Please be advised that I represent Kanawha Valley Fine Jewelry and Loan (KVJL) in the above referenced matterKVJL respectfully disagrees with the allegations set forth in the ComplaintThe customer has pawned over items with KVJLOf those, he has redeemed and forfeited The customer is well aware of our policies and procedures with regard to pawnsThe customer knows that the policy of KVJL is to hold a pawn for days with a day grace period before it is placed up for saleThe customer pawned his motorcycle on September 26, by November 16, no payment had been made and the motorcycle was forfeited just as the other items this customer had pawnedHe claims that he came into the business on October 26, but did not have the $paymentHe further claims that he was told he could make the payment on November 26, KVJL has no record of such a conversationIn addition, such a conversation would be in violation of KVJL policyIf the customer had shown up on October without the payment he would have been told that he still has days to make the $payment before the item would be forfeited and placed up for saleWithout knowing who the customer allegedly spoke with makes it impossible to determine if a conversation ever took placeHowever, KVJL is confident that the customer was not told he could skip the payment and make it up the following monthRegardless, the customer was well aware of what happens when payment is not receivedThe customer also complains that the motorcycle is still in his nameKVJL is in the process of having the paper work, transferring ownership, completed with the Department of Motor Vehicles (DMV) pursuant to policyThe license plate has also been turned into the DMV pursuant to KVJL policy.I hope this addresses any concerns you may haveIf you need any further information or if you have any questions, please do not hesitate to let me know

For your reference, details of the offer I reviewed appear below.I do not agree with the response. At the end of October I did go in with little less than and they did tell me they had to have the full amountI went on to ask if I could pay it all on the of novThey made that agreement with me and put memo in computer and said I would be in on the 26th of NovemberThe money I came in with that day I paid and got my ridgid comb tool set out, so the guy who made that agreement with me will be on that receipt on your computerWhen I went in on the 26th of November with payment the manager *** told me it had been pulled on the and sold that Sunday.The memo was on the pawn ticket about me coming in on November to payHe did not know why it had been pulledThis should be on video along with the bike should be on video when they had bike out on the floor for saleAlso I came in January and spoke with manager *** he also said memo was on the transactionI tried to get a print off he said he did not know how toHe called the employee by the name of *** that had sold the bike to ask about the tags and he did not know what had happen to the tagsWhat I dont understand is that the KV pawnshop sold the bike to a individual without taking the bike out of my name and the individual drove the bike out of the pawnshop because the bike is no longer thereI would call that title jumpingThat is illegal Also if the bike would happen to be in an accident I would be liable. I also would like to say that I have pawned many items and KV pawnshop has always work with me on transaction even when some pawns were overdue and grace period had expiredThey would still let me pay on themI trusted KV pawnshopThat is why I trusted them with my bikeIf that day they had told me, no they needed money right then I would have borrowed the money from somebody so I wouldnt lose the bikeI paid over for the bike, now if I wanted to just let the bike go I would have sold it to the Pawnshop but I did not want to lose bikeI think the KV pawnshop is in the wrongThey should have never made an agreement to extend my timeVideo surveillance should be checked over it will prove that the agreement was made and the KV pawnshop is liable for my loss of my Harley Davidson.

well aware of our policies and procedures with regard to pawns. The customer knows that the policy of KVJL is to hold a pawn for 30 days with a 7 day grace period before it is placed up for sale. The customer pawned his motorcycle on September 26, 2017 by November 16, 2017 no payment had been made and the motorcycle was forfeited just as the other 86 items this customer had pawned. He claims that he came into the business on October 26, 2017 but did not have the $200 payment. He further claims that he was told he could make the payment on November 26, 2017. KVJL has no record of such a conversation. In addition, such a conversation would be in violation of KVJL policy. If the customer had shown up on October 26 without the payment he would have been told that he still has 7 days to make the $200 payment before the item would be forfeited and placed up for sale. Without knowing who the customer allegedly spoke with makes it impossible to determine if a conversation ever took place. However, KVJL is confident that the customer was not told he could skip the payment and make it up the following month. Regardless, the customer was well aware of what happens when payment is not received. The customer also complains that the motorcycle is still in his name. KVJL is in the process of having the paper work, transferring ownership, completed with the Department of Motor Vehicles (DMV) pursuant to policy.
