For the record, to the best of my knowledge, our company has not received any previous correspondence from your office regarding this complaint. The Attorney General may have done some due diligence when you received this complaint regarding our company’s track record and any previous complaints or litigation regarding our products and services. We have been in business since October 0f 2008. We have installed thousands of jobs since then. We have an A+ rating with the Revdex.com and we have received multiple Awards for customer service. We are not involved in any other litigation or legal situations other than this complaint. Our company, JCASA LTD was formed in Ohio on 10/3/2008. This is registered with the Ohio Secretary of State. Mr*** purchased the gutters that he has on his home on 5/27/2008. He would probably have contracted this work with *** *** in Avon Lake. *** *** was the entity that sold and installed the K Guard Gutter System up until they ceased doing business sometime in 2008. Our company has no relationship whatsoever to *** ***. We did not purchase *** ***, any assets or liabilities of theirs, or transact any business with *** *** at any time. JCASA LTD, has a contract with K-GUARD, LLC of Westerville Ohio that allows JCASA LTD to sell and install the K-Guard Gutter System. JCASA entered this agreement with K-Guard LLC in October of 2008. This contract with K-Guard LLC does not obligate JCASA LTD to warranty liabilities for any other business entity. For the record, JCASA LTD uses the registered Trade Names Clog Free Gutters of Ohio and Dun-Rite Exteriors, Inc. JCASA LTD also has registered the Trade Name NEO Roofing and did use that trade name until JCASA LTD purchased certain assets from the owner of Dun-Rite Exteriors, Incin and is now using the Trade Name Dun-Rite Exteriors, Inc. JCASA LTD or any of the Trade Names associated with it including NEO Roofing do not have any legal issues or unresolved debts now or at any time in the past. JCASA LTD did not contract any work with Mr*** and received no money or form of payment from Mr***. JCASA LTD does, in certain situations, attempt to assist homeowners who have the K Guard Gutter System on their home and who contact us with a problem We do this as an act of goodwill. The “Complaint Detail” states that Mr*** attempted to contact NEO Roofing twice, and “Mike L*** (sic) and he has not returned our calls.” Our CRM software system contains the following entry: Meghan S*** replied months ago12/14/16Mike L*** 12/14/5:AMTo: *** *** *** ***I went to the home to inspect the gutters on the garagethe gutters are level on three sections, and one section has a belly in the gutterthe gutters need to have the proper pitch so the gutters can flush themselves properlyThe customer has had the gutters close to years and has only cleaned out the gutters once.12/14/16Meghan S*** 12/14/2:PMTo: *** *** *** ***Service has been updated. After Mike L*** did the above inspection, JCASA LTD dispatched a crew of workers to Mr***’ home to make the adjustments that MrL*** specified. This work was done by JCASA employees on 12/20/2016. We did not charge Mr*** anything for these services. Given these facts, I would take the position that Mr***’ claim that his calls were not returned is false. Mr*** has since posted inaccurate information on the internet that infers that NEO Roofing has responsibility for his gutter system and disparages NEO Roofing and the K Guard Gutter Product. Given the legal and online approach that Mr*** has decided to take regarding this matter, JCASA LTD considers this to be an adversarial situation and will proceed accordingly and may consider acting to protect its goodwill from libelous and/or slanderous statements made by any person that damage its goodwill. In summary, JCASA LTD rejects Mr***’ request for refund of any amount because JCASA LTD did not contract any work or receive any payment for the work in question. is flat and the amount of water coming off the roof these gutter can not handle it that is why the water is going over the top of the leaf guard and on to the groundWe made this purchase because we were told by the sale person the leaf guard gutter could handle the water coming of the roof..When it does rain we will find out if the problem was correctedIf not we are asking that a refund be given to the church.Thank you *** *** *** if they have any concerns they may contact me ***
I am rejecting this response because: During my initial conversation with Mike L*** he informed me since NEO Roofing now takes care of K Guard gutter systems, NEO Roofing now is responsible for the "warranty work" of no clog gutters and they will clean them anytime debris enters the guttersMrL***'s correction to the clogging problem was to re-pitch the gutters which the company did BADLY!!! Now a bigger problem!!! I tried to call MrL*** times to set up a conversation with him but he did not return my callsI am not looking for NEO Roofing to refund money but I wish to contact the K Guard Corporate office over the failure of this product but MrL*** would not allow this correspondenceAll I wish for is communication with NEO Roofing to resolve the gutter issue
