Property Management Agreement with Kamehameha Realty started on June26,2010. Section E Rental Services-item #4 states - Agent shall do a check in and check out inspection of the premises plus annual inspections. In year of 2016,checked with *** if any unit insp. were done. Was informed that insp. must be requested. Contacted property managing agent( Stanley S )and requested a unit insp. ( never done )On 9/27/17 contacted S.S*** and again requested for a unit insp. On 3/19/18 called S. S and asked if the insp. which was requested on 9/27/17 was ever done.( replied never got to it )Called back this same day and said a insp. was scheduled for 3/21/18. On 4/17/18 called S.S*** and asked if insp. was done on 3/21/18. He said that the carpet in one bedroom had been replaced and that the rest of the carpeting seemed stained. S.S*** called me back this same day and told me that the carpet was not replaced but covered. He could not provide any info on the condition of the rest of the unit. On 4/30/18 contacted S.S*** and requested that a thorough insp.of the unit be done as to this date we have no idea of the condition of this rental unit. He said he would do another insp.and also provide us with photos. On 7/11/18 called S.S*** and asked what happened to the insp. and photos he claimed he was going to do back in 4/30/18. He replied ( I FORGOT ). He then said he will do the insp. Note: We've been trying to get this agent to fully perform this function since 2016. The space within dates that I've contacted him clearly shows his disregards to my concerns and the contents of the Property Management Agreement that we've signed. On 7/13/18, received call from S.Shimabukuro. He informed me that he went to the rental unit and said the tenants had removed all the carpet and had installed some type of laminate flooring without any written consent by the landlord as stated in Rental Agreement Hawaii Assoc. of Realtors Standard Form item S #1.

First and foremost, I would like to apologize to *** for the frustration that this situation has caused him. At Kamehameha Realty, we understand that a rental property is an investment, and as the managers of this investment, that communication is very important.
*** who has recently retired, is my father, founder of the company, and previous owner of the business for over 35 years. Kamehameha Realty has been a family run business from the start and Stanley has been a property manager for as long as I can remember. However, in this case, I am sorry to hear that Stanley was not able to satisfy *** request.
While I don’t doubt his statements and time table, I am surprised to hear about this complaint. Given the length of time that *** has been disappointed with the property manager, I would expect that *** would have reached out to our staff to express his complaint and requests. That would have solved the problem immediately as one of the other property managers would have certainly helped Stanley to meet his requests. However, we have no email or phone message records from ***, and we thus were not aware that this problem existed until recently.
Annual inspections are not a standard item in our property management agreements due to our low management fee. When agreed upon, it will be on an individual basis. I can confirm that this is the case with *** rental property and moving forward, an annual inspection will be completed if applicable.
The Kamehameha Realty staff strives to provide the best service and takes responsibility of avoidable mistakes. Before this complaint was even filed, *** compensated *** with $1,500, which was the cost quoted to purchase and install new carpet. This is in addition to the fact that *** already received free flooring as he was not charged for any labor or material costs. Additionally, the tenant was notified not to make unauthorized upgrades to the property. We have the signed notification from the tenant, which is always mailed to the owner with his owner statements. As a client of ours since 2010, I believe *** is familiar with this.
It is true that we failed the client in communicating and following through with his inspection and carpet installation requests. We have been trying to make it right since the mistake was made. It is unfortunate that *** would take his complaint to a public forum after receiving free flooring and being additionally compensated for the full amount quoted for installing carpet in case he still wants to do so.
For the above reasons, I do not believe that this is a fair representation of our business nor were we as a company given a fair chance to stop the escalating problem. I am truly sorry that this situation has occurred, but I believe that *** has already been adequately compensated for our mistake.

Complaint: ***

I am rejecting this response because: the response does not clarify the term being used ( plus annual inspections ) that is used in their Rental Service Agreement. Please clarify this in writing so all parties will understand the meaning of this term being used to prevent future misunderstandings.
