I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me.  But I must clarify the matter that of all the list of items I claimed builder to solve only one was solved and that is blind of the aft door. Others, not present, buider´s superintendent said they were upgrades so were not solved.A recent call from builder´s inspector to us has explained that they agree to replace the front garden tree of same size and type and install the missing wooden piece of the upper kitchen cabinet. So inspector has required a picture of the cabinet to define color.I´ll keep informing you about final solution of my claim.Thanks,Oswaldo M[redacted]

Dear Sir/Madam:

I am following up with you regarding the Complaint ID # [redacted] from Mr. [redacted] at the above referenced address.  I visited his home on June 12, 2014 to observe his fiberglass tub and marble surrounds.  I found both of the products to be in...

excellent  condition and could not see the defects he pointed out. The [redacted] standards state the scratches must be observable in normal daylight.  Mr. [redacted] states they can only be seen at sunrise.  He also held a flashlight over the surface of the tub approximately ½” to 1” to try and point out scratches or defects.  Again, I could not see any defects. 

As a courtesy we have offered to send out a company again that can buff the marble and fiberglass.  His request to either refund him the cost of the tub or replace the tub seems unreasonable to us as both meet industry standards.  

Please attach this information to our file and let it stand on record that K. Hovnanian Homes takes our homeowner complaints very seriously and when warranted, repair or replace any item(s) that are not up to the Standards of The [redacted] State of [redacted].

“On 9/26/13 we performed the Gold Key Orientation with Mr. [redacted] and his family for his new home. After reviewing the home, no defects or cracks were found in the granite countertop. We met again on 9/30/13 at the Gold Key Delivery which is when Mr. [redacted] closed on the home and all necessary documents were signed as to the condition of the home.  No cracks or defects were present in the granite countertop at the delivery. 
 
On 10/24/13(24 days later) one of our Homeowner Service Managers met with the [redacted] Family in which they revealed that there was a crack in the granite countertop on the right side of the sink.  Although K. Hovnanian Homes clearly did not cause the crack, we offered to repair it for Mr. [redacted] as a courtesy. Mr. [redacted] denied the repair and is requesting to have the granite countertop replaced. We still stand behind our original offer to repair the granite countertop as a courtesy for the [redacted] Family.”

I am very concerned about the response I got from K-hov regarding the complaint.
At the heart of the complaint is the scope of  the events, i.e,  Gold key orientation and Gold key delivery. 
I.            Gold key orientation was on Sept 26th 2013.  We are a first time home owner, for us it was a brand new experience. As the phrase ‘orientation’ suggests,  Gold Key orientation was simply (45 minute long) orientation of the house, it was not  a quality inspection, it only covered  things like where the buttons are, where the garbage disposal was at,  options like  where the electric switches are, where the cables are and we spent some time to check whether we got things as we gave options for and simply reviewed paper works. We did not dig any further. K-Hov manager [redacted] defined the scope of Golden key orientation as orientation and familiarizing with the house, and assured  that we have opportunity to catch problems when we start to live and he defined that there will be
·         15 days,
·         4 month &
·         a year review.
 
II.            Most importantly we were told by K-hov that as we moved in any problems/defects found will be resolved by KHOV. So no discussion of defects took place.
III.            We did not get  the key to the house, so we did not have the chance to review anything that day. At no point of orientation any of us said it has no defects.
IV.            Gold key delivery was 09/30/13 and  it involved me going to the office and picking up the key. Between the orientation and key delivery we did not have access to the house because we did not even close the loan. To show these two events as two separate occasions of reviewing the condition of the home is outrageous and very dishonest.
V.            The granite top can not be repaired, It is not fair that I accept a repaired and defective granite top for the full cost of it and as we found  upon moving in and brought up to them on the very first review. They promised that finding defects in the review is fine and they should deliver. They are already wasting my time.
VI.            K-Hov  already fixed the following problems (avoiding  the cracked granite top problem ) when we reported, these were also  missed in Golden Key orientation
a)      roof painting being thin and blotchy/streaky,
b)      uneven shelves in the kitchen pantry,
c)       master suite bathroom door not being fully painted,
d)     closet hanger rods not sized properly. 
e)      Microwave oven was dysfunctional
 
When master suite bathroom door not being  painted can be missed by us and experts of K-Hov, my question to  K-Hov will be: Is not the  argument that the granite problem did not exist  since we did not catch a flawed argument?  A  crack on the granite top is very minute to notice, you got to look at it in certain lighting and in certain angle.  
We moved to the home from our apartment in Goodyear on Oct 12th  2013 and as we settled down we noticed the granite problem, and on the first review (should have been 14 days review  but k-Hov employees scheduled it late  24 days later) we showed to K-Hov during that visit, which explains why it was brought up on Oct 24th 2013, “24 days later”. K-Hov’s Tracy Smith conveniently forgets that his people came for first review after 24 days. They should ask themselves why it took them 24 days to have a 14 days review scheduled?
VII.            With the granite top  K-Hov is taking a different course of action solely based on their own profit interest, because they are already fixing and fixed problems not found during the so called Golden key orientation. K-Hov never said these problems a) thru e) were not there or we caused them since they  were not  brought up in orientation. My guess is these problems were fixed because they were inexpensive to fix and KHOV would not fix a problem that is more expensive to pick. They should be accountable for their work.

We later found a granite crack afterwards in the master bathroom that was not noticeable during the walk through; unlike you, we were not even offered a repair. Guess when it comes time for a bathroom remodel, this will be resolved. Thankfully, we can cover it with rolled up towels. Sorry yours is in the much used kitchen near your sink! We closed October 2012.

Hovnanian Homes position will remain the same. We clearly did not cause the

crack and will stand by our offer to repair the crack in the granite as a

Review: I purchaced a new home from K Hovnanian in early 2014. I upgraded to a garden tub ( like in the model home) At a cost of 1,800.00. When the tub was installed it was filthy and FULL of screws that damaged the tub surface Beyond repair. K hovanian has offered to buff the scratches, With no acceptable results. Furthermore there are several other scratches to the tub surround (backsplash). Since the beginning of april 2014 K Hovanian has made no attempt to rectify the issue.Desired Settlement: My desired outcome is to have the damaged tub removed and tub surround replaced with a new tub and surround. ( like the model home) I paid for a NEW tub, I want a a NEW tub.

Review: This is from a previous complaint that has not been resolved with Khovnanian. The case # is [redacted]. Khovnanian is NOT telling the whole story. Khovnanian has had trades come out to my house without any warnings. This includes the cabinet guy, paramount windows (who [redacted] was suppose to cancel and DID NOT) and I have had trades mean and cocky towards my daughter [redacted] and I. I DO NOT tolerate mean people. I have told the builder ahead of time that I have doctors appts. but [redacted] schedules people (trades) to come out anyhow. That was this last week again with the plumber scheduled when I had warned [redacted] of my doctors appt 5 days previously in an email. I have been sick with heart problems and breathing and having to deal with stress of this whole mess.

Only this Friday on August 22, 2012 did they come and work on the outside finally. There is still touch up paint outside under the window, replace medal flashing, and stucco that needs to be straightened and then painted around the garage. They want to go back with the same crappy carpet and havent even told me when my stairs will be replaced. I still have smell under my kitchen sink that NEVER got resolved. In fact the plumber replaced my garbage disposable that was in his truck and the smell ONLY got worse. I was told by [redacted] that I could pick a garb disp. out of a spec home and then once again a plumber comes out again and brings one with him. The marble was done in the master bathroom and it DOES NOT look good and it DOES not match. The whole piece of marble needs to be replaced and should of NEVER been installed like that. I have NEVER had in marble cracked in any bathroom

Then mark weber supervisor tells me that they will replace my carpet with the exact same thing. I will just have the same problems. Then khov. DID NOT file a claim with Shaw carpet (manufacturer of carpet) and mark weber tells me in the email that they WILL NOT have Shaw cut me a check for me to go to where I want to buy it for my peace of mind. That is because khovnanian DID NOT file a claim with the manufactuer on my faulty carpet. I have been inconvenienced with more pain and suffering over and over by this builder. They had NO problem putting 5,000 towards my closing costs and they should NOT have a problem having Shaw manufacturer rep come out and for Shaw to cut me a check. After all it is the manufacturer who is at fault. I should have a better carpet then having the same junk put back in because of all of this suffering. This carpet is the worst that I have had out of 9 brand new houses. I have had to live with these issues for over 4 months.

Kovnanian DID NOT bring out the manufacturing person with shaw on my carpet but rather sent out ONLY God knows who, a person who claims he is a certified inspector. I dont know anything about this person and I dont trust him. HE is a third party and once again I dont have his company information. The carpet guy looks at my issues for 5 minutes and would not even tell me what he thought. The first guy ([redacted]) came out on January 21, 2013 and he told me that he has NEVER seen any carpet like mine. Everything is so secretative and I have a right as this being my home to know all about what is going on with it. I paid alot of monies for this house and I should be living in a house free of major defects.Desired Settlement: I am ONLY in this mess because the builder rushed the insdie of my house from September 14, 2012, until October 05, 2012. I have stairs that have to be pulled out and that WILL BE a real mess. We have NOT been able to enjoy our house, since November 16, 2012. I cannot even have my furniture put up because I am still waiting on an answer for the carpet. Thats like paying on a brand new sports car and I cannot even drive it because it has major problems. I want this whole mess resolved more then they ever will and it needs to be ASAP.

[redacted] and I have had to live with these issues for over 4 months now and they should understand and allow me to have a carpet even upgraded. [redacted] and I are worried about drinking out of the ROS under the sink due to the smell and the health issues that we have had with the smell. We have both been to the doctors and [redacted] started a new prescription for migrane headaches. She has NEVER had these problems before. I continue to have breathing problems and will be having a major heart work up in the next month. We need the ROS pulled out because the smell is still there and to use my option monies to upgrade the stairs, since they have to come out anyways. Due to the ongoing pain and the suffering we should have a check cut from the manufacturer so we can go somewhere else to get carpet for our peace of mind. I have this right as the homeowner to file a complaint with faulty carpet with Shaw manufactuer. I have called Shaw and they cannot find a claim number for my address.

Since March 5th 2013 we have scheduled Mr. [redacted]’s warranty items with expectation to have them resolved by March 22, 2013. Emails were sent to Mr. [redacted] stating the date, time, and what trade was coming out on March 11th,14th, and 15th. Due to homeowner availability we have rescheduled for March 19th,21st and 22nd and we were successful completing the scheduled warranty items. On March 28th [redacted] (Division President) and [redacted] (Sr. Homeowner Service Manager) met with Mr. [redacted] to discuss his remaining service requests. At this time we have 5 outstanding items we are currently working with Mr. [redacted] to resolve and expect them to be resolved by April 19th 2013, provided that Mr. [redacted] makes his home available during this time.

Review: I bought a new home build with KHovnanian and I closed on the home on November 16, 2012. The builder rushed everything inside of my home in the last three weeks that it was built. From September 14, 2012, until completion of MY home on October 05, 2012, all of the inside of MY home was rushed and it shows just that. Now I have major problems with rust on garage floor, faulty carpet, bad paint job on stairs, windows that are crooked, marble in master bath beat up and much more. There is also a mechanic greasy smell under my sink that is effecting my lungs due to a heart condition that I have. The builder and employees are aware of my problems and they have let this go on for over 7 weeks now. I have to spend my time upstairs and I am NOT getting the full benefit of my house. This is ONLY causing me more pain and sufferin as time goes by.

The builder has had two different employees out here to look and smell under the sink. On February 08, 2013 one employee [redacted] came out and he admitted to [redacted] (my daughter) that he smelled something. Then he came back out on February 13, 2013, with second employee [redacted] ( supervisor ) and he said that he never smelled anything. Then [redacted] told me that he would have his boss come out and that never happened. Then the plumber came out after [redacted] on February 19, 2013 and he said that he smelled a plastic smell. On March 01, 2013, the plumber ([redacted] last name unknown) came out with [redacted] and then he says that he does not smell anything. These people know there is a bad smell and they are being very untruthful with [redacted] and I. They are contradicting themselfs and saying two different things and I have proof.

The very first time that the plumber came out he left the garbage disposable unplugged. The second time that the plumber came out with [redacted] he turned off my cold water under the sink and left [redacted] and I without cold water. This is uncalled for and intentional and instead of repairing the problem with the smell they are leaving me with more problems. This is done ONLY in retaliation. All of these problems should never even be happening, if the builder would of built the house right in the first place. I am tired of Khovnanian giving me the run around and NOT doing anything to get my house repaired correctly and backing up their warranty. I should expect this though because this is the way that I have been treated by kHovnanian and its employees, since Februrary 2012. As I stated before I will get to the bottom of all this.

I have lived in many brand new homes and NOT once did I experience any of these problems. I will say this again and again, You cannot treat CHRISTians like me this way and not expect to pay from God. You know exactly what I mean by this need to have resolution to my problems ASAP, so that I can get on with my life and enjoy my house.

On 1/8/2013 Mr. [redacted] called in a new Service Request with items of concern that he wanted to be addressed. We set up an evaluation appointment on 1/14/2013 and scheduled 7 trades on 1/28/2013. On 1/21/2013 we received an email from Mr. [redacted] stating he didn’t want all the trades to be in his house all at once. We were told by Mr. [redacted] that he wanted certain trades scheduled at his home only after 2pm. As an accommodation to Mr. [redacted], on numerous occasions, we have scheduled trades to arrive at his home at staggered intervals and dates (and after 2pm) to attempt to resolve the open items. Unfortunately, due to Mr. [redacted]’s schedule and requests, we have been unable to finalize these warranty items. It is our desire to complete these warranty items as soon as

possible. We have been in constant contact with Mr. [redacted] via phone and email and have most items scheduled to be completed the week of March 11, 2013. With Mr. [redacted]’s cooperation, we fully intend to have all of the items resolved by March 22, 2013.

Review: We recently had our one year walk through on our home. Before this, we had an inspector come out and take pictures with detailed notes on several issues. In addition to that, we provided the warranty service rep who came out with our detailed list of surface imperfections and other things not listed on the inspection report that we wanted fixed before our time was up. Both copies were provided to the service rep. He then scheduled the needed trades to come out over a week and a half time span due to conflicting work schedules. Various trades have failed to show up- causing us to call and ask him what is going on. Most of the trades that have showed up have done lazy, sloppy work and not met our expectations in addition to leaving things dirtier than when they arrived. It has been about three weeks since the initial visit with the service rep and there are still many things he has yet to address that we have even reminded him of several times over. For having a detailed list, and pictures with most of the items, I am severely disappointed that I have to keep calling him in order to get these items fixed. Some items, it appears they are avoiding fixing and hoping we will forget about them because they are too cumbersome. For the pride that I initially had when building my home, and the effort I put into maintaining it over the year, I am disgusted that K Hovnanian would treat their customers this way. I initially had hoped that when it was time to move into a bigger home in the next few years, that my choice would be a no brainer and I would choose K Hovnanian. Now, I know I will NEVER chose another K Hovnanian home again nor would I offer their name as a recommendation. The work I have seen lately is shoddy and things have not kept as nicely as one would expect for a home that is only one year old. For the items that I upgraded and paid extra, I am severely disappointed in how they have worn over just one short year.Desired Settlement: I would like other people interested in K Hovnanian for their home builder to know about these issues in regards to ther customer service/warranty. I also would all items on my list to be fixed to my expectations in a timely manner. I would like future trades entering into my home to respect it and leave it in the same, if not better condition as when they entered. I would like K Hovnanian to hire competent people to represent their warranty department.

On 7/5/12 Ms. [redacted] called in a Service Request with

items of concern that her third party inspector found. We set up an evaluation

appointment on 7/12/12 and scheduled our trades on 7/19/12 and 7/27/12 per Ms.

[redacted]'s availability. The homeowner's requested alterations took place as

scheduled with the exception of a couple of items and those items were

rescheduled and completed on 7/31/12. On

8/3/12 Ms. [redacted] let us know that she was not satisfied with the changes that

took place at her home. At that time we set up an appointment to meet Ms.

[redacted] on 8/17/12 at 5pm to go over her concerns. After evaluation all the

items are complete and were done so correctly. Before we left the home we were

ensured that Ms. [redacted] was satisfied with our services we provided to her

home. At this time we asked that ID# [redacted] to be closed.

Review: We had builder K.Hovnanian build our house and moved into our new home in [redacted] in October 14th 2013 and noticed a crack on the granite cabinet in kitchen within a few days. Granite is a strong material and can be cut only with diamond tip to my understanding, We thought this may be caused during installation or it is a fissure in low quality granite, or someone may have dropped it during the construction, and we paid for granite and it better be right- so we contacted the builder K.Hovnanian service management. In the builder K.Hovnanian warranty paper, it is stated that they will fix any defects as we come across. We were assured in the initial orientation to move in the house and live in the house and we got different timelines such as: 15 days, 4 months and one year to find and report any defects. When I asked K.Hovnanian to make good of their warranty and fix the granite problem, we got different versions such as why we did not pick it up in the initial walkthrough/ To which my response is (the initial walkthrough or orientation was a rushed session of 45 minutes with paper works to sign and we were not looking at everything that's why we are given 15 days etc. review.) They also responded that It is a big undertaking to replace so builder K.Hovnanian will buff it up My response it : we deserve what we paid for and not any less either, we want to own a granite top not a problem.. If we want to sell the property this is going to come up. They also tried to create confusion such as someone might have stood on it, may be painters so it is not builder K.Hovnanian fault. I assure everyone that nobody ever stood on it. The location of the crack is consistent with installation related mishaps IMO. I exchanged two emails since December with supervisor [redacted] and I sincerely requested him to resolve this. His blunt reply is The crack was not present at install nor was it there at the initial orientation. We will not replace the granite, but are willing to repair the granite. The granite top can not be repaired, It is not fair that I accept a repaired and defective granite top for the full cost of it and as we found upon moving in and brought up to them on the very first review. They promised that finding defects in the review is fine and they should deliver. They are already wasting my time.VI. K-Hov already fixed the following problems (avoiding the cracked granite top problem ) when we reported, these were also missed in Golden Key orientationa) roof painting being thin and blotchy/streaky,b) uneven shelves in the kitchen pantry,c) master suite bathroom door not being fully painted,d) closet hanger rods not sized properly. e) Microwave oven was dysfunctional When master suite bathroom door not being painted can be missed by us and experts of K-Hov, my question to K-Hov will be: Is not the argument that the granite problem did not exist since we did not catch a flawed argument? A crack on the granite top is very minute to notice, you got to look at it in certain lighting and in certain angle. We moved to the home from our apartment in Goodyear on Oct 12th 2013 and as we settled down we noticed the granite problem, and on the first review (should have been 14 days review but k-Hov employees scheduled it late 24 days later) we showed to K-Hov during that visit, which explains why it was brought up on Oct 24th 2013, “24 days later”. K-Hov’s Tracy Smith conveniently forgets that his people came for first review after 24 days. They should ask themselves why it took them 24 days to have a 14 days review scheduled?VII. With the granite top K-Hov is taking a different course of action solely based on their own profit interest, because they are already fixing and fixed problems not found during the so called Golden key orientation. K-Hov never said these problems a) thru e) were not there or we caused them since they were not brought up in orientation. My guess is these problems were fixed because they were inexpensive to fix and KHOV would not fix a problem that is more expensive to pick. They should be accountable for their work. TheTh
