by *** ***.The facts as pertains to the ***'s flooring are as follows:The flooring was installed in May, The only warranty provided by K & K is labor, which is guaranteed for yearsAny warranty for the material is provided solely by Armstrong, the manufacturer of the floorEnclosed is the Armstrong warrantyIn May, (years after installation), the ***’s first reported problems with the materialAccording to the manufacturer, Armstrong, the problem the ***’sencountered, face checking is a moisture related problem and is NOT covered under warrantyUnder the terms by which K & Kinstalled the flooring, K & K had no legalobligation to do anything further since the manufacturer was blaming the ***s for their problemNotwithstanding the foregoing in August, K & K offered to replace the fewindividual planks that were damagedK & K ordered two boxes of wood and visited the ***’s house on August 30, to perform the repairApr 11:13a Sunny/K& KFloor, Inc ###-###-####Received: Apr ZUTb 12: Ibpil?.2Mr*** ***April 18, 2016Page 210.Unfortunately the color variation in the wood was unacceptable to the ***s and the work was not doneAt the time of the visit, there were only a few planks needing replacement in the entry to the kitchen.When K & K returned on October 13, with boxes of wood to pick out color that matched, K & K’s installer noticed the ***'s kitchen was remodeled and the number of planks to be replaced had significantly increased.K & K has requested both Armstrong and JJ Haines, the distributor, to visit the ***'s house to inspect the floor and neither would visit as based on the pictures provided, both concluded the problem was caused by the ***s.Notwithstanding the foregoing, K & K has offered to (A) replace planks (rejected by the ***s), or (B) use other planks from another portion of the ***s flooring (ie from a bathroom for example) to replace the planks identified for replacement and put a different flooring in the area that supplied the recovered planks (the ***s rejected this)K & K has recently offered to remove and install new flooring as long as the ***s would pay for the material (at K & K’s wholesale cost).We are awaiting the ***’s response at this time to K & K’s latest offerK & K believes it has gone above and beyond its obligations to the ***s.Sincerely,K & K Hardwood Floors, inc.By*** ***, President
