On September 3, 2014 Mrs. did purchase a Sentria II from Kairos Industries. As with any business that sells products in the home to conswner and users we do have a 3 day cancellation policy. Mrs. class="Apple-tab-span" had until midnight on the 6th of September to notify us of her wish to cancel. It clearly states at the bottom of each of our contr< .cts "To cancel this transaction, mail or deliver a signed and dated copy of this cancellation notice or any other written notice, or send a telegram, to" and then states our address. Here at Kairos industries we do strive to take good care of our customers and even though it isn't lined out in the contract, when a cm.1omer calls our office within the three days as noted on the contract we will accept a verbal notice of canc.;lation. Unfortunately this was not the case with Mrs. Kairos Industries never received anything from the customer until she called us on September 12, 2014 to tell us that she wanted to cancel. She did state at that time that she had "tried" to get ahold of the sales person ( ), but never mentioned having spoken with him. Mr. later called in stating that his wife had signed the cancellation on the fourth of September, but that their f<XK was broken so they were unable to fax it to the office, and that they were unable to deliver it, or mail it because their car was broke down and they would have to usc a taxi. Before getting ofT the phone Mr. informed the office manager that he was going to bring the Kirby to the office and give it back. Per company policy the customer was informed that the Kirby would not be accepted because their cancellation period had expired. They informed us at that time of their intention to file a complaint with the BBB, and that they would get a free Kirby because we would be unable to collect any money from them. They then hung up the phone and we didn't hear anything else until on November 3, 2014 we received your letter and the credit card company put the money for the purchase in a holding account until the dispute is resolved. Review: I purchased a kirby vacuum cleaner on April 30, 2014 from an man [redacted] who works for Kairos Industries. Their address is [redacted], Phx, Az 85027. The phone number listed is ###-###-#### and [redacted] phone number is ###-###-####. I spoke to [redacted] once regarding bags that he was to deliver after the purchase. I never heard or saw him again. I have tried calling both numbers repeatedly to return the vacuum. The number listed for Kairos Ind just hangs up immediately and the number for [redacted] has a message that says "you are not authorized to call this number by your account holder. I would like to return this vacuum but have been unable to do so because of their lack of contact. According to the contract I had until 5/3/2014 to cancel my transaction, which is something that was never discussed at the time of sale.Desired Settlement: However I did read the contract and have been trying to return the product since before the 3rd. I do not know what avenue I can pursue next accept to come to you and complain about the business practice. Please advise how I can cancel this contract and return this unwanted product.

Review: I am compelled to write you to point out some important information about the earlier letter faxed to your office. It has reference to the date of the sales demonstration done in my house by sales persons from Kirby's/Kairos.

[redacted]. as he identified himself, with his "assistant"/observer and their supervisor came on the 3rd of September, not the 6th that was erroneously entered in my first faxed letter dated September 19th. I called Kirby for cancellation the next day, September 4th, not the 5th as was written in the faxed letter. I am also enclosing the copy of my bank statement to show that my credit card was charged $1,900 on the 5th of September, after I have already called in the cancellation of transaction. Virtually I was entitled to cancel until the 6th from the time of sales transaction. I did not call on my bank to order a stop payment because I though may card has not been charged until the transaction is undisputably final, allowing me three days from the time of sale to cancel should I change my mind. I immediately changed my mind and cancelled the transaction the following day the 4th. It was inaction on the part of this company or its sales person, [redacted]. & his supervisor that resulted the non-cancellation, and now they claimed it was my fault when I have complied according to what I was told by [redacted].

Also please find the picture of the items (the vacuum cleaner set) that was used during the demo and has since been untouched from the time [redacted]. left it here. I had hope from the first time I informed him of cancellation of transaction he would come out and get it back. Of course he collaborated with his supervisor instead of uphold the truth that I had ordered him to cancel the sales as early as the 4th of September. When I talked with him then after he had talked with his supervisor, he tried to persuade me that I will get extra belts or bags. I insisted that I really do not want the vacuum cleaner, that it was a needless purchase that my husband discouraged me to get into from the start. I felt I am victimized by these people despite efforts to try to resolve this matter in a reasonable manner. In the meantime, I have filed a dispute form with my bank in the hope that the amount Kirby credited off my account will be credited back.
