Client was difficult to work with from beginning, giving me exact photos to replicate and balking at my raised prices (from her cousins photoshoot 4 years ago). I had a gut instinct that I should not book the client, but she was persistent, so I did. She was very kind to me during the session, as I...

was to her. I give 1-hour max for my $300 rate, which includes 20 images. It is NOT guaranteed that they will get to chose their images. No one ever gets extra images without paying for them. The only time I allow clients to choose is if there are many more than the standard 20 images. In her case, there were 20 original files. I edited her files and sent them over within the timeline. She got exactly what she paid for, so there is no need for any refund. If you notice in the attached image, she has downloaded the files 10 times from Oct 11 to Oct 29- so I would assume if she hated the photos, she would not have downloaded them so many times. I believe she is happy with the product, she's just mad she didn't get to choose. I tried to explain it to her through many emails but she wouldn't take no for an answer, so she ran to Revdex.com to complain. I have many happy clients. This is my busiest time of year, and I am confident I gave her the 20 best images from the session we had.

There was no signed contract, only email. Here is where I quoted her the price. I *did* tell her in the following email I'd let her choose, however, there were not more than 20 great images. It was my mistake assuming we'd get many more photos than 20. This was something new I was testing out... letting clients choose if there were more than their allotted amount. In her case, there was not. Like I said before, she got 20 images, which is exactly what she paid for. Here is her gallery: [redacted] -- I even gave her copies in black and white. I do not see anything wrong with any of these images. Her son was 3 years old, he was a busy kid and wasn't in a great mood, as most 3 year olds are... She had unrealistic expectations for him. He had a train in every picture and she wanted to get it out of his hands, but it made him scream. The first half of the photoshoot was fighting him to get rid of the train. I told her that we should pick our battles and I began taking photos with it, and as you can see, the photos mostly have the train but he was happy. The client came to me prior to the session and told me not to take very many photos of her stepdaughter, but to make sure I didn't let her feel left out. So I could have taken many more of her stepdaughter, but she told me not to, because the session was a FAMILY session and also about her son. So there were 20 great images. Still, she got exactly what she paid for. I do not even know why she's complaining at this point.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

Regards,
[redacted] The Revdex.com asked whether the company's response has addressed the issues and the answer is no. Kacy continues to refuse to offer even the slightest redress. The relevant section of Kacy's response is her first few sentences:I "did" tell her in the following email l'd let her choose, however, there were not more than 20 great images. It was my mistake assuming we'd get many more photos than 20.I have submitted evidence of Kacy's agreement to send me 40 photos to choose from. Kacy acknowledges that I was supposed to choose and admits that she did not take enough great images to send me to choose. The reason she did not take enough photos was because she admittedly cut our session short. The mistakes were hers and I should not be paying for them.Kacy glosses over the fact that the offer and acceptance we exchanged through emails does in fact constitute a contract –$300 for 40 photos to choose from. I paid her but did not get what I paid for. Kacy has many times admitted that she did not take enough photos during our session but believes that this failure on her part absolves her of her responsibilities. She fabricates terms that never existed when she says that choosing was not guaranteed. Incredibly, she says that I, the client, should have known that the number of photos the professional photographer obligated herself to take was too high of an expectation with a toddler involved. I thought she admitted that she assumed we would get "many more photos than 20.” And through our many email communications, Kacy was well aware of the age of my son. I thought getting pictures of the family, including my toddler, was the whole point. I thought taking pictures of little ones was this lady's specialty. I think Kacy's statement is utterly ludicrous and truly shameful. And of most importance, you will not find any statement that choosing is not guaranteed anywhere in our communications because it does not exist and was absolutely never conveyed. If you go into a doughnut shop with a prepaid voucher for two dozen chocolate eclairs, they box them up and you get home and open the box to find one dozen glazed munchkins, you did not "get what you paid for” because you got the "very best" glazed munchkins and it is you're your problem as the patron that the doughnut shop didn't make enough chocolate eclairs that day. Kacy keeps saying that because she thinks that the pictures I got are so great, I should just be happy with what I got, I paid her $300 for a particular package, and it was not the "get what I get" package. The fact that the several people in my family have more than one computer between us and have downloaded the link a few times to save the handful of pictures that we are happy with is irrelevant. Yes, I do like a handful of pictures. They are great. But I am unhappy with many of them as well. I’m sure if I had received the 40 I paid to choose from, I would have found many more I was happy with. As previously stated, the only reason paid this much money is because there would be a decent amount of pictures to choose from.Kacy' statements about my kids are skewed and it is disturbing that someone that makes her living on families would "go there” to avoid reimbursing a few bucks. I did tell Kacy that the focus of the session was my son's three years pictures and that I wanted pictures of him but I also wanted some of my step-daughter, the two of them together and a couple of family shots. I never told her NOT to take pictures of anyone. We spent maybe three minutes total trying to get the train away from my Son. If she was able to take such great pictures of him with the train, why didn't she take more instead of telling us she had plenty of pictures and cutting our session short. Why didn't she take more pictures of my family. We were all sitting on the ground in front of a barn still ready to go when she cut us off and said we were done. It was at that point, in fact, that I asked her if we had enough photos and she said we had plenty. If you look at the Session, you will see there really aren't many shots of either of the kids alone and only a handful of them together. I should have had several more.It is clear that Kacy has no intention of reimbursing me what I am due unless she is compelled to do so. Obviously, I want half of my money back as that is what I am due. But I also hope that other families that are considering Kacy and are smarter than I was read the Revdex.com reviews and make a thoughtful decision before paying out their hard earned money to someone who treats clients this way. I encourage you to read the other complaints and to be scrupulous when reviewing the positive reviews- all but one having been written within a few days of each other.
