On January 19, the Propsective Purchaser entered into a written planning agreement that clearly stated that" This agreement is for the preparation of plan onlyIt does not secure lot availability nor house or lot prices as they are subject to change without notice"
The Prospective
Purchaser was fully aware and it was confirmed to them prior to entering the planning agreement, related to the original amounts that "As discussed it is basic at this stage as we would really need a final plan and all details to confirm."
Prospective Purchaser was charged simply for cost of invoices from the drafting company (provided) as per the written agreementWe have no motivation to mislead as we realize no profit from the drafting of the plansOur staff had expended many hours with this customer to accommodate their numerous changes and request in the formulation of the final custom plan and pricing to their specifics and preferences

In full confidence we treated this customer fairlyOn May 16, we provided a summary of costs complete with the respective invoices and provided a cheque to her to complete the balance refund amount
We further responded with our letter of June 6,
I found it puzzling that when concluding our last in office meeting (April 28, 2016), when we offered to do a further pricing review for her she left and commented that:
"She did not see any point in us doing any further review as she thought she would not be proceeding anyway regardless of the price."

We trust this provides the clarity required and confirms that we have treated this customer in a fair manner in keeping with the agreement that was entered into by both parties

I am rejecting this response because:[redacted] As such, I keep repeating that this is not about the signed a contract for drafting fees. This is a complaint about what we feel is a gross misrepresentation.  We proceeded with signing a contract for drafting fees based on a greatly inaccurate estimate.  [redacted] We believe there needs to be a warning to the public so that this does not happen again.My recollection of our last meeting was different to Mr. H[redacted]s comment that, "I did not see a point in a further review regardless of price" . I did not say this at this meeting.  He only offered a minimal reduction in price. The difference from estimate to actual was still too great for us to proceed.  In fact, I sent Mr. H[redacted] an email on May 3, after our final meeting asking if he had resolved the low estimate.  Additionally, prior to our final meeting we asked your builder representative, Margot P[redacted] what could be done to adjust the price. A reduced price was presented, but it was still much higher than estimate and it meant we would have to eliminate many features, outlined in initial discussions and documentation, which were important to us. I look forward to a prompt response. We have expended a great deal of our time on this and would like to bring it to resolution.
