We bought our truck in Sept 2019. Our purchase agreement and the odometer says that the truck had 118,000 miles on the truck. We decided to trade in the truck at another location and when they ran the CarFax on it the truck actually had over 240,000 miles when we bought the truck. We ended up putting another $2300 down because our trade was not worth the original trade amount because of the mileage. I reached out to Kanabec Auto Sales to try and find out how this could have happened. I told Eric I need proof showing that when he bought the vehicle the odometer read 118,00 but he failed to produce any evidence showing this. Had we known the correct mileage we would never had purchased the truck and upon talking to the bank they would never had given financing if they had known. I also have the report that says that Eric registered the truck for sale in July of 2019 saying there was 240,000 miles but never disclosed this to us. This tells us that he knew there was a discripency in the mileage. If he had no knowledge of this then he can legally go after who he bought the truck from but we have to legally go after him. And if he did know then he should be held liable as this is against the law!

I hope this email finds you doing well during these times. This email is in response to the complaint filed by Tim ***. When I received the Ford F-150 in question the odometer read 118,940 and when Tim purchased the truck the odometer read 118,949. With this being said I had no proof that there is supposed to be somewhere over 240,000 miles on it. When Tim purchased the truck I told him I do not pay to run a CarFax for him but I could pull a AutoCheck for him or he could go online and pull a CarFax if he wanted to. The AutoCheck I pulled and showed him did not show any issues with the title or odometer reading. The issue arose after Tim and his wife Christy went and traded the Ford F-150 in for a new truck at Miller in St. Cloud, Mn. I guess the issue came up (I don't know how many days after the deal was done at Miller) when Miller in St.Cloud decided to pull a CarFax on the Ford F-150 after they had already signed out Tim and Christy *** on their new truck hence finalizing the deal. In fact the deal at Miller in St. Cloud had been finished to the point that the lender that they had the Ford financed through me had already been paid in full and sent them the lein card. After Miller in St. Cloud pulled the CarFax and noticed that according to that there was supposed to be 240,000 miles on the truck they then called Tim and Christy and told them, I never once gave them anything or had any idea that the odometer reading was different. Tim and Christy then proceeded to stop back in to talk with me about the issue. They stated that they needed to give Miller in St. Cloud $1,000 extra to make up for the mileage difference (Keep in mind this is after the deal was done there.) that they found on the CarFax. I told Tim and Christy that I would talk with my boss and get back to them. Upon calling them back and telling them we would write Miller in St.Cloud a check for the $1,000 to help them out and show good faith the price all of a sudden jumped to $2,500. We then told them that we would like to get the truck back so we could have our attorney look into the deal as they threatened us with the fact that they contacted their lawyer and were going to go after someone for fraud. After they brought up their lawyer I informed them that I could no longer talk with them as they wanted to pursue legal matters. I have included copies of the paperwork from the deal showing that they signed acknowledging that what the odometer read was to the best of mine and his knowledge.

We have over 10 pages showing that the truck had over 235,000 miles at the time that Kanabec Auto Sales purchased the truck. The previous owner, as there have only been ourselves and the original owner) would get service on a regular basis and would go to the same place every time. Each time this vehicle was serviced the mileage was recordered. Kanabec Auto Sales registered this vehicle in July 2019 that it was ready to be purchased. It was registered at having 240,000 which was never expressed to us. We asked Eric to get us proof that when he purchased the truck that he was deceived as well but he would not produce anything. The title he sent for proof shows the odometer reading at "18" then says N/R and actual miles checked. Why would it say that if there were actually the 118,940 miles on it? None of this makes any sense.
Our trade in with Miller has only proved to show that the actual mileage was falsified. Eric admits that the CarFax reports that their are over 240,000 miles on the truck.
Eric NEVER offered any compensation. If he had offered the $1000 he claims to have offered we would have accepted it and been done with the whole mess. Miller was simply asking for the $2300 they over paid on a trade. We simply told Eric that we needed to contact an attorney as we were not sure what to do. We are being pulled in two directions and we have done nothing wrong. We purchased a truck showing low miles and that was not delivered. Also to note Eric never showed any kind of paper before he sold the truck to us. We would never had purchased it if we had known there were that many miles on it.
We have never disputed signing papers with Eric. The "proof" he sent to you only shows that he sold the truck with a specific amount of miles on it 118,940 from a title that does NOT have the actual odometer reading on it. I still see zero proof that Eric purchased this vehicle with the actual mileage.
