guests/roommates did not cause these items? That is what a Judge will ask you.We've provided you with the legally security deposit settlement statement detailing all these charges, along with pictures to prove itI cannot simply waive actual costs of money that was spentTherefore, I don't believe this is going anywhere and arbitration will only delay our recovery of these funds even moreThis case is being sent to our collection agency, and they will be in contact with you for further questions

Complaint: ***I have attached two documents attesting to the condition of the apartment on the day before my walk-through with *** as well as a photo that I took that shows that it is not in "filthy" condition.However, this is not the debate at handThe issue is not the condition of the apartment when I vacated it, but the fact that *** committed fraud on a contract and is making claims about me. On 1/1/I arrived at the apartment located at *** * *** ** *** *** ** *** around AM to finish cleaning and emptying the unit*** and his wife arrived around noon for our walk-throughAfter a quick walk-through of the apartment *** asked me to sign the move in/move out form, which had no issues listed in the move out columnPer our discussion, I added a line about spackle marks in the second bedroomThis was all that was listed on the document when I signed itI asked *** if he needed anything else from me and he said no and wished me good luck in all my venturesI wished the same and leftI was not asked or invited to stay for any further inspection upon my signing of the move in/move out form. *** then sent me, via certified mail, a packet of photos and an invoice along with the move in/move out form claiming that I owed an additional $for damages to the apartmentUpon inspection of the packet I noticed that the move in/move out form that I signed on 1/1/had been altered, citing "see pics" on a variety of itemsThese photos were not presented to me during the final walk-through, and I did not receive them until I received ***'s letter, sent on 1/24/via certified mail, which I received on 2/8/I had no reason upon leaving the walk-through to expect a bill in the mail as *** told me that everything, except for the spackle marks on the second bedroom walls, looked great

for these repair items and the cleaning needed, so a bill for the additional costs incurred was mailed to ***'s forwarding addressWe've given *** a chance to remedy this situation outside of a court of law, however she has opted to complain to the Revdex.com instead of making payment arrangementsThe bill mailed to *** was for actual damages incurred by us, due to her actions, and will not be waived

When we finished the inspection, which I thought was completed upon my leaving, there was one item on the move in/move out form, which I signed. This was not provided to me upon signing and was altered after I had signed on 1/1. The condition on the apartment continues to not be the issue, the issue is the fraud that you committed on the documentation which I signed.You told me that the apartment looked great, if it really had been filthy, you would have been able to see it. The photos that you have sent show a pretty clean place.
