Review: Please accept this as a formal complaint concerning:

K - 3 [redacted] On May 20,2013 K-3 Enterprises entered into a contract with [redacted] Homeowners Association, a client of ours. According to the contract, K-3 was to etch and resurface with epoxy then apply a concrete stain to sixteen sidewalks. The company provided a two year warranty, with no conditions, on the work.

Within six months some sidewalks had begun to deteriorate. By May 2014 it was reported to the contractor that the stain on fifteen of the sixteen sidewalks had begun to peel off.

The Board of Directors has offered several options to the contractor in order to bring closure to the problem. Mr. [redacted] has failed to comply with their requests. I am enclosing copies of recent correspondence.

The Board of Directors would appreciate any help that you may provide in this matter. The board is willing to release K-3 from the contract if they will agree to remove all stain from the stoops/landings and steps.

If no agreement can be reached, our next step is to file a complaint with the State of Virginia, as Mr. [redacted] holds a license with the DPOR.

This is in response to a complaint filed with the Revdex.com against K3 Enterprises, the ID number is indicated above. Customer was told at time of application of stain not to apply snow ice removal chemical products on the same surface. Within a month of original stain application snow ice removal chemicals were applied which started the flaking of stain and of concrete.

[redacted] had notified K3 by email and phone call in May 2014 and requested that the walks be sand blasted. After exploring this option it was determined that EPA Regulations will not allow this practice due to airborne particle issues.

K3 did not receive further notification from [redacted] until 11/3/14 via email. A call was made at that time to the property management group. The letter to the Revdex.com states that notices were sent in August and September. K3 had not been by post office box regularly but when checked did find a letter dated September.

After checking my schedule, I have notified the property management group that K3 has scheduled to complete the stain removal from steps and landings beginning December 10, 2014 or sooner if possible.

K3 discussed the stain removal process with the property management group. Concrete is a porous substance and it may not be possible to remove all of the stain. Property management said they understood and agreed. K3 will do everything possible to remove the stains from the steps and landings. Upon completion of this task the contract signed by K3 and [redacted] is to be considered null and void.

Review: Paid company $3,800.00 to install privacy fence. After several months parts of the fence kept falling down. Called several times, and he did come out several time to fix. After 1 year, the fence is falling down and bowing all over. We have tried to contact the company several times, and at first he promised to come out, never did. Now he does not return our calls. We have had 3 fence companies come out and give estimates on fixing. All have stated that the job was done incorrectly. He did not use proper equipment and materials. The job was half done to make a profit with using cheap materials and labor. We are in the process of getting more estimates to have the fence completed correctly.Desired Settlement: Would like for the company to at least either refund all or most of the amount we paid so we can have another company complete correctly. We have taken pictures to show how the fence is falling apart

March 13, 2013 Re: Case #[redacted] Revdex.com/case number K3 Enterprises Per our conversation I am responding to the customer complaint by the [redacted] family that your office is handling. This job was completed before Memorial Day 2011. At that time the job was completed and customer signed completion form. Mr. and Mrs. [redacted] were an acquaintance who approached me about building their privacy fence. They had gotten quotes from other companies and felt the other quotes were too high for their budget. I came out, took measurements and carried information to Home Depot. At Home Depot I spoke to a Home Pro regarding the fencing project. Store personnel gave materials list and explained how fence should be done. I went back to customers and gave them the price of $3,800.00. They told me at that time that the nearest estimate for the job was between $5,200.00 and $5,400.00. We discussed the information that the Home Depot pro had given me. The customer agreed, gave deposit. Construction began, and upon completion remaining balance was paid. In July 2011 I received a call from Mr. [redacted] while on vacation at the beach. A wind storm had come through the area and had taken down neighbors trees and damaged one side of the customer’s fence. Customer said it was not K3’s fault and would I come fix it. I said yes and upon return from vacation I went to site, repaired the fence by adding additional concrete to reinforce. I did not charge anything for these repairs, all labor and material costs were taken care of by K3. The customers said they were satisfied with the repair work. I did not hear from customers until October 2012 when they called to say that some posts were leaning and some boards were twisting. After initial installation it was suggested to customer that the fencing should be treated with a water proofing product to help pickets maintain shape. This is similar to treating exterior decks. I asked in October 2012 if the boards had been treated as I had suggested, they replied no. K3 then offered to come out to make repairs but customer would be charged for materials and labor since the 1 year warranty had expired. The next time I heard from the [redacted] family was in January 2013 in a voicemail. The customer was threatening to contact the Revdex.com if I did not repair their fence free of charge. They did not accept my previous offer to repair for the labor and material charges. K3 regrets that any issues have occurred. The job was not cut on materials for profit. All materials were purchased at Home Depot and installed according to their plan. Please feel free to contact me with any questions. I am hopeful that this situation can be resolved. Mr. David Kibler states his original response stands. K3 offered to come out to make repairs but customer would be charged for materials and labor since the 1 year warranty had expired.

[We still stand behind our previous statements. Mr. Kibler never offered to come back out to do any repairs at a charge to us. He never returned any phone calls either. We have since had the fence taken completely down and replaced correctly. We have not had any problems with the fence since it has been redone. Regards, [redacted]
