The contractor continues to deny that he did any of the work incorrectly, despite the reports from the inspector stating exactly what he did wrong. The only acceptable resolution is for the two roofing companies to come together to find a way to work together to solve my leaking problem. I cannot fix my ceiling until the leak is fixed. I do not care if it has been years or years or years - the warranty is for years. I should not be the one forced to put out thousands more dollars to fix a roof that I already paid for

K.C Contracting continues to deny any responsibility for this issue. I contend that, based on the information provided to me from the inspector from Liberty Mutual, regardless of the number of years since the installation of the roof, the roof was NEVER installed correctly or to code. This is a fact. The contract states quite plainly that the labor is warranted for years. The labor was done incorrectly in that the type of roofing appropriate for the pitch of my roof was not used. The leak did NOT occur immediately following another portion of my roof being replaced. It occurred years after that. I am not placing sole blame on one contractor, but the combination of them BOTH incorrectly installing roofing on my home. All I ask is that I have my roof fixed in a way that will ensure the leaking problem will be resolved, so I can then move on to fixing my ceiling.

ID No. [redacted]Complaint Involves: Guarantee or Warranty Issues- It is denied that the claim is a warranty or guarantee issue.Contractors counter statement of the problem. In December 2009 a small portion of the [redacted] roof was replaced at a cost of $2,250. The shingles were warranted by the...

manufacturer - however the shingles are not claimed to be defective. There is no claim that the labor was defective. There were no issues with the roof for 7 years. A second roofing contractor came and worked on the roof that adjoins the area where (7 years prior) K[redacted] installed the roof. Since that contractor performed work, the roof began to leak at the seam area between the two parts of the roof. As a gesture of good will, K[redacted] offered [redacted] $300 towards the cost of patching the area where the leak occurred (after the second contractor worked on the roof). [redacted] has made a claim with their insurance company for the water damage. No estimates for the damage have been provided. [redacted] used the roof for 7 years with no issues. Only when a second contractor worked on the roof was there any issue.Offer of settlement:Demand $3,000Other Contractor should pay $2,500K[redacted] offer: $300 (taking into consideration -credit for 7 years use of roof)- and a full release.

Dear Ms. [redacted],

I am responding to the BBC complaint filed by [redacted] against Kindler Roofing.
1.    The work was done to code. Kindler installed the roof on an existing structure. The roof pitch existed when the replacement roof was installed. The codes addressing roof assemblies do provide for applying the shingle roofing in the manner that Kindler installed the roof. (R9052.1- R9052.7.1) (I have attached the relevant sections of the roofing code)
2.    The installation for this roof type does not call for a  drip edge. (R905.2.8.4-R905.2.8.5)
3.    At the time of installation different roofing repair estimates were provided – the most expensive being a rubber roof. However a rubber roof would not have guaranteed that the leak that occurred, would not have occurred.
4.    The leak occurred 7 years after Kindlers work. There was no leak until after another contractor had come onto the roof and removed some of Kindlers work and put down roofing on the adjacent roof structure.
5.    If anything, the installation of shingles on the main roof by the other contractor could have caused a pitch change where the main roof met the roof installed by Kindler Contracting.
6.    The main roof and alleged “flat roof” were installed by two different contractors (5 years apart) the second contractor is responsible for the less than 2 inch staggering between the two layers of shingles.
7.    The “flat roof” is not leaking, there is no need to install more than 1 layer of shingles on the “flat roof” area.
8.    As shown in photographs 59 & 60, ice and water shield was installed on the “flat roof”

Mr. K[redacted] remains willing, to pay Mr. & Mrs. [redacted] $300 as a good faith gesture.
Mr. K[redacted] is sorry that they have had these issues but he firmly believes that the second contractor is responsible for the issues the [redacted]’s are having.

Please feel free to call me should have any questions or concerns.

Review: In December of 2009, I had a portion of my roof replaced. The contractor installed a roof and gave me a 10 year warranty on all labor and material. 2 years ago, I had another section of my roof replaced by a different contractor. Earlier this year, my roof began leaking again. It caused, and it still causing, significant damage to my ceiling. My insurance company did an inspection and found that both contractors incorrectly installed the roofing. KC Contracting used the incorrect type of roofing for the pitch of roof. The roofing is not to code. The inspector determined that both roofing companies were responsible for the problem. The other contractor has involved their insurance co and we are working toward fixing that section. However, John K[redacted] of KC Contracting refuses to acknowledge any wrong doing and has only offered to give me $300 toward fixing my roof. It will cost $3,000 to fix it. Meanwhile, my roof remains leaky and continues to damage my ceiling.Desired Settlement: I would like Mr. K[redacted]/KC Contracting to remove the improper roofing and replace it with the type of roofing that is required by code in order to resolve the leaking issue. If he does not wish to do the work, then I would like him to pay for it to be done by another contractor.
