Hello, I dropped payment off after 6pmWhen I reviewed my lease agreement, it doesn't state that if using drop box after business hours payment will be posted next business day

I am rejecting this response because: I've read my lease agreement and I do not see where it states that if I use the drop box, the payment will be posted next business dayAs I have stated to the management at Kapolei Lofts I dropped payment via the drop box on the 3rd

To begin, [redacted] Residential Management, LLC (hereinafter "FCRM") takes residents' complaints very seriously. As such, I have comprehensively reviewed Mr. [redacted]'s Complaint....

Having completed my review, I have detennined that FCRM has acted in a permissible manner and pursuant to the tenns of Mr. [redacted]'s Lease Agreement. As a result, the desired settlement outlined in Mr. [redacted]'s complaint is not warranted.Pursuant to paragraph 2 ("Rent") of Mr. [redacted]'s Lease Agreement, "Rent is due in full in advance no later than the first day of each month." Furthennore, paragraph 3 of Mr. [redacted]'s Lease Agreement provides, in pertinent part, "Rent received after the due date will be considered delinquent. Ifthe Rent is received after the third (3rd) day of the month, the Resident agrees to pay a late fee of I 0% of the monthly rent as additional rent along with the delinquent Rent as pennitted by state/local law."In an email from Mr. [redacted] to Nathan L[redacted], New Development Operations Manager, on January 27, 2016, Mr. [redacted] states, "I dropped my payment late on the third [of January] in the drop box" (emphasis added). The term "late" ht Mr. [redacted]'s email establishes that he more than likely dropped off his rent after working hours (i.e., 9:00AM    6:00PM).  Accordingly, hispayment was not received until the next day, Tuesday, January 5th,  Due to this, Mr. [redacted] was subject to the late fee as set forth in paragraph 3 of his Lease Agreement.Although it is unfortunate that Mr. [redacted] was assessed a late fee, he should have made arrangements to pay his rent on the first of the month, or at the very latest, during regular business hours on the third day of the month in order to avoid being charged a late fee. It is clear from these facts that Mr. [redacted] was properly  assessed a late fee for the month of January because his rent payment  was not received  until the 5th of the month.   Therefore, the desired settlement outlined in Mr. [redacted]'s complaint is not warranted.If you have any questions, feel free to contact me at the phone number listed above.
