Hired K Construction to demo old roof and re-roof November 2017.Job is incomplete. Contractor lies when questioned. Possible fraud on permitting.

Hired KC to do a complete roof demo (of old) and re-roof (new wood, tar paper, peel & stick membrane, and clay barrel tile). Contract was signed with *** in my home on 11/21/2017.

Decision to re-roof home was made based on age of existing roof and active leaks. This was expressed to , who stated he would be able to begin immediately.

Contract called for 4 payments of $4,200=$16,800
1st-Initial Deposit of $4,200 paid on 1/21/2017.
2nd to be paid upon tar paper install and dry-in
3rd to be paid upon peel&stick membrane install
4th to be paid upon install of clay tiles and total completion of job.

*** went silent on me and would only respond via text about possibly starting. After hounding him KC finally completed the demo and dry in of tar paper in mid February, nearly 3months after signing the contract (2nd of 4 payments made).

On 2/25/18 *** stated he would finish the second portion, peel and stick membrane. The peel and stick did not get installed, then the run around truly began. I then realized he never had a permit even hanging in front of my home for the job. After confronting him he finally admitted he had messed up the permit which he never disclosed to me and began to lie about coming back over to the house. I had exposed tar paper for a roof and began noticing it flapping and peeling in certain areas around 3/20/18 which was conveyed to him via text. I even experienced several leak spots beginning again. 3/24/18 the Peel and stick was finally installed and remains exposed to this date.(3rd payment made).

After re-reading the new permit once he finally brought it out it appears he has forged my signature and initialed lines on a portion of it addressed to me the "Home Owner". I could be reading it wrong, but there is a part of the permit roofing form#300 that speaks to "Owner's Notification of Re-Roofing. I don't remember signing anything like this and as the form states the contractor is supposed to go over the information on the form with me.

Since 3/24/18 I have received every excuse in the book as to why the finishing clay roofing tiles have not been installed yet. There are two other homes on my block that started a new roof after us and have already finished.

Furthermore, the Boral Peel&Stick membrane product specs state that it cannot be used as a temporary roof for more than 180 days. So I'm close to 90 days on that clock as well. I'm starting to receive heat from my HOA over the matter.

I have spoken to Suncoast Roofing Supplies out of Ft. Lauderdale who *** supposedly ordered my roofing tiles from however they had no record of KC or *** making an order for my address and furthermore, had never heard of *** or KC. *** no longer answers any phone calls and only responds to text messages occasionally.

At this point I just want the job to be finished. Once the tile is installed I owe one final payment, which at this point I don't feel as though I owe him. Considering how long the tar paper was left exposed and now coming close to the manufactures specs of maximum exposure for the peel& stick membrane I feel as though my sub-roof will be deficient to hold up to long term weathering.

The roofer no longer answers any phone calls. He will only text me back. Consistint lies about coming by to finish, show me the invoice for the roof tile order, etc.

Not sure what else to do at this point.

Desired Outcome

At this point I want him to finish the job and he can considering himself paid with the 3 installments he has.

After was all said and done, my roof was finally completed. The owner of K Construction (***) was conciliatory towards my complainants. After some negotiation we were able to reach an agreement at completion of the job. Mr. was paid in full and stood by his companies work and warranty.
