We had several phone calls with Mr*** that we did not record. I did not anticipate having such a problem with this customer to where this would be necessary, though I assure you we had verbal communication regarding the delays and other ongoing projects I was attempting to finish prior to bringing in Mr***'s vehicle (to physically have the space to work on it). When delays were communicated repeatedly Mr*** said "I'm not in a hurry" and so we did not know that he was on the verge of threatening legal action until he sent an email and placed this complaint. We were going to put Mr*** ahead of other customer work because he was inquiring as often as he was and being a "squeaky wheel", but it is not something we like to do, and honestly isn't fair to the other customers that have waited longer. There were and are several problems with the machine shop that was doing the work that delayed the project beyond our control, and it was when this project was in this state that Mr*** chose to no longer be "not in a hurry".
The expertise we provided was indeed toward the best execution of parts to build a reliable motor, and beyond that to an EMS system that was configured originally for the stock fuel system and camshafts as ordered by Mr***, which he later changed to add cams and larger injectors. Beyond that we provided tuning feedback and trade secret information that normally we do not share with customers because we felt we had a good rapport with Mr***, and encouraged his understanding of the EMS system we have been tuning for over years. We helped explain concepts that would be considered advanced topics freely as well such as how to arrive at correct injector response dataHe even mentioned how he could apply some of the information to we discussed to help further his own bike tuning side practice. When asked about specialty tools and equipment and what I paid for them, I provided him details. This open communication feels like communication in good faith that we were never obligated to provide as part of the sale of parts, or required under any purchase or contract made with Mr***.
Frankly I don't really expect Mr*** to be reasonable given the situation or to accept any resolution other than: We are giving him everything he paid for ready as of today 06-08-16. For what it's worth, I don't care to do business with someone who doesn't understand that the work we do is specialized, and does not respect the knowledge andexpertise we have provided for what it is. If you don't understand we are a small business doing as much as we can every day, often days a week, there really is no resolution to be had. I wish no ill will toward Mr*** personally, but we just seem to not be a good fit to conduct business going forward

I am going to have the motor inspected by another shop There is a warranty against defects in workmanship, but I don't have a year to wait so I probably would just have the inspecting shop fix anything that is not correct
I consider this case closed as I do not plan on doing any more business with this company

I was not made aware of this process taking over year I believe his web site posted 3-or 5-weeks estimated turn around time, which is normal Initial estimate by ko racing was done in July I told ko racing that I was not in a hurry and July is a fine date I ordered this engine 2/4/2015.I do not understand the expertise portion Most of the questions I asked were in regards to what parts I should order from ko racing to make x amount of HP Please give me the specific information I asked for? I believe it was only for the ecu that was not configured specifically for my car, which I bought from you There was no billable time broken down on your invoices, or actually anything broken down properly per Oregon State Law.I paid for your expertise when I ordered the motor A build of this power is less at many other competing companies.A specific delay on current projects was not mentioned ever accept on the following response email, before I suggested I was going to get legal assistance This was received May 25, Name Sorry to see this, seeking legal action, if we don't get your car done, on your time line? Once we get your head back from the machinist you can come get all the parts we have for you. We are hoping to get the head back today or tomorrowOnce Kris receives your head he will order the buckets (which takes over a week to get the buckets from Toyota). Then he will contact you to come and pick up the parts you still have here along with your long block and headWe won't be putting your motor in your car or tuning itParts you can pick up transmission, act clutch, flywheel, Fidanza cam gears, clutch master cylinder, Toyota clutch slave and OEM flywheel bolts. This customer is well aware of the lengthy process which it takes to perform the work and rebuilding of these engines to a high level particularly for a one-two man operation such as we have here at KO Racing.  It is our expertise he sought and has received hours upon hours of advice and...

information in evening, on weekends, and all in between to aid him in his project in good faith.  This was in an effort to keep him happy during the process of rebuilding one of our own motors for him to facilitate less downtime on his car (which still runs and drives as of this date) which he has never paid for.  We have a long queue of project cars and engine rebuild projects like Mr. [redacted]'s that have been here even longer than his and take precedent over his project chronologically.  While we always communicated with Mr. [redacted] as to the status of his engine build and the problems encountered with our supplier and machine shop resources, he has decided he is no longer willing to wait through these problems and has started this process to force an ultimatum deadline.  We can not in good conscience provide the best possible work on behalf of Mr. [redacted] going forward under the threats of legal action, or because of filing a complaint with the Revdex.com.  We have agreed to finish all work and or parts owed to Mr. [redacted] as soon as is possible given the machine shop delays, and get him his parts the first or second week of June if at all feasible to do so.  It is unfortunate it has come this and would hope the customer would try to resolve any issues with us prior to feeling the need to file complaints, or send ultimatums.
