Owner promised pictures taken of my damaged roof would be forwarded to insurance company. Insurance company has not received them as of 6/10/19.
On April 18, 2109 *** Project Mgr, of K. Simons Construction inspected my damaged roof and took pictures. On April 19 after talking to my insurance company I asked Mr *** to email those photos to them. He stated that he would not email them unless I signed a commitment to use his company. I said I was not able to do that at this time. (I had not made up my mind as to what company I was going to use. I had estimates from two other companies and they were $1,000 less.) I told my insurance company that K. Simons Construction would not send the pictures unless I signed a commitment. *** at Gulf Stream Insurance said I "should not be strong-armed into signing." After thinking about my pictures being "held hostage" I called *** the owner of K. Simons Construction and discussed this problem with him. He told me FOUR times during our conversation that he would have Mr *** email the pictures to me and my insurance company. A week later I asked Ms *** if she received the pictures and she had not. I called Mr *** and asked if Mr *** told him to email my pictures and he said no. He then asked for my email address. I waited another week and still no pictures. I called Mr *** and Mr *** daily for a week and they would not answer the phone. It is now June 10, 2019 and neither my insurance company nor I have the photos. If I would have been told upfront that documentation of my damage would not be forwarded to my insurance company unless I signed a commitment I would never have let Mr *** on my roof. He wasted my time. Two other roofing companies did not have a problem emailing my photos to me and my insurance company. I believe that if you tell someone you are going to do something you should follow through. Mr *** did not do that. I was lied to.

Desired Outcome

I want my photos emailed to me and my insurance company as promised.

I am responding late to this complaint because it was sent to an old Texas office address that has been closed for over 3 years. This old Texas office is not connected in any way to K *** Construction's offices in Florida. Also, the email address the complaint was sent to is an old email address. I am just now seeing this complaint for the first time. In regard to the complaint.. We do not find a *** in our system as a contracted customer. *** states in the complaint that he/she did NOT sign a contract with our company. It is possible that we completed a storm damage inspection at this property. However, we never engage with a property owners insurance carrier without having a signed contract with that property owner. We are not obligated to perform work on behalf of a property owner without a signed contract. We are sorry if there was any misunderstanding with ***. We do not feel this complaint should be attached to our Revdex.com profile because the complaintant is not and has never has been our customer.

I do not accept the response because I was promised my pictures would be sent to my insurance company without signing a contract. Mr *** told me 4 times during our telephone conversation that the pictures would be emailed. He would first email them to me and then I could forward. He asked for my email address which I gave him. I also gave my email address twice to *** (the picture taker) when he requested it. I am not going to sign a contract with any company until I know my insurance company is going to pay for a new roof. The insurance company will not make that decision until they see the pictures. Mr *** spent over an hour on the phone with me telling me what a honest person he is and how reputable his company is. He wasted my time telling me how long he has been in the business, what brand of shingles they use and why other brands are not as good and basically patting himself on the back. I made and ate my dinner during this long conversation. He reiterated 4 times that I would get my pictures. If something as simple as promising a customer their pictures and not following through, makes me wonder what kind of promises would be broken over the installation of a new roof? If I cannot trust the word of Mr *** (I was told he was the owner by another customer) how can I trust anything else from this company? Mr Zibull states that I was not a customer because I did not sign a contract....I beg to differ....a customer is one that contacts your business to do business. If he wants to mince words ..... then I am a potential customer that he would want to *** over by keeping the word of his representative. The insurance representative was shocked that I would be "strong armed" like this. K.*** Construction has already endured the expense of the adjuster coming to my house, inspecting my roof and taking the pictures. Emailing the pictures would take at most a couple minutes. There is no great expense in this. But the reputation of this company is now in jeopardy. In this small community word of mouth can make or break a company.

I'm sorry that there continues to be some confusion and misunderstanding in this matter. K *** Construction is national storm restoration contractor with 38 offices nationally. We highly value our customers, and take pride in providing great customer service. We have successfully performed thousands of quality roof installations in Florida over the past 10 years. Nationally, we maintain a Revdex.com A+ rating, and have dozens of 5-star online reviews and repeat customers. 100% of our work is insurance-related. We perform free storm damage inspections for property owners. Once this inspection is completed we inform the property owner of our findings and recommendations. At that point, the property owner can choose to (or not to) sign an "insurance contingency" contract with our company to become a contracted customer. This signed contract gives us permission to communicate with the property owners insurance company to discuss our storm damage assessment. I don't understand why *** would feel that asking for this signed contract is a "strong arm" tactic. We never pressure a prospective customer into signing a contract with us. Our contract clearly states that if the property owners insurance carrier does not approve our estimate, the property owner has no obligation to our company. It has always been our company policy to require this contract commitment before performing any additional work beyond our free inspection. Asking for this type of contract commitment is commonplace with any storm restoration contractor. As for the pictures that were taken of this roof, we agree that if one of our inspectors stated he would forward pics to ***, he should have followed through. Unfortunately, we have no way to verify the existence of these pictures, as the inspectors that *** mentions have not worked for our company in months. This perhaps explains why ***'s call to one of these previous inspectors was not returned. Additionally, all incoming calls to any of our office location phone numbers are answered, recorded and logged 24 hours a day, 365 days per year. We cannot locate any calls from *** to any of our office numbers, nor to our national toll-free number. This Revdex.com complaint is our first knowledge of this issue. We always respond immediately to all calls that come directly into any of our office phone numbers. We will be happy to send another inspector to this property to start fresh. However, we would require a signed contract in order to create an actual contractor-customer relationship.

So now you are stating that *** that presented me with a business card (I still have) saying he is Project Manager for K. *** Construction at 3604 W Hwy 390, Panama City, FL XXXXX, cell phone XXX-XXX-XXXX, office XXX-XXX-XXXX no longer works for your company? Also that *** phone number 352-667-2034 no longer works for your company? All the more reason one should not do business with your company. When I called Nick I specifically stated I wanted a company that was local and has been here for a long time. He said he has been here for 14 years. He presented himself as the owner of the company. So I was duped into thinking he was telling the truth when he said he would see that I got my pictures because he has been here for years and would be for many more years. He spent over an hour telling me how honest he is. I would like to point out that when Mr Christian came to my house he never presented me with a contract. He said verbally that the estimate was $14,999. I had nothing in writing. He said he would work with my insurance company for me. I said I wanted to work with them myself. I had no understanding of what he was talking about. I said "is this an AOB because I do not want one of those?" He said it is not. I handed him the email address of my insurance company and he took it without saying anything further. I called my insurance company after he left and told Ms Harris what his quote was. She said send the pictures and estimate. I then called Mr *** & told him what she said. He said "Are you ready to sign a commitment?" I said "no I am not signing a commitment with any company until I know my insurance company is going to pay for a new roof." He never said anything about if my insurance company did not pay that I would not have to pay myself. He let me believe I was committed no matter what happened with the insurance company. Then is when I called Ms *** back and told her she would not be receiving my pictures because he wouldn't send them without a signed commitment. (He never called it a contract) Ms *** is the person that used the phrase that I should not be "strong-armed" into signing. Mr *** was here on April 18, 2019. I stewed about this until April 29, 2019 in which I called *** that I believed was Mr ***'s boss and owner of the company. Mr *** said that the company had the same software as insurance companies so they were able to communicate with the insurance company better than I could. He could tell I was very upset about my pictures being held "hostage" and asked if sending my pictures would make me "happy." He reiterated three more times during the conversation that he would contact Mr *** and have him email my pictures. He asked for my email address. I waited about a week and called my insurance company to see if Ms *** received the pictures. She had not. I then called Mr *** and asked him of Mr *** told him to send my pictures. He said no. He then asked for my email address which I gave him. I waited a couple more weeks and then started calling both gentlemen. They would not answer their phones. I gave them a target date and said if pictures were not sent I was reporting to Revdex.com and Facebook. I waited another month before doing that to give them time to send. Now I am told that they no longer work for the company so my pictures cannot be found. I do not understand why this company operates this way and why a potential customer is not told about signing a contract beforehand. Two other roofing companies came over, took pictures, gave me a written estimate and emailed the pictures to me and my insurance company. That is how I expected this company to follow. They were not forthcoming into saying a contract had to be signed. I would not have let them on my property had I known. So now the bottom line is: K.*** Construction has unscrupulous business practices in which people are duped. Their employees don't stay very long (probably because they do not agree with these practices). I looked up their Revdex.com rating before allowing them to come to my home. It said they were not affiliated. There was no rating. Mr *** stated about this 5 star rating and I said there was none and no affiliation. After that I checked again and there was an affiliation. If there is a 5 star rating I did not see one for Panama City. It must be for other cities. My prerequisite for a roofer was someone local and would be here for years to come. This company still looks to me that they just follow the storms and then leave. There are some bad reviews from when they were in Texas. No wonder they pulled out. If K. *** is going to hire employees then they need to hire honest employees that live up to their word. Other companies would *** their word anyway for the sake of the company. I will follow up to see if these two gentlemen have in fact left the company. It could be true since Mr *** said he was from Nashville. Makes me wonder how I would get warranty work done if needed?
